Army announces punishments for unvaccinated soldiers – here they are

U.S. Army soldiers who remain unvaccinated and either have not requested an exemption or have had their exemption requests and appeals denied will be allowed to serve in spite of the Army’s COVID-19 vaccine mandate, but they will be barred from reenlistment or promotion.

In a November 16 memo obtained by Government Executive, Army Secretary Christine Wormuth laid out how the service will handle punishments for soldiers who defy the military-wide vaccine mandate. Wormuth’s memo authorized commanders to flag soldiers.

Soldiers who refuse the vaccine without an approved waiver will not be immediately separated from the service, but their military careers will be stalled out at their current ranks with no chance to serve beyond their current contract period.

Soldiers will also be barred from being issued awards and decorations, attending military or civilian schools, applying for tuition assistance and receiving bonuses and assuming command positions.

“The Soldier will remain flagged until they are fully vaccinated, receive an approved medical or administrative exemption, or are separated from the Army,” Wormuth wrote.

“I authorize commanders to impose bars to continued service…for all soldiers who refuse the mandatory vaccine order without an approved exemption or pending exemption request,” Wormuth also wrote.

Lt. Col. Gabriel Ramirez told Military.com, “At this time, the secretary has not authorized any separations with the sole basis being refusal to follow the COVID-19 vaccination order.”

Wormuth’s memo applies to both active and reserve components of the Army, as well as the National Guard.

Wormuth said all soldiers covered in the memo who refuse the vaccines without an approved or pending exemption request will remain flagged.

It is unclear how effectively Wormuth’s memo can bar reenlistments and promotions for troops serving in the National Guard, who serve in both state and federal capacities. The memo comes in the days after Oklahoma National Guard Adjutant Gen. Thomas Mancino said the state’s National Guard would not be requiring troops to take the vaccines and would not take any punitive measures against those who refuse the vaccines.

Eugene Fidell, a military law professor at the New York University School of Law, told Defense One the question of whether state governors or federal officials have ultimate authority over the National Guard will likely be determined by the courts.

The Army’s method for dealing with soldiers who refuse the vaccines differs from the U.S. Air Force and the U.S. Navy. Last week, the Navy began the process of separating sailors who refused the vaccine and warning those that are denied their vaccine exemption requests have five days to start the vaccination process or vaccine separation.

During a Nov. 18 Facebook townhall, Air Force Secretary Frank Kendall was asked whether he wants unvaccinated Airmen separated from the service, to which he responded, “It’s actually a pretty straightforward question. The bottom line is that willfully disobeying a lawful order is incompatible with military service. And to get a vaccination is a lawful order.

Apple Sues Israeli Spyware Firm NSO Over Surveillance of Users

Tech giant also wants to ban NSO, whose software has reportedly been used by governments to spy on journalists and dissidents, from using its products

Apple said on Tuesday it has filed a lawsuit against Israeli cyber firm NSO Group and its parent company OSY Technologies for the surveillance and targeting of Apple users with its Pegasus spyware.

The iPhone maker said it is also seeking to ban NSO Group from using any Apple software, services or devices to prevent further abuse.

NSO's Pegasus software gives clients total access to target's cellphones and has reportedly been used by several governments to monitor the phones of reporters, lawyers, opposition politicians and civil society workers.

“State-sponsored actors like the NSO Group spend millions of dollars on sophisticated surveillance technologies without effective accountability. That needs to change,” Apple's announcement quoted Craig Federighi, its senior vice president of software engineering, as saying.

On Monday, credit rating agency Moody’s said NSO stands at risk of defaulting on around $500 million worth of debt, which would force it into insolvency.

On November 3, the U.S. Commerce Department said that it was adding the company to a trade blacklist, restricting its access to U.S. technology and potentially hobbling its ability to do business.

Following the U.S. Commerce Department announcement, The New York Times reported that Jerusalem would petition Washington to remove the company from the blacklist, citing two senior Israeli officials in reporting that the Israeli government considers its software a crucial component of its foreign policy and national security.

NSO’s senior management has lobbied Prime Minister Naftali Bennett and other ministers from his government to pressure the U.S. government to lift sanctions imposed against the company.

Affidavit: Migrants held hostage, forced to package narcotics

Two men have been arrested for allegedly holding migrants hostages and forcing them to package illegal narcotics, according to an arrest affidavit.

Authorities identified the suspects as Valentin Sarmientos-Santiago and Saul Armando Garcia-Montalvo. Each was charged with transport, attempt to transport and conspire to transport migrants for the purpose of commercial advantage and private financial gain.

