Reich (and Fauci) are Wildly Wrong

Dear Correspondent,

 

Because when you sent to me the following tweet by Robert Reich you provided no commentary, I can’t tell if you approve or disapprove of its contents, which are in full:

 

Perhaps there’s something wrong with a system that allows a 35-year-old, unelected, Trump-nominated judge — whom the American Bar Association deemed unqualified — to strike down the travel mask mandate for the entire country?

 

Yet sensing that you find Reich’s tweet to be a brilliantly damning indictment of U.S. District Court Judge Kathyrn Kimball Mizelle’s ruling against the CDC’s mask mandate, I feel obliged to explain why I think Reich’s tweet is, to put it mildly, moronic.

 

First, there is no legally specified minimum age for serving on the federal bench. Joseph Story – no slouch as a jurist – was appointed to the U.S. Supreme Court at the age of 32.

 

Second, like him or not, Donald Trump was president from 2017 to 2021, and among any president’s duties is to nominate federal-court judges.

 

Third, Judge Mizelle wasn’t put on the court by Trump unilaterally; she was approved by the Senate.

 

Fourth, all federal-court judges are unelected.

 

Fifth, also unelected are all public-health officials, including Anthony Fauci and Rochelle Walensky.

 

Sixth, while the ABA did indeed deem Judge Mizelle to be unqualified, it did so because she spent little time in the private practice of law. If this criterion suffices to render someone unfit for high government office, Anthony Fauci is even less qualified for his position than is Judge Mizelle for hers, given that Fauci spent no time in the private practice of medicine. Upon completion of his residency in 1968, he took a job with the National Institutes of Health. He has ever since been employed by the government.

 

Seventh, because the CDC is a federal-government agency, its diktats generally cover the entire country – a fact that should be doubly obvious in the case of diktats affecting interstate commercial air travel. Judge Mizelle could hardly have ruled against the mask mandate for only a subsection of the country.

 

Eighth, Reich skates alarmingly close to implicitly endorsing a totalitarian proposition that Fauci recently endorsed explicitly – namely, that government-employed public-health bureaucrats are above the law. About Judge Mizelle’s ruling, Fauci declared: “We are concerned about that – about courts getting involved in things that are unequivocally public health decisions. I mean, this is a CDC issue; it should not be a court issue.”

 

To propose that any government action be immune to judicial oversight – that is, immune to oversight by the formal guardians of the law – is to propose that the officials who perform that action are above the law. As Reason’sEric Boehm wrote in reaction to this authoritarianoutburst by Fauci, “This is either a complete misunderstanding of the American system’s basic functions or an expression of disdain toward the rule of law.”

The Unmasking of America

 

It turns out that the mysophobic control freaks who wanted the entire population muzzled had become a tiny minority, the blue-checkmark people that relied on digital media to amplify their weird opinions so that they seemed to be mainstream. The facade cracked and fell almost at the same time, all at once, to the point that it was effectively impossible for the Biden administration to announce an appeal.

 

….In my lifetime, I’m not sure I can remember a single other time when a federal government rule imposed upon an entire country, one that affected so many people on a daily basis, was suddenly declared to be completely illegalnot just newly illegal in light of new data but illegal all along. It means that the government, not the people, had been in violation of the law. That is nothing short of astonishing. Surely the implications of this will resonate for many years to come.

 

This seems to have been the turning point, that moment for which so many people had waited so long, the dawning and entrenchment of a realization: the “public health measures” that government had long pushed on us had not actually worked. Maybe, just maybe, a pandemic takes a predictable trajectory, like the sun and the stars and the tides, and government only pretends to control it.

 

Judge Kathryn Kimball Mizelle in her brilliant opinionuses a word in passing to describe the effort to forcibly separate and mask the population: “experimental.” Exactly right. They experimented on us. On people! Their experiment not only failed. It created vast carnage in every direction. Even now, we are far from being over the suffering. The inflation, the supply chain issues, the educational and health losses, the demoralization is all still with us and will likely get worse.

