Everything they do is a bad idea. They are evil and stupid. On top of that, they are terrified. So I would not count on any rational decision making from their end of it.
They know it is 100% farce. They know they did it, and are persecuting the victims in crass political theater. They know they came at DJT with everything imaginable, and had their tails handed to them each and every time. They know that if they made a farcical criminal referral, and the corrupt DOJ idiotically pursued it, that their own crimes would inevitably be revealed. Nevertheless, they are indeed stupid.