At about 5:30 a.m. Nov. 14, the Zapata County Sheriff’s Office informed agents assigned to the Zapata Station that a man had called saying he was in the country illegally and that he was being held hostage in Zapata.

Deputies and agents responded to the area and observed a man running from a white trailer located in the 1000 block of Juarez Avenue. He stated he was the caller. Deputies then found four additional people inside the white trailer.

Deputies then went next door to a yellow trailer where a woman gave authorities consent to search the trailer. The search yielded an additional six people inside and three others outside. In total, authorities located 15 people between both residences.

Border Patrol determined that 12 people were migrants. Nine migrants were identified as the ones being held hostage, according to court documents. The suspects were identified as Sarmientos-Santiago and Garcia-Montalvo.

At about 9:15 p.m. Nov. 14, Homeland Security Investigation special agents received information regarding a possible human smuggling attempt that involved an alleged sexual assault.

A woman stated that the stash house operator told her she would have to pay them an extra $3,500 not previously agreed with the human smuggling organization. She and another migrant identified as Sarmientos-Santiago as one of the individuals who held them at the location and forced them to package illegal narcotics.

She further identified Sarmientos-Santiago as the person who allegedly sexually assaulted her at the yellow trailer. Sarmientos-Santiago, a Mexican citizen, invoked his right to an attorney and declined to provide a statement.

Garcia-Montalvo, a Mexican citizen, stated he was responsible for the migrants and coordination of their movement. Garcia stated that people in Mexico “forced” him to harbor the migrants and threatened to kill him.

“Garcia further related observing Sarmientos lying in bed with two females with the lights off,” states the affidavit.

Biden admin under fire for removing Nigeria from list of countries that violate religious freedom

Even though radical Islamists frequently kill Christians, President Joe Biden’s Secretary of State Antony Blinken removed Nigeria as a 'Country of Particular Concern' regarding religious liberty earlier this year.

Multiple human rights groups have rebuked the Biden administration for removing Nigeria from the list of countries that severely violate religious freedom.

Even though radical Islamists frequently kill Christians, President Joe Biden’s Secretary of State Antony Blinken removed Nigeria as a “Country of Particular Concern” (CPC) regarding religious liberty earlier this year. The shocking decision led many human rights groups both domestically and in Nigeria to blast the decision publicly ahead of Blinken’s recent visit to Nigeria on November 18.

Calling Blinken’s decision “unexplainable,” U.S. Commission on International Religious Freedom (USCIRF) chair Nadine Maenza said on November 17 that the organization is “especially displeased with the removal of Nigeria from its CPC designation, where it was rightfully placed last year [by the Trump administration], as well as the omission of India, Syria, and Vietnam.”

“USCIRF is disappointed that the State Department did not adopt our recommendations in designating the countries that are the worst violators of religious freedom,” added Maenza.

According to the State Department, “Under the International Religious Freedom Act (IRFA) of 1998, the President is required to annually review the status of religious freedom in every country in the world and designate each country the government of which has engaged in or tolerated ‘particularly severe violations of religious freedom’ as a Country of Particular Concern (CPC).”

Listed as “severe violations” are torture, prolonged detention without charges, forced disappearance, and other flagrant denials of life, liberty, or security of persons.

Recent attacks against Christians in Nigeria included the September 26 massacre of 38 Christians by Muslim radicals and the October 31 kidnapping of an entire Christian congregation. An average of 17 Christians are murdered by jihadists every day in Nigeria.

“More than 40 religious organizations from across the world signed an appeal in August for the relisting of Nigeria over rising religious violations,” stated Franklyne Ogbunwezeh, a senior research fellow and director for Genocide Prevention in Africa at Christian Solidarity International.

“The fact remains that in northern Nigeria, Sharia and blasphemy laws are still being used to discriminate against Christians. Christians don’t get permission to build or renovate their churches — we know that. And the government at the state level is increasingly becoming authoritarian,” added Ogbunwezeh.

“We have lost many people and places of worship to their assault, especially in the north-central part of the country and the northeast,” described Christian Association of Nigeria president Rev. Samson Ayokunle. “That agenda with the killing of Christians has not stopped till today, and Nigerians are living witnesses.”

Despite the deadly persecution at the hands of radical groups like Islamic States Western African Province (ISWAP) and Boko Haram, many of the governments in the country’s northern region either do nothing or actively aid in the Islamic takeover, Ayokunle said.

City Council set to approve voting rights for over 650K NYC green card holders

The New York City Council is set to approve legislation that would allow non-citizens to participate in municipal elections, expanding eligibility to vote for key Big Apple posts to green card holders and recipients of deferred action.