 

Meanwhile, as of right now, it surely seems like the people who did this to us – far less than 1% of the population and maybe no more than a few hundred who relied on Big Tech and Big Media to make their marginal ideology larger than life itself – stand on the verge of being completely discredited. We shall see.

 

Meanwhile, the strictures for travelers coming to the US still exist. People are still being fired from their jobs for not being vaccinated. Many countries are still closed. And all the media venues that pushed for lockdowns and mandates are all warning that they will come back, just you wait and see.

 

More ominously, all the powers that these people abused are still possessed by the administrative state.The Public Health Service Act of 1944 is still with us along with the federal quarantine power that is so easily abused. That needs to go. More reforms are needed, more inquiries, more truth, plus we need iron-clad assurances that nothing like this will ever happen again.

 

At Brownstone Institute we are particularly interested in a closer, much closer, look at exactly how all of this happened. There are dozens of questions that remain. The struggle to tell the story begins now, and this effort will last for many years to come.

 

What lockdowns and mandates have done to society is a painful truth, and one that we will be dealing with for many years. As much as we all just want it to go away, and as much as we all have great cause to celebrate this day, as much as the repeal of the mask mandate represents a symbolic end, no one should lose sight of the deeper problem: all of this happened to us, and not only to us but to billions of people the world over.

 

It did not happen by accident. It happened because a tiny group of intellectuals, who implausibly gained control over a machinery of power, believed that they had the power to remake the world and used a pandemic to try out their skills. That’s a terrifying reality, and one that should loom large in our minds and hearts for many years to come.

Global military spending breaks record

 

The top military spenders in 2021 were the US, China, India, the UK, and Russia

 

The military spending of all nations combined set a new record in 2021, exceeding the $2 trillion mark for the first time ever, the Stockholm International Peace Research Institute (SIPRI) revealed in a report published on Monday.

 

Governments spent a total of $2.113 trillion on weapons last year. The top spenders were the US, China, India, the UK, and Russia, accounting for 62% of the total sum.

 

According to the researchers, 2021 was the seventh consecutive year in which global military expenditures had grown, despite the strains placed on economies by the Covid-19 pandemic.

 

••While US defense spending slid by 1.4% compared to 2020, Washington remained the absolute global leader, having lavished some $801 billion last year==. The SIPRI report also points out that US funding for military research and development – while having dropped by 1.2% last year – still rose by 24% between 2012 and 2021. That suggests that the US is “focusing more on next-generation technologies,” according to Alexandra Marksteiner, a researcher with the SIPRI’s Military Expenditure and Arms Production Programme. “The US Government has repeatedly stressed the need to preserve the US military’s technological edge over strategic competitors,” she said in a statement.

 

With an estimated $293 billion spent on weapons, China holds second place on the SIPRI’s list. According to the Sweden-based institute, Beijing’s military spending has increased for 27 years in a row, with a 4.7% rise in 2021.

 

India comes in third with $76.6 billion spent last year, up 0.9% from 2020. The report notes that New Delhi has been working to decrease its dependence on imported arms of late, with 64% of its military outlays having gone to local arms manufacturers.

 

The UK spent $68.4 billion on defense in 2021, a 3% increase over the previous year.

 

According to SIPRI estimates, Russia’s military outlays rose by 2.9% to reach $65.9 billion in 2021. Moscow thus spent 4.1% of its GDP on defense. The country’s military spending has grown for three consecutive years, according to the report. Lucie Béraud-Sudreau, director of the SIPRI’s Military Expenditure and Arms Production Programme, noted that “high oil and gas revenues helped Russia to boost its military spending in 2021.” She added that “Russian military expenditure had been in decline between 2016 and 2019 as a result of low energy prices combined with sanctions.”

 

In Europe, eight more NATO member states brought their defense spending in line with the alliance’s target of at least 2% of their respective GDPs last year. Germany, while not being among those nations meeting the target, nevertheless ranked as the third largest defense spender in Central and Western Europe, having disbursed $56.0 billion on its military, or 1.3% of its GDP.

