Prince Andrew’s Lawyer Argues Virginia Giuffre Was Old Enough to Consent Under New York Law
Prince Andrew is making another effort to throw out the civil case being brought against him by Virginia Roberts Giuffre, who claims she was forced to have sex with the queen’s son.
In a filing Monday evening, Andrew, who just hours earlier was photographed horse-riding near his home in Windsor Great Park, also asked the presiding judge to keep under seal some of his responses to Giuffre’s allegations.
Andrew controversially asked Judge Lewis Kaplan to dismiss Giuffre’s complaint, arguing that New York’s Child Victims Act, the legislation under which she is suing him, is flawed because it classifies those under the age of 18 as minors, but the age of consent in New York is 17, the London Times reports. Giuffre alleges that she was 17 when she was forced to have sex with the prince multiple times and at various locations around the world in 2001
A notorious photograph of Andrew with his arm around a teenage Giuffre’s bare midriff has circulated in the media for several years, but the Duke of York claims to have never met Giuffre. The photograph, which shows Ghislaine Maxwell in the background, was reportedly taken at her London apartment by Jeffrey Epstein, who died in a jailhouse suicide in 2019.
Andrew’s allies have previously planted stories in the press saying he believes the picture is a fake, a claim that has been met with stunned disbelief by his critics.
The London Times reports the new filing from Andrew’s legal team argues the Child Victims Act is “not a reasonable mechanism to address the injustice of child sexual abuse in New York” because it classifies under-18s as minors “even though the age of consent in New York is 17.”
Andrew is arguing “the issue of consent is unsettled with regard to those—like Giuffre—who were between the ages of 17 and 18.”
The Times says Andrew’s legal team, headed by Andrew Brettler, acknowledge in the paperwork that it would be possible to prove lack of consent by showing evidence of an “implied threat” being made, but it would be difficult to prove “as memories fade, false memories are created, and witnesses die or otherwise become unavailable.”
The filing adds, they report: “Here, the only witnesses to the purported implied threats under which Giuffre allegedly engaged in unconsented sex acts with Prince Andrew are Epstein (deceased), Maxwell (incarcerated), Prince Andrew (the accused), and Giuffre herself.”
The Times also reports that Andrew says he should be protected from legal action by Giuffre under the terms of a settlement she made with Epstein in 2009.
The Times said Kaplan “agreed a delay to January 14 last night.”

Pfizer says COVID-19 pill near 90% effective in final analysis
NEW YORK (Reuters) -Pfizer Inc on Tuesday said final analysis of its antiviral COVID-19 pill still showed near 90% efficacy in preventing hospitalizations and deaths in high-risk patients, andrecent lab data suggests the drug retains its effectiveness against the fast spreading Omicron variant of the coronavirus.
The U.S. drugmaker last month said the oral medicine was around 89% effective in preventing hospitalizations or deaths when compared to placebo, based on interim results in around 1,200 people. The data disclosed on Tuesday includes an additional 1,000 people.
Nobody in the trial who received the Pfizer treatment died, compared with 12 deaths among placebo recipients.
The Pfizer pills are taken with the older antiviral ritonavir every 12 hours for five days beginning shortly after onset of symptoms. If authorized, the treatment will be sold as Paxlovid.
"It's a stunning outcome," Pfizer Chief Scientific Officer Mikael Dolsten said in an interview.
"We're talking about a staggering number of lives saved and hospitalizations prevented. And of course, if you deploy this quickly after infection, we are likely to reduce transmission dramatically," Dolsten said.
Pfizer also released early data from a second clinical trial suggesting that the treatment reduced hospitalizations by around 70% in a smaller trial of standard-risk adults, including some higher-risk vaccinated people. The results were not statistically significant, but Pfizer said they showed a "positive data trend for reduction in risk."The trial did not show that the drug alleviated symptoms of COVID-19 in the same population.
The results in standard-risk individuals are from interim analyses at 60% and 80% of enrollment of the now fully-enrolled trial of over 1,100 people. Pfizer will continue the trial and release more data when its done.
Dolsten said he expects authorization for use in high-risk individuals from the U.S. Food and Drug Administration and other regulatory agencies soon. He does not believe an FDA advisory panel meeting will be needed.
"We're in very advanced regulatory dialogues with both Europe and the UK, and we have dialogues with most of the major regulatory agencies globally," Dolsten said.
Pfizer submitted data to the U.S. FDA last month, asking for emergency use authorization of the drug.

Sexual abuse allegations against three priests 'credible,' diocese says
FALL RIVER – Three Massachusetts Catholic priests, including one from an Easton church, are barred from returning to ministry after the diocese found them each to be "credibly accused" of sexual abuse of a minor.
According to the Diocese of Fall River, the Rev. Richard E. Degagne was suspended after allegations surfaced in 2019. He was then the pastor of Immaculate Conception Parish in Easton.
The Rev. Edward J. Byington and the Rev. James F. Buckley were already retired and were not assigned to a parish when allegations surfaced during 2020, diocese officials said.
The Rev. Buckley was ordained in 1959, the Rev. Byington was ordained in 1970 and the Rev. Degagne was ordained in 1982. As a result of Monday's decision, all three are prohibited from participating in church duties.
"They are not permitted to exercise any public ministry including the celebration of public Mass or of other sacraments. They may not provide spiritual direction, may not wear clerical attire, or present themselves as priests," the diocese wrote in a statement.
"My prayers remain with any and all who have suffered sexual abuse by clergy, especially as a minor," Bishop Edgar M. da Cunha said. "Their pain is real and long-lasting, and perpetrators must be held accountable."
