“The Court agrees with Smartmatic that Lindell has asserted at least some groundless claims,” the judge wrote in his opinion dated Thursday.
“In particular, the Court concludes that at the very least Lindell’s claim against Smartmatic under the Support or Advocacy Clause falls on the frivolous side of the line (other claims do too). As a result, the Court orders Lindell and his previous counsel to pay some of the fees and costs Smartmatic has incurred defending itself and moving for sanctions,” Judge Carl J. Nichols wrote.
Lindell waved off the ruling by the judge nominated by former President Donald Trump and noted that it was just one of many other irons in the fire to improve election integrity through the court system.
“Whatever the judge thinks, that’s his opinion,” the conservative pillow maker said in an interview with Bloomberg Law. “I’ve got lawyers doing more important things like removing these machines from every state.”
Last summer, Lindell predicted that Trump would be reinstated as President of the United State of America by August 13.
“The morning of August 13, it will be the talk of the world, going, ‘Hurry up! Let’s get this election pulled down,” the huge Trump supporter said at the time. “Let’s right the right. Let’s get these communists out, you know that have taken over.” But this week’s ruling was another blow to the pillow executive’s reinstatement theory as it also indicated that motions to dismiss the lawsuits against Smartmatic, Hamilton Place, and Dominion Voting Systems were also granted.
Smartmatic filed a complaint against Lindell earlier in the year alleging that he lied about the company’s role in the2020 election.
“Mr. Lindell’s message was as dangerous as it was factually inaccurate. Mr. Lindell told people that Smartmatic stole the 2020 U.S. election. He told people that Smartmatic’s election technology, hardware, and software were hacked by China and other foreign countries,” Smartmatic USA Corp.’s complaint against Lindell read.
“He told people that Smartmatic election technology, hardware, and software were developed for the sole purpose of stealing foreign elections by switching votes. And he told people that Smartmatic deployed its election technology, hardware, and software to do just that in the 2020 U.S. election. All lies,” it read.
Social media quickly divided into those in favor of the judge’s dismissal, or for Lindell’s insatiable appetite for election fraud lawsuits.
