I was taught, in the '80s (private citizen), to ask the court if the fringe was meaningful… knowing that if they lied, it could set up an appeal.

 

Was also taught to state, before proceedings, that "I do not waive any rights, and, at all times, reserve all my rights".

I'd have to read up. Can tell you this: A stunning number of persecutions are halted by showing this knowledge… and that's proof that many judges knew what was up, even back then
