Hung jury more likely. All it takes is for the dark side to get to one juror via threats and/or inducements.
For murder, it takes all 12 to acquit. If there is even one holdout, they are hung, and the dirtbags could try him again. Unless the judge at that point said prosecutorial misconduct, and calls a mistrial with prejudice.

No man is an island, and this judge is no exception. He is aware of the furious brouhaha about the trial, and importance for the country, and what might happen after a verdict is reached. IMO he feels strongly that Kyle will be freed, and wants to deprive the left side ravers from the ammo of claiming they had Kyle,and the judge saved him.
