No can't even charge conspiracy based on speech made in a public forum. Bar is so high with that.
However long it takes to give them their constitutionally guaranteed trials, do it all by the book, then shuffle them off to the death chamber. I believe in televising the executions. And making them more violent like bringing back the firing squad. It sends a message. Try it again and we will do the same to you.
I'm not a lawfag. Probably should be given the amount of 1983 cases I've been involved in (not a plaintiff), I've learned a helluva lot about law. Criminal is a much higher bar than civil and the government wouldn't waste its time with something like that. Dealing with a 1A pleading would be a nightmare. They'd go to the Supreme Court while still in pre-trial phase over some finicky issue.
In summary, go for his fucking throat. Don't waste time on something that'll get the whole criminal case tied up when he's dead to rights on far worse.
