Maybe most of the jury members will not vote for conviction. But there's got to be a few jurors who will vote guilty and stand firm. That would result in a 'hung' jury. Then what? Could Durham then move for a new trial with a change of venue out of DC?

But I can see your thinking. So he doesn't get a conviction in the specific case of lying to the FBI on Sussman. Maybe he has entered enough evidence in the court record to use when he makes his RICO indictments.
