18 U.S. Code § 2339C - Prohibitions against the financing of terrorism

 

(a) Offenses.—

(1) In general.—Whoever, in a circumstance described in subsection (b), by any means, directly or indirectly, unlawfully and willfully provides or collects funds with the intention that such funds be used, or with the knowledge that such funds are to be used, in full or in part, in order to carry out—

(A) an act which constitutes an offense within the scope of a treaty specified in subsection (e)(7), as implemented by the United States, or

(B) any other act intended to cause death or serious bodily injury to a civilian, or to any other person not taking an active part in the hostilities in a situation of armed conflict, when the purpose of such act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or to abstain from doing any act,

shall be punished as prescribed in subsection (d)(1).

(2) Attempts and conspiracies.—

Whoever attempts or conspires to commit an offense under paragraph (1) shall be punished as prescribed in subsection (d)(1).

(3) Relationship to predicate act.—

For an act to constitute an offense set forth in this subsection, it shall not be necessary that the funds were actually used to carry out a predicate act.

(b) Jurisdiction.—There is jurisdiction over the offenses in subsection (a) in the following circumstances—

(1) the offense takes place in the United States and—

(A) a perpetrator was a national of another state or a stateless person;

(B) on board a vessel flying the flag of another state or an aircraft which is registered under the laws of another state at the time the offense is committed;

(C) on board an aircraft which is operated by the government of another state;

(D) a perpetrator is found outside the United States;

(E) was directed toward or resulted in the carrying out of a predicate act against—

(i) a national of another state; or

(ii) another state or a government facility of such state, including its embassy or other diplomatic or consular premises of that state;

(F) was directed toward or resulted in the carrying out of a predicate act committed in an attempt to compel another state or international organization to do or abstain from doing any act; or

(G) was directed toward or resulted in the carrying out of a predicate act—

(i) outside the United States; or

(ii) within the United States, and either the offense or the predicate act was conducted in, or the results thereof affected, interstate or foreign commerce;

(2) the offense takes place outside the United States and—

(A) a perpetrator is a national of the United States or is a stateless person whose habitual residence is in the United States;

(B) a perpetrator is found in the United States; or

(C) was directed toward or resulted in the carrying out of a predicate act against—

(i) any property that is owned, leased, or used by the United States or by any department or agency of the United States, including an embassy or other diplomatic or consular premises of the United States;

(ii) any person or property within the United States;

(iii) any national of the United States or the property of such national; or

(iv) any property of any legal entity organized under the laws of the United States, including any of its States, districts, commonwealths, territories, or possessions;

After Nominating Ex-Carlyle Partner Powell as Fed Chair, Biden Holidays at Firm Co-Founder’s Mansion

 

US President Joe Biden has elected to spend his Thanksgiving holiday at the home of David Rubenstein, a billionaire and co-founder of the private equity firm Carlyle Group. Earlier this week, Biden nominated a former Carlyle partner, Jerome Powell, for a second term chairing the Federal Reserve, the US central bank.

The president and his wife, first lady Jill Biden, arrived at Rubenstein's sprawling coastal estate on Massachusetts’ Nantucket Island on Tuesday night, where they’ll be joined by their extended family members ahead of the Thursday feast day. It’s a trip the family has made every year since 1975, except for 2015, when their son Beau died, and 2020, when the COVID-19 pandemic interfered.

However, Rubenstein himself apparently won’t be there, according to Forbes, as he’s traveling in Europe. His estimated wealth is $4.5 billion.

According to his official biography, Rubenstein started the Carlyle Group with William Conway Jr. and Daniel D'Aniello in 1987. Today it’s the world’s second-largest private equity firm by capital raised over the previous five years, according to the PEI 300 index, boasting $293 billion in assets, and Forbes estimates Rubenstein’s net worth at $4.5 billion.

White House Press Secretary Jen Psaki defended Biden’s trip when asked by reporters about what kind of message it sent, casting the visit as no different than any other American family’s Thanksgiving plans.

“I hope everybody in here is spending time with their families,” she said to the White House press corps. “This is a time to put politics aside, spend time with your loved ones and talk about what you’re grateful for,” she said, adding that he has the ability to continue working from the Nantucket mansion and is traveling with his staff.

Biden Mulls Sending Extra Weapons & Trainers To Ukraine Amid Dubious Reports Of "Russian Invasion"

 

Here we go again: the ratcheting tit-for-tat threats currently being unleashed between Moscow and Washington arguably hasn't been this intense since the height of the Donbass conflict of years ago, and the Crimea crisis. It's leading to the Biden administration mulling ramping up arms transfers to Kiev.

 

CNN on Tuesday is citing multiple defense sources to report "The Biden administration is weighing sending military advisers and new equipment including weaponry to Ukraine as Russia builds up forces near the border and US officials prepare allies for the possibility of another Russian invasion."

 

And yet as we've reviewed, there's still as yet little to nothing in the way of hard evidence that Russia is setting in motion any kind of plans to "invade Ukraine" - as Bloomberg last week first reported based on anonymous US sources. Much of the speculation appears based on satellite images of Russian troop movements taking place significantly far from Ukraine's border, with Moscow's constant refrain to the West being that it can move its own troops within Russia's sovereign borders wherever it wants to.

 

But this new US plan to not just send more military hardware - but also US military advisers - would mark a serious escalation, as the Kremlin has recently warned it would see any kind of NATO forces buildup inside Ukraine as violating its "red lines" which would require taking action.

 

According to the fresh CNN report, the proposed lethal aid package now under consideration by the White House could include stinger missiles - which Moscow would without doubt consider a severe escalation:

 

The discussions about the proposed lethal aid package are happening as Ukraine has begun to warn publicly that an invasion could happen as soon as January. The package could include new Javelin anti-tank and anti-armor missiles as well as mortars, the sources said.

 

Air defense systems, such as stinger missiles, are also under consideration, and the Defense Department has been pressing for some equipment that would have gone to Afghanistan like Mi-17 helicopters to instead be sent to Ukraine. The Mi-17 is a Russian helicopter that the US originally purchased to give to the Afghans. The Pentagon is now weighing what to do with them after the US withdrawal from Afghanistan in August.

Fauci says having a COVID booster to be considered fully vaccinate 'on the table'

 

Fauci and others cite studies that appear to show vaccine protection wanes over time

 

 

Dr. Anthony Fauci, the country's top U.S. infectious disease expert, says having a COVID-19 booster shot being the new threshold for being fully vaccinated is "on the table."

 

"Right now, officially, fully vaccinated equals two shots of the mRNA and one shot of the J&J, but without a doubt that could change," Fauci said Tuesday in an interview for the upcoming Reuters Next conference.

 

The idea of needing to have a booster to comply with government mandates on being fully inoculated, in part to keep a job, has gained momentum in recent days with weeks, with New Mexico and Connecticut’s Democrat governors making comments similar to those made by Fauci.

 

He also said the vast majority of Americans who have been vaccinated against COVID-19 should receive a booster shot.

 

"We'd like to get as many people who were originally vaccinated with the first regimen boosted," he said.

 

Studies from Israel and other countries have shown that vaccine protection wanes over time. While data first suggested that was mostly a problem in the elderly, there is newer evidence that it occurs among all age groups, Fauci also said in the interview.

 

"That's the reason why we're very keen on getting as many people who are originally vaccinated to get a booster … because they really do work," he said, also according to Reuters.
