Biotech Companies Sue Moderna for Patent Infringement Over its COVID-19 Vaccine

On Monday, two biotech companies filed a lawsuit against Moderna in the U.S. District Court for the District of Delaware, accusing the vaccine manufacturer of patent infringement on its COVID-19 vaccine.

Arbutus Biopharma and Genevant Sciences sued Moderna over infringement claims on six patents concerning the manufacture and sale of Moderna’s Covid-19 vaccine.

Moderna released a statement to The Hill and denied these allegations of patent infringement.

“Moderna denies these allegations and will vigorously defend itself against Genevant’s claims in Court,” Moderna said in a statement to The Hill. “Our COVID-19 vaccine is a product of Moderna’s many years of pioneering mRNA platform research and development, including the creation of our own proprietary lipid nanoparticle delivery technology, which has been pivotal to combat the COVID-19 pandemic,” it added.

More from BioPharmaDive:

Arbutus and Genevant’s lawsuit escalates a yearslong dispute with Moderna that’s already wound its way through a federal patent appeal board and a federal appeals court.

At issue are microscopic fat-like particles that Arbutus scientists developed to shield messenger RNA delivered into the body — inventions awarded several U.S. patents which Arbutus and partner Genevant allege Moderna infringed with its COVID-19 vaccine Spikevax.

In court documents, the two cited several disclosures in scientific publications describing early studies of what would become Spikevax, including one coauthored by National Institutes of Health scientists that was published in The New England Journal of Medicine. The papers, Arbutus and Genevant claim, show Moderna’s vaccine uses so-called lipid nanoparticles that are covered by six separate patents they hold.

Arbutus and Genevant are not seeking an injunction on sales of Spikevax, which last year earned Moderna nearly $19 billion, and acknowledge Moderna’s essential role in developing a vaccine that’s saved tens of thousands of lives during the pandemic.

But they’re hoping to win a judgement that Moderna infringed six of their patents and to secure damages no less than a “reasonable royalty” on Moderna’s sales. Mani Foroohar, an analyst at SVB Leerink who covers Moderna, expects a single-digit royalty could be expected should the court rule against Moderna, which would still equate to a significant sum.

Minister backs down after ‘financial war’ on Russia comment

Bruno Le Maire clarified Paris is “not in a battle against the Russian people”

Bruno Le Maire, France’s minister of the economy, has backed down from his earlier declaration to “wage a total economic and financial war on Russia,” admitting the language he used was inappropriate.

Speaking to Franceinfo on Tuesday, Le Maire had initially hyped up his country’s response to Russia’s invasion of Ukraine, claiming Paris will “target the heart of the Russian system” and ensure the “Russian people will also pay the consequences” for President Vladimir Putin’s actions.

“The sanctions are effective, the economic and financial sanctions are even extremely effective,” Le Maire had said, claiming “Russian foreign exchange reserves are melting like snow in the sun,” as the “ruble has collapsed by 30%.”

Le Maire’s remarks sparked condemnation by Dmitry Medvedev, the deputy chairman of Russia’s Security Council and former president. Responding on Twitter, Medvedev warned France that “economic wars quite often turned into real ones,” urging the minister to “watch your tongue” and the rhetoric he uses.

Hours later, Le Maire sought to clarify his remarks, telling French news agency AFP that he had initially misspoken and the use of the term ‘war’ was not an appropriate way to discuss his government’s response to the Ukraine conflict.

“We are not in a battle against the Russian people,” Le Maire told AFP on Tuesday, seeking to calm the tensions sparked by his initial interview. However, a tweet from Le Maire sharing his threat of “financial war on Russia” was still on the French minister’s Twitter account as of 3:30pm GMT.

High School Assistant Principal in Michigan Is Able to Return to Work While Awaiting Trial For First-Degree Child Sex Assault

An assistant principal at Ecorse High School in Michigan could be allowed to return to work after he was arrested and charged earlier this week for criminal sexual conduct charges involving a child.

Melven Conway, 46, was taken into custody at the school Monday morning after the Detroit Police Department had been notified of an alleged sexual assault that happened around eight years ago and involved his then-ten-year-old daughter, but thanks to a judge’s decision to grant low bail and place him on house arrest, Conway is permitted to go back to work while he awaits trial. In other words, he is free to resume his role around children despite his criminal child sex charges.

There were no legal parameters or limitations given to him that would restrict his contact with minors. The decision for him to return to school is entirely on the district.

