Any Lawfags around?

 

My niece has had a drug problem for almost 20years and not long ago, I had a protection order filed against her for threats against me and other as well as threatening to burn my house down.

 

She went to jail almost 2 months for violating that TPO and was released on probation with counseling and drug testing as a condition, to prevent it becoming a felony. I agreed to all that with the prosecution.

 

My elderly father lives with me and begged me to let her stay here again while I had the TPO in place. She has been here about 3 weeks.

 

So, she was doing great and had not left the house as was my condition because she could not stay away from drugs. She sneaked out day before yesterday and had been gone until about an hour ago.

 

I wake up, start coffee and here she comes into the kitchen tweaking her ass off thinking she was acting "normal". I asked her if she liked jail and she snapped threatening me etc again. I called the cops and they just left. I have to be at the courthouse tomorrow 12/9.

 

My question is, The fact I let her stay here and used my TPO as leverage to try and keep her off the streets and from doing drugs, will the judge hold that against me? I am beside myself at how bad she looks and what she has become. What might the judge say about me allowing here to stay hereโ€ฆ

Judge was pretty clear about not letting her come back, has me worried they'll drop my TPO and her charges.

Knots me up inside thinking of what I have just done to family a member.

 

She is facing a felony now and 3 years.. I believe it was, that she had "on the shelf".

Cold AF outside and snowing.. She left on foot just before cops got here. Praying they pick her up soon.
