Penalties. When enforcements of awards and judgements have proven non-existant, what teeth do NDA's have that all other rulings do not. And just because someone is paid 10mill doesn't mean they won't turncoat, if anything it shows a lack of loyalty to anything akin to the truth.
A living document should be able to defend itself from attackers.
