That's been going on since the concept of an embassy was introduced. Stingrays and all of the other SIGINT equipment are just modern tools in a very old game of spy vs. spy. Averaging about 5k per month so it wouldn't surprise me if it's closer to 35k by now. Some are being unsealed, MS-13, leakers, etc. But that's only a few at a time. They can tie a helluva lot of defendants into one indictment, a RICO indictment. It's worth noting these are not civil cases nor are they federal "misdemeanors." They're straight up federal felonies.

Wasn't pardoned. Commuted. But yes, it's hard to understand why Obama would want to let loose someone who's gonna ruin his life. He wouldn't if he were thinking rationally. But he hardly ever made decisions based on logic and reason. Commuting Manning's sentence was a PR stunt to kiss the ass of the LGBTQ community.

 

Then there's his gross incompetence. Look at what he did to Horowitz and Flynn, that's gonna fuckin ruin him. Did he think that couldn't come back and bite him in the ass? Maybe he didn't think Manning would come back and fuck him over after havingโ€ฆher sentence commuted because Hillary would be in power. No one knows what goes through the heads of these morons. I don't see how the court system will be able to handle these cases, which is probably why they'll be rolled up and sent to military judges who aren't presiding over felony cases every single day. District judges are already overworked, so part of Trump's "pack the courts" may serve a purpose here. Look at all of the shit in California. They're already under a mountain of shit as it is. The civilian court system can't handle hundreds, thousands of RICO indictments. The pre-trial will be a nightmare. Appeals of denials of motions. They'll wrap it up in the circuit court (CA9, takes 18 or more months to decide cases), then SCOTUS. Needs to go to military. Swift justice. No fucking mercy. Give them their constitutionally guaranteed fair and speedy trial then mete out punishment.

I haven't read the entire annex. I'm inclined to believe they retain the right to habeas corpus unless the right is suspended under Article I, Sec. 9, Cl. 2 aka the Suspension Clause.

"The privilege of the writ ofย habeas corpusย shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.

It's not something that can be removed by EO alone.

 

The case involving unilateral suspension is Ex parte Merryman. It's (sort of, not really) controlling because of how the decision was rendered. Taney of Dred Scott fame ruled the President cannot unilaterally suspend habeas corpus but its unclear if it's a circuit court or Supreme Court opinion. It was in chambers, not published. No one knows if it's binding and Lincoln ignored it.

The issue is how do we define enemy combatants. It's gonna be a very high threshold to overcome when it comes to labeling American citizens "enemy combatants." Hamdi v. Rumsfeld, allows detention of Americans as enemy combatants. Boumediene v. Bush, extends habeas protections to aliens detained as enemy combatants. So logically, if alien enemy combatants are entitled to habeas proceedings, so are American citizens.

What baffles me is they didn't have air cover. They said they cleared the mountain tops. The reason why they were in a Chinook is because they could deploy four-wheelers and dune buggies from the helo. Insert further away and travel there. I'm not saying Extortion 17 wasn't a hit job but they hit the wrong squadron if the goal was to silence the operators on the bin Laden raid. That was what piqued my curiosity. I'm sure it's nothing but I just find it odd that it was a yellow blanket. I didn't serve. Have a good friend who's a retired SEAL (from Team 5) and another few friends who are retired Army SF and retired Rangers. I also know at least one person who's a member of "The Unit" aka Delta/CAG/ACE. Will ask around but these people don't talk about what they've seen and done. It's like pulling teeth.