The social media platform is growing more receptive toward Musk’s $43 billion takeover bid, media report

 

Twitter is in discussions over Elon Musk’s acquisition bid and could finalize a deal as soon as this week, the Wall Street Journal reported on Sunday, citing people familiar with the matter. Earlier this month, the billionaire unveiled a $43 billion offer to take the microblogging platform private, which could become one of the biggest internet acquisitions ever.

 

According to the newspaper, Musk met with Twitter executives on Sunday who were generally more open to discussing a deal than they previously were. “Twitter is taking a fresh look at the offer and is more likely than before to seek to negotiate,” it said, adding that “the situation is fast-moving.

 

The newspaper also said that Musk had told Twitter Chairman Bret Taylor in recent days thathe won’t adjust his $54.20-a-share offer for the company.

 

Just 10 tens ago, Twitter’s board countered Musk’s proposal by enacting a shareholders’ rights plan known as a “poison pill,” to protect the company from a hostile buyout. In response, Musk vowed to sack the social media giant’s directors if his takeover bid succeeds.

 

An active Twitter user with over 81.5 million followers, Musk became one of the social network’s largest shareholders after acquiring a 9% stake in the company in late March. Musk is currently worth about $260 billion, according to Bloomberg’s Billionaires Index. To compare, Twitter’s current market valuation stands at about $37 billion.

 

Twitter shares have soared by 25% since Musk launched his takeover bid in early April. They were trading at $49.43 per share in pre-market trading on Monday.

Ukrainian plot to kill Russian journalist foiled – Moscow

The would-be assassins were detained, and explosives and firearms seized, Russia says

 

Russia’s Federal Security Service (FSB) claimed on Monday that it detained a group of “neo-Nazis” instructed by Kiev to kill popular Russian TV host and journalist Vladimir Solovyov.

 

According to the FSB, the hit was ordered by the Security Service of Ukraine (SBU). “The members of the criminal group are confessing to preparing to kill Solovyov and flee abroad afterwards.”

 

The FSB said that during searches, it seized an explosive device, eight Molotov cocktails, six handguns, a sawed-off hunting rifle, and a grenade. It added that more than 1,000 rounds of ammunition were seized as well, along with fake Ukrainian passports.

 

The statement followed shortly after President Vladimir Putin said that “a terrorist group was planning to attack and kill a well-known Russian journalist.”

 

“They will deny it, obviously, but the facts and evidence are solid,” he added, speaking at a meeting of the Prosecutor General’s Office Board earlier in the day.

 

Solovyov, 58, hosts a popular political talk show on Russia 1 TV, the ‘Full Contact’ radio show, and actively comments on social media. The veteran journalist is known for his pro-government position and has strongly supported Russia’s military operation in Ukraine.

 

In February, the EU put the presenter – along with 374 other Russians – on a no-fly and asset-freeze list. In early March, YouTube blocked his two channels, claiming they violated the platforms’ community guidelines.

 

Kiev has not commented on the accusation it was behind the alleged plot to kill the journalist.

Russia opens humanitarian corridor for civilians from Mariupol’s Azovstal plant

 

Soldiers will observe a ceasefire to let civilians exit in all directions, the Ministry of Defense has announced

 

Russian and Donbass forces will observe a ceasefire around the besieged Azovstal steel mill in Mariupol starting from 2pm Moscow time on Monday, allowing civilians to evacuate to safety, the Russian Defense Ministry has said.

 

Colonel General Mikhail Mizintsev, the head of Russia’s National Defense Management Center, said that armed units will “withdraw to a safe distance and maintain the exit of civilians from the said area in any direction they choose.”

 

Russian and Donbass troops mainly control the city, but a number of Ukrainian soldiers have been holed up in Azovstal. Ukrainian President Volodymyr Zelensky, however, claimed last week that roughly 1,000 civilians remained in the mill as well.

 

Mizintsev said there were “no obstacles” for civilians to leave the Azovstal plant, other than “the decision of Kiev and the commanders of nationalist units to use civilians as a human shield.”

 

Russia previously offered the Ukrainian fighters the opportunity to lay down their arms and surrender, but they refused.

 

On Thursday, Russian President Vladimir Putin called off the assault on the mill, opting for a blockade instead.

