Whitmer will 'fight like hell' to protect abortion access

If the U.S. Supreme Court overturns Roe. v. Wade, then the state AG race could determine whether abortion is criminalized or not.

Gov. Gretchen Whitmer said she’ll “fight like hell” to protect abortion access in Michigan.

She responded Monday night to a leaked U.S. Supreme Court draft majority opinion from Politico claiming that the nation’s top court would overturn Roe v. Wade, which established abortion as a constitutional right.

Chief Justice Roberts confirmed the document’s authenticity today and ordered an investigation, the Associated Press reported. It was the first time a Supreme Court decision was leaked in modern U.S. history before it became official with a formal release.

Justices Samuel Alito, Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett signed the opinion, Politico says.

The U.S. Supreme Court decided to hear Mississippi’s appeal of a 2019 decision, Dobbs v. Jackson Women’s Health Organization. In that decision, the U.S. Court of Appeals for the Fifth Circuit upheld a previous decision by the U.S. District Court for the Southern District of Mississippi, overturning a state law prohibiting abortions after the 15th week of pregnancy.

Whitmer continued: “To the nearly 2.2 million women in Michigan whose access to abortion hangs in the balance, I promise you this: I will fight like hell to make sure abortion remains safe, legal, and accessible in our state.”

In April, Whitmer asked the state Supreme Court to strike Michigan’s 1931 abortion ban that Roe. v. Wade overruled. On the same day, Planned Parenthood sued to overturn the abortion ban that Attorney General (AG) Dana Nessel has vowed not to enforce if triggered.

The lawsuits ask the court to stop enforcement of the abortion ban, arguing it violates Michigan’s due process clause protecting a right to privacy and bodily autonomy.

If the U.S. Supreme Court overturns Roe. v. Wade, then the state AG race could determine whether abortion is criminalized or not. The House GOP budget aims to allocate $750,000 to defend the constitutionality of state laws, specifically the abortion ban.

A “Reproductive Freedom For All” group is pushing a ballot petition to ask Michiganders if they want to create a state constitutional right to reproductive freedom.

To reach the Nov. 8, 2022 ballot, the group must collect 425,059 valid signatures by July 11, 2022. The petition drive would define the right as "the right to make and effectuate decisions about all matters relating to pregnancy, including but not limited to prenatal care, childbirth, postpartum care, contraception, sterilization, abortion care, miscarriage management, and infertility care.”

In November 1972, Michiganders rejected a ballot proposal to legalize abortion.

It’s an election year, and Matt DePerno, the GOP-endorsed and Trump-endorsed AG candidate, has said if elected, he plans to prosecute the 1931 law with no exceptions, including rape and incest, or even to save the life of the mother.

“I do not have exceptions to abortion,” he said in a video posted by Nessel in which he incorrectly describes the law as enacted in the 1950s.

“And I would enforce that law immediately when I am elected and sworn into office,” DePerno said.

In 2020, 29,669 abortions were performed in Michigan.

Apparently, the Supreme Court leaker did not only leak secret case developments with Politico. CNN reportedly has more details on the Supreme Court’s discussion on the upcoming Roe v. Wade decision.

Chief Justice Roberts, who reportedly joined the liberal judges on the court in the upcoming decision, was trying to barter with the conservative judges in their negotiations. Roberts is reportedly willing to uphold the Mississippi law that would ban abortion at 15 weeks of pregnancy.

HotAir reported — With an apparent 5-3 lineup set to overturn Roe based on Justice Samuel Alito’s draft majority opinion in Dobbs, Chief Justice John Roberts has reportedly argued to retain Roe while dumping Casey as a compromise position.

It appears that five justices would be voting to overturn Roe. Chief Justice John Roberts did not want to completely overturn Roe v. Wade, meaning he would have dissented from part of Alito’s draft opinion, sources tell CNN, likely with the court’s three liberals.

That would mean that the five conservative justices that would make up the majority overturning Roe are Alito and Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett.