District superintendent Dr. Josha Talison explained that the school is aware of Conway’s arrest and is cooperating with the investigation in a statement to Fox News:

“The Ecorse School District has been made aware of the arrest of Assistant Principal Melven Conway. We are going to work collaboratively with all law enforcement agencies involved as this investigation continues. As always, the security of our students and staff is our number one priority,” Talison wrote.

The arrest and charges have been a long time coming for Conway, who has been under investigation since he was accused of the assault by his now-teenage daughter almost a full year ago.

When filing her report in the spring of 2021, she claimed that Conway had assaulted her inside a Detroit home, according to authorities.

A warrant for Conway’s arrest had been submitted all the way back in September 2021, but he was not officially charged until February 1st, 2022, and, it took almost a full month longer for law enforcement to finally bring him into custody, which didn’t happen until Monday, February 28th.

Immediately following his arrest, Conway was arraigned in court and a not guilty plea was entered on his behalf. Prosecutors argued that the accusations amount to first-degree “criminal sexual conduct involving a child,” and clarified that the victim is his own “biological daughter.”

Nevertheless, the judge set bond at just $75,000 and ordered Conway to wear a GPS ankle monitor and remain under home confinement while he awaits trial. He will only be allowed to leave home to go to work or get legal counsel, which permits him to return to the high school despite the sickening nature of his charges.

From Fox2 Detroit:

“He was ordered held on a $75,000/10% bond, meaning he can bond out for $7,500.

If he posts bond, Conway must wear a GPS tether and can go to work and stay home.

He’s due back in court on March 10 for a probable cause conference.”

Poland and Bulgaria deny warplanes supply to Ukraine

Ukraine has claimed three NATO countries will send jets amid conflict with Russia

Polish President Andrzej Duda said on Monday Poland and NATO were not part of the conflict between Russia and Ukraine and therefore can’t send jets to join the combat. “We are not sending any jets to Ukraine because that would open a military interference in the Ukrainian conflict. We are not joining that conflict. NATO is not a party to that conflict,” he said at a press conference after his meeting with NATO General Secretary Jens Stoltenberg, adding that they were supporting Ukrainians with humanitarian aid.

NATO chief Jens Stoltenberg has also confirmed that NATO was not to be part of the conflict, and therefore was not to send any troops and planes to Ukraine. However, he confirmed that NATO will continue to provide Ukraine with financial and military support, such as anti-tank weapons, air defense systems, and other types of military equipment.

Earlier on Tuesday, the Ukrainian Air Force officially announced on their Facebook page that three NATO countries – Poland, Slovakia, and Bulgaria – would deliver more than 70 warplanes for the Ukrainian army. The jets were supposed to be able to operate from Polish airfields.

The Bulgarian Defense Ministry told local media on Tuesday that it has not considered providing combat aircraft to Ukraine.

Military conflict between Russia and Ukraine broke out on Thursday after Russian authorities launched a military operation, claiming it was necessary to “demilitarize” and “denazify” Ukraine to protect the Donetsk and Lugansk People’s Republics. The international community imposed heavy sanctions against Russia and closed airspace of more than 30 countries worldwide as a response to the “unprovoked” hostilities.

The first round of negotiations between Russia and Ukraine was held on Monday in an undisclosed location on the Belarus-Ukrainian border. The key goal of the negotiations was to achieve a ceasefire.

Microsoft CEO Satya Nadella’s son Zain dead at 26

Microsoft CEO Satya Nadella’s son, Zain, died at age 26 on Monday following a lifelong battle with cerebral palsy, according to reports.

The tech firm informed its top executives of Zain Nadella’s passing in an email. The message asked the executives to send their thoughts and prayers to the Nadella family.

“I know we all want to support Satya during this difficult time,” Microsoft’s chief people officer Kathleen Hogan said in the message, according to Geekwire. “The best way right now is to hold him and his family in your thoughts and prayers, while allowing them the privacy and peace to process such a grave loss.”

Nadella’s son – the eldest of his three children – experienced asphyxiation in utero and was born weighing just three pounds. Zain Nadella received care at Seattle Children’s Hospital for much of his life.

Zelensky gives Boris Johnson ‘shopping list’ of weapons needed to defeat Russian forces

Ukrainian President Volodymyr Zelensky presented UK Prime Minister Boris Johnson with a “shopping list” of arms needed to defeat Russian troops — with more British anti-tank missiles shipped over almost daily.