 

According to Mizintsev, a safe passage from Azovstal has remained open since March 21. However, Ukrainian Deputy Prime Minister Iryna Vereshchuk accused Russia on Sunday of failing to guarantee a ceasefire in the area.

 

Mizintsev said that Russia would notify Vereshchuk on the matter. According to theMOD, information about the ceasefire and safe passage will be transmitted to the Ukrainians by radio every 30 minutes.

 

The battle for Mariupol has been raging for nearly two months, as Russian and Donbass forces completely surrounded the city.

Ukrainian drones shot down in Russia – governor

 

A pair of Ukrainian drones were destroyed in Russia’s Kursk Region, which borders Ukraine from the northeast, the region’s governor has said.

 

Governor Roman Starovoyt wrote on social media that “Russian air defense troops shot down two Ukrainian drones” early Monday morning in the village of Borovskoye. He said no one was hurt in the incident.

 

“The terrorist alert in the region will be extended,” Starovoyt added later during a government meeting. The governor earlier said that mortar shells had hit a border crossing on Saturday, also with no casualties.

 

Also on Monday morning, a fire broke out at an oil depot in Bryansk, a city around 150km (93 miles) from the Ukrainian border. The cause of the fire is unclear.

 

On April 1, Russia accused Kiev of conducting a helicopter raid on an oil depot in Belgorod, another city in a region bordering Ukraine. Kiev has denied carrying out attacks on Russian territory.

Russia urges allies to dump dollar and euro in trade

 

Moscow has called on trading partners to switch to national currencies

 

Russia should increase settlements in national currencies with partner countries, Denis Manturov, head of the Russian Ministry of Industry and Trade, said at the plenary session of the Innoprom international exhibition in Uzbekistan on Monday.

 

He was addressing countries within the Eurasian Economic Union (EAEU), BRICS and the Shanghai Cooperation Organisation (SCO), of which Russia is a member.

 

According to the minister, in 2021, the growth of Russia’s trade turnover with partners within these associations amounted to about 38%, while together these unions make up roughly half of the global economy. According to Manturov, the future of their successful cooperation depends on how fast Russia’s partners move away from the US dollar and the euro toward national currencies in mutual settlements.

 

“What is happening today in the global economy and in the world gives us a hint about how we need to rebuild our logistics, industrial cooperation, in what directions we can develop our economies.This [is] de-dollarization, and now we have added de-euroization, that is, the transition to our own currencies in order to be as independent as possible in terms of mutual settlements,” Manturov said.

 

The minister added that Western Europe and the US are now experiencing hyperinflation, which “affects the development of industrial sectors and the economy as a whole.” And reorienting cooperation within alliances which do not include the EU and the US to national currencies will give Russia’s partners maximum independence in the development of joint projects, he added.

EU to offer India more military hardware – media

 

The European Commission president’s ongoing visit to New Delhi reportedly aims to woo the country away from Russia

 

Von der Leyen is also expected to discuss the resumption of talks on a free trade agreement between the bloc and India, according to Reuters. The main objective of the European Commission chief is to woo India away from its long-standing military and economic partner, Russia, the report claims.

 

“There are a whole host of Western leaders reaching out to India right now to see what alternatives we can provide,” the unnamed EU official told Reuters. “The key is that we want to bring forward this relationship, work on technology together and bring India into our camp, that’s the main message of our visit.”

 

India and the EU have been holding talks on establishing a free trade agreement off and on for years. The negotiations were frozen in 2013, when they hit a snag over tariff reduction and patent protection issues, and restarted in 2021.

 

Last week, UK Prime Minister Boris Johnson paid a visit to his Indian counterpart as well. He offered to boost defense cooperation between the two countries to Modi, with a potential free trade deal also high on the two leaders’ agendas.

 

Johnson, among other things, pledged that Britain would support India in creating its own fighter jets. He also promised to issue an India-specific open general export license to reduce delivery times for defense items destined for India.

