In my scenario, the appeal possibility would not really matter, because if only one charge remained, and it was 11-1 for acquittal on that one, they and everyone else in the world would know that there is zero chance of convicting, so what's the point.
The overall position and momentum on the board have changed. If NG goes out in position, and people come at them with weapons of any kind, their chances of getting lead poisoning are higher than in 2020. As to the chance of 500 NG being overwhelmed by a mob of thousands, that they just don't want to open up on, that ain't gonna happen. The slime are just not that many, though the fake media strokes them up into a righteous army of millions. Plus, regular citizens, real Americans, have had enough.
