“I think the act of the speaker is clearly unconstitutional. His job is to count the votes, not to decide whether any of the opposition members is some part of a foreign conspiracy. He cannot just throw out a motion of no-confidence.

 

Normally, the speaker’s rulings are granted immunity from judicial scrutiny, but in case – where it’s beyond the jurisdiction of the speaker – the courts can intervene.

 

And in this case, they probably will. I don’t recall any elected civilian government in the past making such a brazenly unconstitutional move. What has effectively happened today is that the Pakistan Tahreek-e-Insaf (PTI) party has replaced the will of the parliament with the whim of the speaker.”

“There is a provision in the constitution, Article 69, that says courts are not to look into the matters on the floor of the House, but there are exceptions.

 

And we have precedence in the past where the ruling by the speaker has been set aside by the Supreme Court. Article 5 of the constitution says that you will obey the constitution and be loyal to the constitution. This has nothing to do with the resolution in the House. For the speaker to say he has decided this resolution is based on disloyalty is a nonsensical position. There is no softer word I can use.

 

If there is disobedience of the constitution and an attempt to subvert the constitutional process at the behest of a foreign power then you need proper proceedings under Article 6 of the constitution that proves treason.”

“[The dissolution is] a blatant violation of the constitution and can lead to a very serious crisis.

 

There are two possibilities, I think. Firstly, the Supreme Court of Pakistan will order the speaker to go ahead with the no-confidence motion. In that case, the PM’s advice for dissolving the Assembly will become invalid.

 

Another scenario is parallel to the case of former Prime Minister Muhammad Khan Junejo who was ousted by General Zia-ul-Haq in 1988.

 

Junejo went to the Supreme Court, which agreed with him that his government was dissolved unconstitutionally. But court said that since elections were announced, it was best if Pakistan moved ahead with the elections to get a new mandate. That’s another example from history, but it doesn’t seem very probable to me.”

“Pakistan seems to be in the grip of instability and a constitutional crisis. What is dangerous is that the government itself, which is tasked to protect and implement the constitution and law, is comfortable violating the constitution to stay in power.

 

There was a fear, a few days before the vote, that the ruling party will use unconstitutional means to avoid the vote of no trust. As earlier the interior minister had suggested banning political parties or asking the Pakistan military to intervene.

De-notification comes after National Assembly's dissolution.

Imran Khan to still continue as prime minister under Article 224 of Constitution till appointment of caretaker PM, announces President Arif Alvi.

But he will not be able to make decisions that an elected PM can make.

 

ISLAMABAD: PTI Chairman Imran Khan has been de-notified as the prime minister of Pakistan, a statement from the Cabinet Division said Sunday after the dissolution of the National Assembly.

 

However, under Article 224 of the Constitution of Pakistan — once a notification is issued — Imran Khan will continue as the prime minister for 15 days till the appointment of a caretaker prime minister.

 

Taking to Twitter, President Arif Alvi also announced that Imran Khan will continue to serve as the premier for the time being.

 

"Mr. Imran Ahmad Khan Niazi, shall continue as Prime Minister till the appointment of caretaker Prime Minister under Article 224 A (4) of the Constitution of the Islamic Republic of Pakistan," he wrote.

 

There is still, however, no clarity over how a caretaker prime minister will be appointed as the National Assembly has been dissolved — and the people who appoint the person, the Opposition leader in the National Assembly and the premier, are no longer in office.

Despite being the prime minister for selected days, he will not be empowered to make decisions that an elected head of the government can make.

 

“Consequent upon dissolution of the National Assembly by the president of Pakistan, in terms of Article 58(1) read with Article 48(1) of the Constitution of the Islamic Republic of Pakistan, vide Ministry of Parliamentary Affairs’ SRO No. 487(1)/2022, dated 3rd April, 2022, Mr Imran Ahmad Khan Niazi ceased to hold the Office of the Prime Minister of Pakistan, with immediate effect,” said the notification from the Cabinet Division.

 

The de-notification of Imran Khan comes hours after ex-deputy speaker of the NA Qasim Suri abruptly dismissed the no-confidence motion against the PTI chairman and termed it "unconstitutional", saying that it was backed by "foreign powers".

Following the dismissal of the no-confidence motion, President Arif Alvi dissolved the National Assembly under Article 58(1) read with Article 48(1) upon the advice of the ex-premier.

 

Imran Khan — addressing the nation shortly after the session's adjournment — sought fresh elections and asked Pakistanis to gear up for the polls as the Opposition lashed out at the government's act of dismissing the motion as "unconstitutional".

 

Not wasting time after the setback in the National Assembly, the Opposition moved to the Supreme Court of Pakistan, with the court itself taking notice of the political crisis.

 

Chief Justice of Pakistan Umar Ata Bandial — during the hearing earlier today — said that "any order passed by the Prime Minister and the President shall be subject to the order of this court".

Legal experts Muneeb Farooq, Salman Akram Raja, Salaar Khan, Reema Omar, and Saroop Ijaz termed the government's move to use Article 5 for dismissing the no-confidence motion unconstitutional.

 

“When a [no trust] motion has been tabled and when the attorney general has told the court that voting will go through, then this [move] seems to be a disregard of constitutional provisions,” Ijaz told Geo.tv.

 

Advocate Khan said to address the rather "flaccid argument", if votes were bought or sold, the remedy is in the Constitution — disqualification of the defecting member.

 

"Despite what overnight constitutional experts may say, it doesn’t give you license to chuck the Constitution out the window," the legal expert added.

Pakistan Cabinet Secretariat has issued notification for the removal of Imran Khan as the Prime Minister. Imran Khan has been de-notified as the Prime Minister. Under Article 94 of the Constitution, the President directed the Prime Minister to continue his work.

 

"Consequent upon dissolution of the National Assembly by the President of Pakistan, n terms of Article 58(1) read with Article 48(1) of the Constitution of the Islamic Republic of Pakistan, vide Ministry of Parliamentary Affairs' SRO NO. 487(1)/2022, dated 3rd April 2022, Mr Imran Ahmad Khan Niazi ceased to hold the Office of the Prime Minister of Pakistan, with immediate effect," the notification said, which was signed by Additional Secretary Eazaz Dar.

Another notification said all 19 special assistants to the Prime Minister, including DR Sania Nishtar, Mr Mohammad Shehzad Arbab, Dr Faisal Sultan and Sardar Yar Muhammad Rind, ceased to hold office.

 

Imran Khan’s Pakistan Tehreek-e-Insaf (PTI) will send the names of the caretaker Prime Minister to the opposition on Monday, April 3. A meeting is underway in the Bani Gala residence of Imran Khan to consider the names of the caretaker PM.

The no-confidence motion introduced by the united opposition fell through after Deputy Speaker Qasim Suri declared it illegal as according to him it sought to topple the government at the direction of a foreign power. Imran Khan on Sunday poked fun at the Opposition leader after evading a no-trust motion against him in the NA. "The opposition is still unable to understand what happened today," Khan laughingly told his lawmakers.

Imran Khan has been removed from office of prime minister of Pakistan effective immediately, a newly released government release has said.

Pakistan President Arif Alvi earlier dissolved the National Assembly (NA) on advice of Prime Minister Imran Khan, minutes after Deputy Speaker Qasim Suri rejected a no-confidence motion against the premier, who had effectively lost the majority in the 342-member lower house of Parliament.

 

Meanwhile, the opposition declared PML-N leader Shehbaz Sharif as the prime minister with support of 195 members.