 

The UK prime minister acknowledged, however, that it is unlikely India would turn its back on Russia in the foreseeable fut European Commission President Ursula von der Leyen will offer Indian Prime Minister Narendra Modi a boost in sales of EU-made weapons to New Delhi on Monday, Reuters reports, citing an unnamed senior EU official. Brussels is supposedly seeking to encourage India to reduce its ties to Russia amid the Kremlin’s ongoing military campaign in Ukraine.

 

While calling for a peaceful resolution to the military conflict in Ukraine, India has stopped short of directly condemning Russia’s actions or imposing sanctions.

Blinken, Austin promise more aid during Kiev visit

US Secretary of State Antony Blinken and Secretary of Defense Lloyd Austin made an unannounced visit to Ukraine on Sunday, where they promised additional military funding and diplomatic support to the country amid the Russian offensive.

 

News outlets said that, due to security concerns, reporters accompanying Washington’s top diplomat and defense chief were barred from reporting on the trip until the officials left Ukraine.

 

President Volodymyr Zelensky announced the visit during a press conference on Saturday, but the US publicly confirmed that it had happened only on Monday.

 

“We had the opportunity to demonstrate directly our strong ongoing support for the Ukrainian government and for the Ukrainian people,” Blinken told reporters after crossing from Ukraine to Poland.

 

The strategy that we’ve put in place, massive support for Ukraine, massive pressure against Russia, solidarity with more than 30 countries engaged in these efforts, is having real results.

Austin said that the US has “the mindset” to help Ukraine win the fight against Russia.

 

Blinken and Austin promised President Volodymyr Zelensky more than $322 million in new military aid, news agencies said, citing US officials. Washington will also reportedly sellUkraine up to $165 million worth of “nonstandard ammunition.”

 

It will provide support for capabilities Ukraine needs, especially the fight in the Donbass,” a US official was quoted by Reuters as saying.

 

“This assistance will also help Ukraine’s armed forces transition to more advanced weapons and air defense systems, essentially NATO capable systems.”

 

The media quoted a State Department official as saying that US diplomats will return to the of city Lviv in western Ukraine as the first step to reopen the embassy in Kiev “as soon as possible.”

 

The White House will reportedly nominate Bridget Brink, who currently serves as ambassador to Slovakia, to serve as ambassador in Kiev. There has not been a confirmed US ambassador in Ukraine since 2019.

 

The US and its NATO allies are supplying Ukraine weapons, ranging from anti-tank and anti-aircraft missile systems to armored vehicles and howitzers. They also imposed economic sanctions on Moscow.

Letter: No, Hillary Can’t Try To Hide Her Oppo From The Special Counsel

The Hillary Clinton campaign and Democratic National Committee’s claims of attorney-client privilege in the Michael Sussmann criminal case may constitute a breach of the settlement agreements they entered with the Federal Election Commission, according to a letter sent to Special Counsel John Durham’s office on Friday.

 

That letter, obtained first by The Federalist, followed the flurry of motions to intervene filed in the special counsel’s pending false statement case against Sussmann. Hillary for America, the DNC, tech executive Rodney Joffe, Sussmann’s former law firm of Perkins and Coie, and the investigative firm Fusion GPS all filed motions last week asking the court for permission to argue against disclosing documents to the special counsel based on their claims of attorney-client privilege.

 

The special counsel’s office had previously filed a motion arguing that the court should review 38 documents withheld in response to grand jury subpoenas to assess whether the secreted material truly qualified as protected by attorney-client privilege. The day after Sussmann responded to that motion, opposing any such in camera review by the judge, his fellow Spygate hoaxers sought to join in Sussmann’s efforts to keep the documents concealed.

 

After the Hillary for America and the DNC’s motions to intervene hit the Sussmann docket, The Coolidge Reagan Foundation penned a three-page letter to Durham and Assistant Special Counsel Jonathan Algor. That letter alerted the special counsel’s office to key facts about the FEC’s recent decision to fine the political groups in relation to a complaint the foundation had filed with the FEC. That complaint charged Hillary for America and the DNC with using the “law firm, Perkins Coie, to hire and funnel over $1 million to ‘outside research firms’ such as Fusion GPS ‘to perform potentially sensitive, controversial, or politically embarrassing’ opposition research into Donald Trump.”