The measure — sponsored by Councilman Ydanis Rodriguez (D-Manhattan) — has a veto-proof majority in the body, but questions linger over the council’s legal authority to allow immigrants who have not yet become citizens to vote for mayor, city comptroller and the council.

It would not cover state and federal contests.

An estimated 660,000 green card recipients live in the five boroughs, according to a 2018 report from the Mayor’s Office of Immigrant Affairs.

The measure is set for a Dec. 9 vote, Rodriguez confirmed to The Post.

Mayor Bill de Blasio said during his daily briefing Tuesday that he would not veto the legislation if passed — but once again reiterated that he did not believe the council had the power to enforce the legislation if passed.

Jury Holds Walmart, CVS, Walgreens Liable In Opioid Distribution

A federal jury in Cleveland on Tuesday concluded that three retail pharmacy chains - Walmart, CVS and Walgreens - recklessly distributed massive amounts of opioids, according to AP, which adds that the verdict could 'set the tone' for future lawsuits brought by county governments that want to hold pharmacies accountable for their part in the opioid crisis.

The verdict supports claims by northeast Ohio's Trumbull and Lake Counties, which claimed that the pharmacy chains failed to institute legally mandated monitoring to screen for potentially illegitimate opioid prescriptions. The counties are seeking billions of dollars in compensation to reimburse expenses related to dealing with addiction and overdoses in their communities.

The counties blamed pharmacies operated by CVS, Walgreens and Walmart for not stopping the flood of pills that caused hundreds of overdose deaths and cost each of the two counties about $1 billion, their attorney said.

This was the first time pharmacy companies had completed a trial to defend themselves in a drug crisis that has killed a half-million Americans over the past two decades. -AP

During the trial, the pharmacies failed to convince the jury that they didn't create a so-called "public nuisance" through lax oversight of prescriptions issued by licensed doctors. They also argued that their systems were designed to help pharmacists spot red flags - with CVS lawyer Eric Delinsky saying in final arguments that "The core job of pharmacist is to insure patients get the medications their docs say they need," adding that "their other obligation" is to flag illegitimate prescriptions for painkillers.

Ultimately the jury found the counties' arguments more convincing.

Mark Lanier, the counties’ lead lawyer, used props such as baking sifters and a toy bridge constructed out of Legos during his closing argument. The sifter showed how the companies failed to properly filter opioid prescriptions while the bridge illustrated the connection between previous illegitimate prescriptions and current abuses. -Bloomberg

In Case With Global Implications, Finland Puts Christians On Trial For Their Faith

Meet the man who appears to be the first in the post-Soviet Union West to be brought up on criminal charges for publishing long-held Christian beliefs.

Juhana Pohjola wouldn’t be cast to play his own part if Hollywood made a movie about a bishop put on trial for his faith. The Finnish pastor has inherited a place in the church of Martin Luther, but it appears none of Luther’s pugnacity or vitriol.

In person, Pohjola, 49, is forthright but unassuming, and gentle. Stereotypically, the Finn is thin and tall. He often pauses while speaking to carefully consider his next words. He listens attentively to others with far less impressive resumes.

In more than two decades as a pastor, Pohjola has ministered to congregations as small as 30. He has spent his life building a network of faithful churches across Finland, many of which started with a few people gathered for prayer, Bible study, hymn-singing—and communion, if they can get a pastor. In an in-person interview with The Federalist, Pohjola urged fellow Christian leaders to be willing to seek out “one lost sheep” instead of crowds and acclaim.

This is the man who appears to be the first in the post-Soviet Union West to be brought up on criminal charges for preaching the Christian message as it has been established for thousands of years. Also charged in the case that goes to trial on January 24 is Pohjola’s fellow Lutheran and a Finnish member of Parliament, Paivi Rasanen.

Rasanen’s alleged crimes in a country that claims to guarantee freedom of speech and religion include tweeting a picture of a Bible verse. Potential penalties if they are convicted include fines and up to two years in prison.

Finnish Authorities: The Bible Is Hate Speech

Rasanen and Pohjola are being charged with “hate speech” for respectively writing and publishing a 24-page 2004 booklet that explains basic Christian theology about sex and marriage, which reserves sex exclusively for within marriage, which can only consist of one man and one woman, for life. The Finnish prosecutor claims centuries-old Christian teachings about sex “incite hatred” and violate legal preferences for government-privileged identity groups.

Writer Rod Dreher pointed out the witch hunt nature of this prosecution: “Räsänen wrote that pamphlet seven years before LGBT was added to the national hate-speech law as a protected class. She was investigated once before for the pamphlet, and cleared — but now she’s going to undergo another interrogation.”
