From some things I was reading last night, apparently he could wait for the jury to report their results to him, and still has the option to declare mistrial. If the holdout jurors come over to reason and honor, and vote not guilty on all charges, well there we are. But what if a juror or two is afraid, but decides to vote not guilty on everything but one charge? The judge could then accept the not guilty(s), and declare a mistrial with prejudice on the remaining charge. Nearly total victory it would be.
