Is there a precedent or ruling that establishes that US citizens are subject to military tribunal in those circumstances, Anon? Not being argumentative, just seeking a substantive reason to be supportive. I can see that if it can be established that civil courts are unreliable, coerced, usurped, or infiltrated, then military tribunals are called for. However, what is the case if civil courts are functioning?

I'm hopeful, but an opinion by a candidate in a confirmation hearing expressed in a reply to a possibly compromised US Senator is not a legal precedent and has no bearing upon the court.
