SEAFORD, Del. (TND) — A new law in a Delaware city will require all fetal remains from abortions and miscarriages to be either buried or
cremated.
The ordinance passed by the city of Seaford is coming under fire from critics and is being called "unconstitutional" by both the American Civil
Liberties Union of Delaware and the state's attorney general.
Those who have an abortion or miscarriage in Seaford can reportedly choose between cremation or burial, with those making the choice being forced to foot the bill, according to WMDT News. If an individual got an abortion and passes on the decision regarding the remains onto the facility which performed the abortion, then the facility must pay for the cremation or burial.
I believe the fetal remains deserve a dignified handling,” Seaford Councilman Matthew McCoy reportedly said, according to WHYY News. “I believe this is the right thing to do, and I believe our community has vocalized that to us throughout this process.
The ordinance reportedly passed with a 3-2 vote, with one of the opposing councilmen fearing passing the law would result in lawsuits towards
the city.
The ACLU of Delaware also believes the ordinance is "flagrantly unconstitutional" and in violation of state law. Speaking with WMDT News, executive director of the ACLU of Delaware Mike Brickner says he believes the ordinance could prevent Delawareans from considering abortion due to the cost of burial or cremation.
