Maybe this would be a perfect application for martial law?

 

The military (via DARPA) & another unnamed federal agency were responsible for the R&D and startup capital in most of these cyber utilities anyway, so it could be argued that the American public already owns a significant interest in the Intellectual Property anyhow.

 

NSA/USCC can keep the basic functions operational while lawyers work out all the P's & Q's in order to sell them back to the public as regulated public cyber utilities, just like the CEO of twatter publicly envisioned in 2011.
