I might be off with this thought, but we are officially still in a war, as peace on terrorism wasn't declared since the declaration of war on terrorism.
That makes everyone involved - especially those participating "knowingly" a combatant. The "Nürnberg Codex of Ethics" has clear definitions for the punishments of combatants in crimes against children and humanity. In conclusion a military can drag a civilian to its tribunals.
