The Sussmann Trial: fingers pointed at FBI leadership

 

It was a long day of travel but we’re back at it on the Sussmann trial.

 

This morning started with testimony from Bill Priestap, who in September 2016 was the FBI’s Assistant Director of Counterintelligence. His testimony was expected, even before the witness lists were put out. Back in January, we observed that Priestap had testified before a grand jury. In fact, Priestap himself stated today that he testified before the grand jury in June 2021.

 

A little bit of background on Priestap before we begin. Priestap approved the opening of Crossfire Hurricane and decided against defensive briefings being provided to the Trump Campaign. He was Peter Strzok’s supervisor and also approved the use of all the confidential human sources used against the Trump campaign (Stefan Halper, et al.).

 

Last week, former FBI general counsel James Baker testified that he spoke with Priestap about his meeting with Sussmann and “repeated to Mr. Priestap that Michael had said that he was not there on behalf of a particular client, that he was there as a citizen, as a – essentially as a human source of information, confidential source.”

 

At trial today, Priestap was presented with notes he took after that meeting with Baker. Those notes reflected that conversation with Baker, stating Sussmann “said not doing this for any client.” Priestap also said that the Alfa Bank/Trump Organization investigation ultimately fell under his control. Getting to the issue of materiality, Priestap was then asked about why the motivations of sources matter to the FBI:

 

Q: Based on your experience, if Mr. Sussmann had brought these allegations to the FBI on behalf of the Hillary Clinton Campaign, would that have mattered to the FBI?

 

Priestap: Again, the – somebody – anybody bringing information to the FBI, we’re interested – the FBI is interested in knowing the motivation of the person providing the information.

 

On cross examination, Priestap admitted he couldn’t recall the meeting with Baker or why he wrote in his notes that Sussmann wasn’t there on behalf of a client. After approximately 6 years, his memory was fuzzy:

 

Q: Do you remember anything more about why you wrote that down?

 

Priestap: I do not.

 

Q: You don't remember anything about the context in which that was said to you?

 

Priestap: I do not.

 

To summarize the defense theory of this case, it’s that Sussmann was there to help the FBI and that he supposedly acted against his clients’ interest by stopping a New York Times article on the Alfa Bank allegations from being published. On that topic, Priestap discussed how the FBI might ask a newspaper to not run a story:

 

Q: As a general matter, if the FBI knew that a newspaper story was coming out about a threat from a nation state, are there ever occasions in which you would, at the FBI, want to ask a newspaper to hold off on running that story?

 

Priestap: Yes.

 

Q: Okay. And that's because there are situations in which the FBI would want to have the chance to investigate before a story came out, right?

 

Priestap: Yes. If the FBI thought, let's just say, that publicly revealing a certain matter could potentially negatively impact not just things the FBI was doing but potentially negatively impact the country, we'd want to have a conversation about it.

US tries to force Russian default

 

Washington ends bond payments waiver, pushing Russia towards a technical default

 

The US Treasury Department announced on Tuesday that it would not extend the sanctions waiver that allowed Russia to make sovereign debt payments to Americans, in a move officials previously said would cause Moscow to be in technical default of its debt obligations.

 

The general license waiver, which is set to expire at 12:01 on Wednesday, will not be extended, said a notice posted on the Treasury website. It was a widely expected move, reported as likely by several US outlets last week and all but confirmed by Treasury Secretary Janet Yellen.

 

Washington had blocked Russian accounts over the conflict in Ukraine, but issued a debt waiver because Deputy Treasury Secretary Wally Adeyemo argued such payments would divert funds from the military. Moscow’s payment of debts represented a “sign of success” for US sanctions policy, Adeyemo had argued.

 

Russia also anticipated the move, with the finance ministry announcing last Friday it had made early payments – for a total of $99.25 million – on two outstanding Eurobonds due on May 26. This leaves Moscow with $2 billion worth of external bond payments due before the end of 2022.

== North Korea fires 3 missiles after Quad rebuke

Ballistic missile tests follow condemnation of Pyongyang by US and its allies at Tokyo meeting ==

 

Three ballistic missiles took off from North Korea, the South Korean military reported on Wednesday morning local time. The launches came after the US, Japan, India and Australia – the so-called “Quad” – condemned the North Korean missile program and pledged themselves to “a free and open Indo-Pacific that is inclusive and resilient.”

 

The first missile was fired towards the waters near North Korea’s eastern coast, South Korea’s Joint Chiefs of Staff said in a statement around 6 am local time, offering no additional details. The Japanese coast guard confirmed there had been a launch of an unidentified type of missile.

 

Within an hour, however, Seoul was reporting “additional launches of unknown ballistic missiles in north and east directions,” according to the Yonhap news agency. A total of three missiles were launched between 6 am and 6:42, from the Sunan area of Pyongyang, the South Korean military later said.

 

Pyongyang’s 17th missile test so far this year comes as US President Joe Biden left Japan to return to Washington, after a five-day trip to Asia. Before departing, Biden and his “Quad” colleagues issued a joint statement about their role in the future of the region dubbed by the US the “Indo-Pacific.”

 

“We reaffirm our commitment to the complete denuclearization of the Korean Peninsula, consistent with United Nations Security Council Resolutions,” said the statement signed by Biden, Japanese Prime Minister Fumio Kishida, Indian PM Narendra Modi, and Australia’s newly elected PM Anthony Albanese.

 

“We also condemn North Korea’s destabilizing ballistic missile development and launches, including multiple intercontinental ballistic missile tests, in violation of UNSCRs, and call on the international community to fully implement these resolutions. We urge North Korea to abide by all of its obligations under the UNSCRs, refrain from provocations, and engage in substantive dialogue,” the Quad added.

 

The White House had warned North Korea might carry out a missile test during or after Biden’s visit to the region. The government in Seoul also announced it had developed a plan in case Pyongyang carried out a nuclear test.

 

North Korea is currently dealing with an outbreak of Covid-19, with the military brought in to help deal with the situation.

 

The partition of the Korean peninsula after its liberation from Japan triggered a war between the Communist North and the US-backed South in 1950. The conflict expanded to drag in the US and China, until it was frozen by a 1953 armistice.

US to End Russia’s Ability to Pay International Investors

 

The United States will close the last avenue for Russia to pay its billions in debt back to international investors on Wednesday, making a Russian default on its debts for the first time since the Bolshevik Revolution all but inevitable.

 

The Treasury Department said in a notification that does not plan to renew the license to allow Russia to keep paying its debt-holders through American banks.

 

Since the first rounds of sanctions, the Treasury Department has given banks a license to process any bond payments from Russia. That window expires at midnight May 25.

 

There had already been signs that the Biden administration was unwilling to extend the deadline. At a press conference heading into the Group of Seven finance minister meetings in Koenigswinter, Germany, last week, Treasury Secretary Janet Yellen said the window existed “to allow a period of time for an orderly transition to take place, and for investors to be able to sell securities.”

 

“The expectation was that it was time-limited,” Yellen said.