 

The FEC complaint, filed in 2018, alleged that “the research was not ‘for the purpose of assisting Perkins Coie in providing legal advice,’” but to further the “political and campaign-related goals” of the organizations. The foundation also claimed in its FEC complaint that because the work was not “for the purpose of providing legal advice or assisting with impending or potential litigation, it was not covered by attorney-client, work-product, or other privileges.”

 

Significantly, as the foundation noted in its April 22, 2022 letter to the special counsel’s office, the FEC had “found probable cause to believe” the political organizations had misreported the purpose of certain disbursements. The FEC reached that conclusion based on a memorandum prepared by the FEC’s Office of General Counsel, but under controlling regulations that memorandum “will not be made public for another week,” the letter explained.

 

Foundation counsel Dan Backer added that while the memorandum is not yet public, the special counsel’s office would likely be able to obtain it directly from the FEC. That memorandum also will provide Durham’s team further details on the FEC’s investigation and fact-finding that may be useful to the special counsel in the Sussmann litigation, noted the letter.

 

In Friday’s letter, Backer also highlighted Hillary for America and the DNC’s commitment in their settlement agreement with the FEC to “not further contest the Commission’s finding of probable cause to believe” that the political organizations had “falsely reported their payments through Perkins Coie to Fusion GPS as being for legal services.” In contrast, in the Sussmann case, Hillary for America and the DNC “are nevertheless asserting materials generated by Fusion GPS and provided to Perkins Coie are protected by attorney-client privilege and work-product doctrine,” the letter stressed.

 

The Government should not permit HFA and the DNC to adopt conflicting positions in different proceedings, depending on the federal agency against which they are litigating,” the foundation’s letter concluded, suggesting the trial court may find those breaches of the settlement agreement “material in ruling on any privilege claims.”…

Letter: No, Hillary Clinton Can’t Try To Hide 2016 Oppo Research From The Special Counsel

 

…Whether the special counsel will follow the foundation’s suggestion and obtain the memorandum prepared by the FEC’s Office of General Counsel before the judge in the Sussmann case rules on the Clinton campaign and the DNC’s assertions of attorney-client privilege is yet to be seen. But what is clear is that the special counsel’s office intends to ensure the jury knows that both the Clinton campaign and the DNC believe communications relevant to Sussmann’s efforts to peddle the Alfa Bank hoax are protected by attorney-client privilege.

 

On Friday we also learned just how the special counsel hopes to do that—by having representatives of both the Clinton campaign and DNC testify at trial. That revelation appeared in a response brief Sussmann’s attorneys filed last week, wherein the defense team noted that they had just learned that the special counsel had issued trial subpoenas to both the Clinton campaign and the DNC. According to Sussmann’s legal team, the special counsel requested “the testimony of witnesses” from those political organizations “regarding the assertion of attorney-client privilege in front of the jury.”

 

Sussmann is now also seeking to exclude that testimony and claims that both the Clinton campaign and the DNC will likewise seek to quash the subpoenas.

 

The irony in all of this, of course, is that the more Sussmann, the Clinton campaign, and the DNC hide behind the claims of attorney-client privilege,the more it appears that, yes, Sussmann pushed the Alfa Bank hoax, including during his meeting with FBI General Counsel James Baker, on behalf of the Clinton campaign. The FEC’s conclusion that probable cause existed to support the finding that the Clinton campaign and DNC had falsely reported fees paid to Fusion GPS as legal fees only further supports that conclusion.

 

The question Friday’s letter to the special counsel’s office raises, however, is whether the Clinton campaign and the DNC’s settlement agreement with the FEC, in fact, forecloses their claims of privilege in the Sussmann case. Backer believes it does, telling The Federalist, “The Clinton Campaign and the DNC want to have their cake and eat it too, but they cannot simultaneously say they won’t contest the reasoning behind the FEC fine and settlement agreement and also run to federal court and say, ‘No, no, no, everything we do is privileged.’”

 

That, however, is precisely what Hillary for America and DNC are doing, leading one to wonder if the real issue in play is not attorney-client privilege, but the privilege of being a Democrat.
