'Rust' movie script did not call for Alec Baldwin to fire gun

 

SANTA FE, N.M. —

A lawsuit claims that actor Alec Baldwin never should have pulled the trigger of a gun that killed one crew member and injured because the script never called for the gun to be fired.

“He took a gun loaded with a bullet, pointed it at human beings and pulled the trigger and shot the bullet that killed people and seriously injured others, Los Angeles attorney Gary A. Dordick. “That conduct is reckless."

This lawsuit filed in California on behalf of crew member Serge Vetnoy alleges that Baldwin was practicing a move for a scene they were about to film when he pointed it at the direction of Vetnoy — who was in charge of lighting. The bullet barely missed him.

“The bullet that killed Halyna Hutchins and injured Joel Souza passed by Mr. Vetnoy’s face so close that bullet fragments hit him in his face,” Dordick said.

So what does all of this mean for Baldwin?

“I think this is the first of probably many civil lawsuits we're going to see,” KOAT legal expert John Day said. “It's almost like a race to the courthouse who's going to get in first, who's going to make claims.”

Day says he doesn't believe the new information revealed in the lawsuit is going to affect whether Baldwin is charged.

"At the end of the day, the investigation seemed to show that when Alec Baldwin pulled the trigger, he was told that there was nothing in that gun that was going to hurt anybody else, Day said.