Roberts is willing, however, to uphold the Mississippi law that would ban abortion at 15 weeks of pregnancy, CNN has learned. Under current law, government cannot interfere with a women’s choice to terminate a pregnancy before about 23 weeks, when a fetus could live outside the womb.

Donald Trump’s candidate for Tennessee’s 5th Congressional district has scrubbed the former President from her campaign website, and appears to be in the middle of abandoning her run for Congress.

Ortagus’s Twitter biography has changed in recent weeks, since she was first removed from the ballot by the Tennessee GOP under rules concerning Republican bonafides. Other removed candidates are challenging the rules in federal court.

But Ortagus’s website, which featured multiple endorsements and mentions of former President Donald Trump, is now a simple landing page with the tag line, “Thank You” on a browser tab.

Sources close to Ortagus have confirmed to The National Pulse that the former State Department spokesman will not pursue a challenge to the ruling following advice from lawyers. Ms. Ortagus did not respond to a request for comment at the time of publication.

The would-be candidate attracted criticism for her relationships with leading left wing figures, as well as her pledge to serve President Joe Biden, has not tweeted about Tennessee or her candidacy since April 19th. Ortagus’s social media has been primarily concerned with Ukraine and Iran since.

Another candidate from her district, Robby Starbuck, announced yesterday that he is challenging the TNGOP decision to remove him, Ortagus, and Baxter Lee from the ballot.

Local GOP bylaws require candidates to have voted in three of the last four statewide Republican primaries in order to run for office.

In a statement released online on Monday, Starbuck said: “Yesterday, my team and I officially responded to the @TNGOP scheme to remove me and others from the primary ballot, with a lawsuit in federal court. I took this major step to fight for the rights of Tennessee voters, only after the state party, in the face of a detailed legal demand and a mountain of evidence, refused to do the right thing and correct what they did wrong by disenfranchising their own voters.

‘Hundreds Of Images’ Corporal At Tennessee Special Needs Prison Facing Child Porn Charges

NASHVILLE (MNPD) – Detectives assigned to the MNPD’s Internet Crimes Against Children Unit today charged a Tennessee prison correctional officer with storing hundreds of items of child porn on his internet cloud account.

Michael Vernon White, 54, of Nashville, a corporal at the Deberry Special Needs Facility, was stopped and arrested on his way to work this morning. Detectives then executed a search warrant and seized a computer from White’s home along with his cell phone.

The investigation, led by Detective Rob Carrigan, began after an Internet service provider detected and reported multiple uploads of sexual images and videos depicting young girls. The telephone number associated with the account was subsequently linked to White.

A judicial commissioner set White’s bond at $50,000, which he posted.

Congress Probes Biden Admin After Taliban Uses US Biometric Data To Target Allies

Congress is demanding answers from the Biden administration following a disclosure that reams of biometric data abandoned by the United States during its bungled withdrawal from Afghanistan are being used by the Taliban to target American allies still stuck in the war-torn nation.

Eight Republican senators led by Sen. Marsha Blackburn (Tenn.) are asking the State and Defense Departments to turn over information related to the evacuation of U.S. troops in Afghanistan that allowed the Taliban to retake control of the country. In addition to leaving behind $7 billion worth of military hardware, the United States abandoned "sensitive data, including biometric data," on Afghan allies that are now reportedly being used by the Taliban to target those who supported the United States’ 20-year war in the country.

"These systems, which were abandoned when the U.S. military withdrew from Afghanistan, contained iris scans, fingerprints, photographs, occupational data, home addresses, and names of relatives," the senators wrote, according to a copy of the letter obtained exclusively by the Washington Free Beacon. "The Taliban is using this personal information to increase targeted killings, torture, and forced disappearances of Afghans who helped the United States." The senators warned that "the Taliban will continue to target the vulnerable with equipment and information that the Biden Administration left behind."