Johnson said the latest batch of weapons would be flown to Poland and driven into Ukraine within “hours and days.”

A source said: “Zelensky has made very specific requests for military hardware during near daily phone calls, and we are working round the clock to get them into Ukraine.”

Johnson told his cabinet, “It is becoming clearer with each day that Putin had made a colossal mistake believing that the guns of his tanks would be garlanded with roses when instead the Ukrainian people had put up a fierce resistance in defense of their homeland.”

Today Johnson will fly to Poland and Estonia to meet British troops serving on NATO’s eastern flank.

Last night he said they are “two countries that are acutely affected by the current crisis in Ukraine. We have shared values that are more important than ever to protect, as the humanitarian situation gets worse. We speak with one voice when we say, [Russian President Vladimir] Putin must fail.”

Western officials believe the struggling Russian attack has deployed half the troops Putin had built up on Ukraine’s border since last fall.

But they fear the frustrated Kremlin tyrant will resort to more “indiscriminate” shelling and bombing as he gets angry over the slow pace of his invasion.

One said Putin had “stirred up a hornets’ nest” but also underestimated the capacity of the Ukrainians to fight.

They added that it is “very clear they are well behind on the time frame they set out for themselves.” Bad planning and a failure to knock out Ukraine’s air defenses in the opening salvo of his attack has left advancing Russian columns badly exposed and open to “smart” resistance from the Ukrainians.

One official also lashed out at the isolated Kremlin chief, suggesting he was not listening to advice.

They said: “Putin’s inner circle, who he might discuss this sort of planning with, is very, very small. The number of people on the inside of a decision-making loop is very small indeed.”

Meanwhile, more than 100,000 Ukrainians fleeing the invasion will be able to come to the UK, Home Secretary Priti Patel said.

Patel said immediate family, partners and children under 18 of Brits and Ukrainians already here will be able to come even if they do not meet normal visa requirements.

Putin-Linked Lobbyist Donated Over $500K to Democrats, Earned Cash from Russian State Investment Fund.

The trustee in question had donated over half a million dollars to Democratic Party causes, with money earned from Russia lobbying.

A former Managing Trustee of the Democratic National Committee lobbied on behalf of the Russian government’s international investment fund which was recently sanctioned by the United States, The National Pulse can reveal.

The Russian Direct Investment Fund (RDIF) – a sovereign wealth fund established while Vladimir Putin was Prime Minister – was the recent target of sanctions from the Biden White House following Russia’s invasion of Ukraine.

Despite the Biden regime’s move to sanction the fund, The National Pulse can reveal that RDIF previously retained former Democratic National Committee (DNC) Managing Trustee John Raffaelli as its American representative, according to Foreign Agent Registration Act (FARA) filings.

Broadly described as “government relations consulting services,” 2014 documents filed with the Department of Justice detail the scope of Raffaelli’s work for the Russian government-backed firm. Raffaelli’s firm Capitol Counsel would “educate and explain” to American officials RDIF’s “role and relationship with United States partners and investors” as well as liaise with the Treasury Department on behalf of the fund.

Much of the work, which included a $45,000 per month retainer fee, appeared to be focused on sanctions.

Federal election records also reveal that Raffaelli has donated hundreds of times to Democratic campaigns, including to candidates such as Hillary Clinton and Nancy Pelosi, totaling over $500,000.

“Campaign work includes: 1992 Clinton for President campaign; 1996 Clinton-Gore national finance committee; and Vice Chair of the Kerry for President campaign national finance committee,” notes the lobbyist’s professional bio.

“The Secretary of Treasury will also be imposing full blocking sanctions on the Russian Direct Investment Fund–a state owned financial entity that functions as a sovereign wealth fund, which is supposed to attract capital into the Russian economy in high-growth sectors,” explained White House Press Secretary Jen Psaki on Twitter.

The Treasury Department also noted that the fund is run by a “known Putin ally,” before adding that the Russian President “and his inner circle of cronies have long relied on RDIF and Dmitriev to raise funds abroad, including in the United States.”

Despite the financial tie between a high-profile Democrat lobbyist and Russia’s top investment fund, Democrats and their mainstream media counterparts continue to push the debunked narrative that the Trump administration colluded with Russia to win the 2016 election.

Corporate Media’s Top Trending Ukraine Stories Turn Out To Be Complete Fakes.

The stories have also been peddled by so-called conservative representatives and news networks, none of which have issued corrections yet.

