Dunno how other lawfags feel, but the only way I'd let my client on the stand in a criminal trial is AFTER many, many cross-exam prep sessions.

 

Not opposed to it. But no way I'd do it without that.

Direct exam is scripted, it's gonna be ok.

Cross is different.

These prosecutors do not appear ready.

Can't fault them for yesterday's cross exam - that was all the defense attorney's work. Couldn't be avoided, they're the only witnesses the prosecution had to work with anyway.

Every case is different.

There's plenty of cases where the only real hope your client has is to testify.

It usually doesn't happen, though.

Most lawyers aren't ballsy enough to do it.

Most clients aren't smart enough to do it.

And attorneys get to hide behind the jury instruction where the judge instructs the jurors

that they can't assume guilt from a defendant's refusal to testify because of 5th Am rights.

__No one who's ever represented a criminal defendant thinks that jurors do not

secretly take that into account, in their hearts, when deciding a case.

It's human nature. If you're not lying, why hide?

 

You're mostly not wrong, anon, but not 100% on target either. There are no absolutes in court; and you can't predict everything.

Done a few hundred trials - small, big, civil and criminal - and in every trial, you just work with the situation you've got.

He's still a very young man, this whole thing has to be really painful for him.

If he's got God, he'll get thru it and be all the better for it.
