Benedict worked with JP2 on the specific terminology in 'resigning' from the papacy. there are 2 aspects: the responsibility of the papacy and the ministerial functions and he would have had to mention both. In his resignation, which was in latin, he only mentioned the ministerial functions, and so is still the pope.
