  1. Last night, Michael SUSSMANN’s attorneys made a written motion to strike certain portions of Mark Elias’ testimony from the record, or, for a mistrial. I am going to continue to analyze this, even thought the judge has just denied the motion for the mistrial, but granted the motion to strike.

  2. Sussmann’s attorney argued that questions asked of Elias, and answers given by him prejudiced Sussmann- they argue this because Elias indicates that Sussmann would KNOW the answers to these questions, therefor potentially implicating him depending on how things go. However the entire thing played out in a strange way. Both the defense AND the prosecution asked questions of Elias that evoked the response.

  3. When the defense asked “to YOUR knowledge” Elias responded “you’ll have to ask him”. In my OPINION, Elias knew EXACTLY what he was doing, This is a skilled trial attorney with decades of experience sitting on the stand, not some everyday bloke who wandered in off the street. The defense didn’t want to bring the jury’s attention to it (so they say) so they didn’t move to strike orally right then. Sometimes doing that puts it in the jury’s head as a Streisand effect.

  4. Then, on redirect, the prosecution asked him differing versions of that question three times, all eliciting the same response from Elias. It was just very odd. The motion states that there were three objections to this, all sustained, but the SC kept asking anyway. It just seems very “on purpose”, wouldn’t you agree?

Judge slaps down mistrial request by Clinton lawyer Sussmann in Durham case

 

A federal judge has shot down a bid for a mistrial by attorneys for Hillary Clinton campaign lawyer Michael Sussmann that was sought after witness testimony revealed he may take the Fifth at his trial for allegedly lying to the FBI.

US District Judge Christopher Cooper told Sussmann’s defense team and prosecutors he would deny the motion Thursday morning — but agreed to strike part of the testimony in question from the trial transcript.

In their Wednesday night motion to strike — “or alternatively for a mistrial” — Sussmann’s attorneys said testimony under cross-examination by Marc Elias, the Clinton campaign’s former general counsel, was “nonresponsive and prejudicial.”

When asked by Sussmann attorney Sean Berkowitz if the embattled lawyer passed information to the FBI on behalf of the Clinton campaign, Elias responded, “You’d have to ask Mr. Sussmann.”

After Berkowitz ended his questioning, prosecutor Andrew DeFilippis pressed Elias on the response in a series of queries, to which Sussmann’s defense objected.

In their motion, Sussmann’s attorneys argued that DeFilippis’ questions were “improper” and “directly suggested to the jury that in order to answer a key question in this case … Mr. Sussmann would need to testify.”

“Commenting, either directly or indirectly, on a defendant’s decision to testify or not testify is entirely improper,” they argued.

 

In the motion, the defense asked Cooper to strike both Elias’ answers and the prosecution’s questions from the record — or grant a mistrial.

Cooper said Wednesday he was “not inclined” to grant a mistrial and told the attorneys to be prepared to question witnesses.

Soaring Fuel Prices Leave Owner-Operators With Tough Choices

 

Avery Vise, vice president, trucking for transport consultancy FTR, has some advice for owner-operators struggling with a massive spike in diesel fuel prices and plunging spot market rates: “There are good reasons to sell your truck and become a company driver,” Vise said.

Under the circumstances, it wouldn’t be surprising if some of the 350,000 registered owner-operator drivers seek the protection of company driving, or lease their independent services to a fleet, the latter of which 44% of members of the Owner-Operator Independent Drivers Association (OOIDA) already do. “It’s not happening yet, but it’s coming,” said William “Lewie” Pugh, an OOIDA executive vice president who worked as a leased owner-operator for 24 years, said of free-agent independent drivers either leaving the business or deciding to change the way they operate.