The probe comes just weeks after Human Rights Watch, an advocacy organization, released a bombshell report detailing how the Taliban is using abandoned biometric data to eradicate those who worked alongside the United States.

With the international community focused on Russia’s unprovoked war in Ukraine, the Taliban has increased its assault on U.S. allies stuck in Afghanistan. An unknown number of Afghan citizens who aided the United States remain in hiding as the Taliban uses the U.S. government’s own data to abduct these individuals. The senators’ investigation into the matter is the latest Republican effort to unearth the extent of damage caused by the Biden administration’s decision to evacuate Afghanistan.

Blackburn and her colleagues are instructing the Pentagon and State Department to explain the "policies and procedures governing when and how the U.S. collects sensitive data, including biometric data, of individuals working with the American military around the globe, including those who supported U.S. efforts in Afghanistan." They expect this information will help prevent a future situation in which sensitive government data fall into enemy hands.

The senators also want to know what safeguards are in place to secure these data. "Where is such data stored and how is it disposed of in the event of mission changes or unintended transfers of control of the data?" they asked.

JTA — Russian Chief Rabbi Berel Lazar has criticized remarks by his country’s foreign minister, who suggested that some of the worst antisemites were Jewish and that Adolf Hitler had Jewish ancestry.

Lazar’s criticism of Foreign Minister Sergei Lavrov’s remarks Sunday — he called them “shocking” and said he wished Lavrov would apologize — is unusual in Russia, where other clergy have been supportive of the war in Ukraine and where dissent has largely been made illegal.

Widely viewed as having close ties with Russian President Vladimir Putin, Lazar and the organization he leads, the Chabad Lubavitch-affiliated Federation of Jewish Communities of Russia, have expressed displeasure with the war while refraining from criticizing the Putin regime directly over it.

“I do not consider myself entitled to give advice to the head of Russian diplomacy — but it would be nice if he apologized to the Jews and simply admitted that he was mistaken,” Lazar wrote in a reply to a request for comment by the Jewish Telegraphic Agency.

“I think it would then be possible to consider the incident settled and turn the page,” Lazar added.

“We paid attention to the anti-historical statements of the head of the Israeli Foreign Ministry @yairlapid, which largely explain the course of the current Israeli Government support of the neo-Nazi regime in Kyiv,” Russia’s ministry tweeted.

Lavrov’s remarks appeared to be an attempt to reconcile the fact that Ukraine’s president, Volodymyr Zelensky, is Jewish, with Russia’s declared reason for the February 24 invasion. Putin said Ukraine was in need of “denazification.”

“When they say that Nazification cannot exist if there are Jews [in charge]: In my opinion even Hitler had Jewish origins so it means absolutely nothing,” Lavrov told Italy’s Channel 4 on Sunday. “Jewish wise people said already a long time ago that the biggest antisemites are Jewish themselves.”

The remarks prompted a stream of condemnations by Jewish groups and Israeli officials, including Prime Minister Naftali Bennett, who called them “lies.” Foreign Minister Yair Lapid called Lavrov’s remarks “both inexcusable and scandalous and also a terrible historical error.”

Bennett’s comments were notable because he has held back from criticizing Russia sharply even as Lapid has struck a more forceful tone, a balancing act that is widely understood as meant to allow Israel, which has strategic interests with Russia, to maintain a degree of neutrality.

But as the war grinds on, that neutrality may be eroding: Israel is sending more defensive weapons and aid to Ukraine, and Russia, isolated internationally, is increasingly engaging with Iran, Israel’s nemesis. Lavrov’s comments represent another breach.

On Tuesday, the Russian foreign ministry accused Israel of supporting “the neo-Nazi regime in Kyiv” for protesting Lavrov’s rhetoric.

Lazar said it was “inappropriate to draw any comparisons” between the Holocaust and current affairs. Referring to the role that Soviet forces played in defeating the Nazis, he told JTA that such a comparison “belittles the achievement of these heroic soldiers who liberated Auschwitz and hoisted the banner of victory over the Reichstag.