A number of popular stories chronicling Ukraine’s resistance against Russia’s ongoing invasion – including those promoted by U.S. Congressmen, media outlets, and even conservatives online – have turned out to be false, despite garnering millions of shares and likes.

The viral, fake stories come amidst social media platforms rolling out robust “fact-checking” operations, often used to swiftly censor stories counter to establishment narratives or critical of the Democratic Party. These programs, however, have routinely failed to flag the following stories as false with the same tenacity.

Ukraine is building an 'IT army' of volunteers, something that's never been tried before

Russia's invasion of Ukraine has been accompanied by cyberattacks and now Ukraine is recruiting volunteers to defend networks - and hack back.

Ukraine has created what is describes as an "IT army" to defend against Russian hackers and to launch counter operations against cyber threats.

Russia's invasion of Ukraine has been accompanied by cyberattacks targeting the country's services and infrastructure, including DDoS attacks and destructive wiper malware campaigns – leading to the Ukrainian government calling for volunteers to aid with cybersecurity. But it has also asked for support in conducting offensive cyber operations back at Russia.

"We are creating an IT army," Mykhailo Fedorov, vice prime minister of Ukraine said in a tweet at the weekend. "There will be tasks for everyone. We continue to fight on the cyber front. The first task is on the channel for cyber specialists," he added, alongside a Telegram link to join the 'IT Army of Ukraine', which now has tens of thousands of subscribers.

In addition to helping to protect Ukrainian critical infrastructure and services from attacks, supporters were provided with a list of websites of 31 Russian targets.

They include organisations in both the state-backed and private sectors, including government agencies, banks, critical infrastructure and energy providers, including Gazprom and Lukoil, as well Russian email provider and search engine, Yandex. The list of targets is also being circulated in some underground forums.

This IT army is just one of the online efforts taking place during the conflict; hacktivist collective Anonymous has said it is taking action in support of Ukraine and against Russia, while Russia-based cyber-criminal groups have also indicated that they'll take offensive action in support of Vladimir Putin's invasion.

This includes the ransomware group Conti, which announced "full support of Russian government" and the intention to "strike back at the critical infrastructure of an enemy" in response to cyberattacks against Russia. A later statement by Conti claimed it doesn't support any government, but it will strike back against the West and "American cyber aggression". Conti has since seen many of its internal documents leaked in what appears to be another act of retaliation. Meanwhile, the BBC has also reported how Russian hackers – without direct orders from the state – are also attempting to hack Ukrainian websites and services.

According to analysis by Check Point, there's a 196% increase in cyberattacks targeting Ukraine's government and military since Russia sent troops in last week. It's likely that cyberattacks will continue in both directions, particularly as more and more people join Ukraine's cyber army.

"We're now witnessing a concentrated attack to take down major websites and services in Russia and other surrounding countries, much like a community-driven effort. They have to deal with waves of DDoS attacks that are likely to worsen as time goes by," says Silviu Stahie, a security analyst at Bitdefender.

Syrian UN Envoy Accuses US Occupation of Enabling Terror Groups and Controlling Food Supply

The US occupation of Syria is a violation of international law

Syria’s envoy to the United Nations Bassam al-Sabbagh accused the United States and other NATO members on 25 February of hindering efforts by the Syrian government to put an end to the 11 year-long war and rebuild the country.

In an address to the UN Security Council, Sabbagh said the occupation of large tracts of Syrian territory by the US perpetuates the activities of the armed groups that are causing instability in the country and the entire region.

“The suffering of the Syrian people continues as a result of the practices of Western countries whose interests and agendas have prevailed over the lives of Syrians and the security and stability of the region,” the Syrian envoy charged.

Sabbagh also slammed the sanctions that the US government has imposed on Damascus. He said such coercive measures have significantly reduced the ability for the Syrian government to access the financial capital needed to rebuild the country and to resettle the millions of people who were displaced by the western-backed insurgency.

He appealed to the UN to speak out against the “blatant violations of international law and the UN Charter” by the US.

Sabbagh emphasized that his country was food self-sufficient before the US illegally wrested control of most of Syria’s wheat producing regions.

Prior to the US occupation, the envoy said, Syria produced over 2.5 million tonnes of wheat per year but is now forced to import most of the wheat needed for domestic consumption.

Washington has deployed its troops across much of eastern and northeastern Syria under the pretext of preventing the oil fields in the region from falling into the hands of ISIS.

Damascus has, however, accused the US of using its occupation to loot and plunder Syrian resources, such as wheat and oil.
