PROVO — A Provo man was arrested earlier this week on several rape chargesstemming from incidents in the 1990s.David Hamblinis being charged with12 counts of rape of a child, three counts of sodomy of a child, one count of attempted sodomy of a child, all first-degree felonies, and two counts of aggravated sexual abuse of a child, a second-degree felony.

 

The charges are based on events that reportedly happenedbetween 1991 and 1998. In Utah there is no statute of limitations for child sex crimes, meaning they can be prosecuted regardless of how much time has passed…

 

The accuser … is still afraid for her life because Hamblin threatened to kill her and several of her family members if she ever told anyone about the abuse. …The accuser said the abuse took place from the time she was 5 years old until she was 13.

 

In an eight-page affidavit the accuser describes in graphic detail multiple incidents when she was raped by Hamblin, as well as the ways he allegedly threatened to kill her. All of the alleged crimes took place in Provo. …

"An elected sheriff and his people are collaborating with a convicted sex offender, a person I'm prosecuting for rape," said County Attorney David Leavitt on Friday. "They're working together to discredit me."

 

Leavitt's latest comments in a 2News interview followed his statements made Wednesday that Utah County Sheriff Mike Smith "recycled a report" in an investigation into old,"laughable" and debunked claims that Leavitt and his wife were linked to a "murder" and "cannibalism" case.

 

Leavitt called Smith a "QAnon cop,"and the county attorney said he's being targeted because he's been a "check" on police power, and has pushed taking cases to trial instead of reaching plea deals.

 

Even more strange is the alleged role of Arthur Knight, whom Leavitt said is also known as Nicholas Rossi.

 

Utah County prosecutors charged Rossi in 2020 with a rape that occurred 14 years ago in Orem. The probable cause statement said a rape test kit showed DNA swabs matched Rossi.

 

On Friday,Arthur Knight — who said he lives in Scotland — held a Zoom news conference with Utah media.

 

Knight claimed he is not Rossi, has never been to the United States, let alone Utah, and is fighting extradition here on the rape charge — but seemed to have keen interest in the Utah County Attorney's race.

 

"Mr. Leavitt has continued to victimize me," said Rossi, who spoke through an oxygen mask, which his wife said he needs after a bout of COVID-19. He accused Leavitt of "building a wall of bricks made of lies."

 

Knight has been a prolific user of Twitter, with numerous posts critical of Leavitt and a website that also delved into the county attorney.

 

2News reached out to Utah County Sheriff's Office on Leavitt's allegation that it's in league with Rossi/Knight.

 

"We are not collaborating with, nor does Nicholas Rossi/Arthur Knight have anything to do with this investigation," it responded. Earlier this week, the sheriff's office revealed the investigation is looking into ritualistic sex abuse.

 

As if the circumstances could not be more unusual, ‘’’Leavitt said an attorney he forced to resign from the Utah County Attorney's Office for taking Jazz tickets from a defense lawyer now "represents Nicholas Rossi’’’ as his defense attorney."

 

Jeff Gray, who is running against Leavitt in the GOP primary on June 28, said Knight contacted him several weeks ago to help in his campaign.

 

"I couldn't understand a word he was saying," Gray said, adding he thinks Sheriff Smith is "an outstanding guy" who "didn't divulge any details that involved David Leavitt."

When Utah County Attorney David Leavitt decided to go to Ukraine earlier this week to collect documents from his Kyiv apartment, he’d planned for several contingencies in case the city was invaded by the Russian military.

 

He had extra cash in case the internet went down and the ATMs didn’t work. He’d also rented a car, deciding it safest to not rely on public transportation in case the trains stopped running.

 

But something unexpected happened that halted what was supposed to be aquick trip to Ukraine to gather a few personal items: Leavitt is stuck in Amsterdam after he tested positive for COVID-19.

 

It’s the second time Leavitt has been ill with the coronavirus.

 

Leavitt, who taught in Ukraine with the American Bar Association for more than a decade,has owned an apartment in Kyiv for several years. With news of a threat of a Russian invasion, Leavitt said in an interview on Wednesday that he’d booked the hasty trip to Ukraine to get paperworkproving ownership of his apartment and to collect some personal effects.

 

“We flew from Salt Lake to Amsterdam and Amsterdam to Kiev,” he said Wednesday, “and spent 24 hours there andgot things taken care of then visited with some close friends of ours.”

 

The capital city felt different than previous visits, Leavitt said of landing in Kyiv. He added that Ukrainian friends seemed nervous.

“It felt like there was a tension,” he said. “A feeling of foreboding. It’s right at the front of everyone’s minds. It’s a sad feeling.”

 

“There has been so much troop movement recently,” he said. “[Russian President Vladimir] Putin’s tanks have a far easier time going over frozen ground than muddy ground. That’s not something we think of as Americans.”

 

Thecounty attorneysaid hedecided to go to Ukraineafter seeing news that the American Embassy was evacuating families and personnel and that The Church of Jesus Christ of Latter-day Saints had moved its missionaries out of the country. He expedited a previously planned trip because he felt he had a window of time where he couldgo with his sons to collect what they needed from the Kyiv apartment.

 

The U.S. Embassy issued an alert on Wednesday urging Americans to leave Ukraine as soon as possible, saying “the security situation in Ukraine continues to be unpredictable due to the increased threat of Russian military action.” It further noted the situation could “deteriorate with little notice.”

Leavitt first left Utah on Sunday, flew back out of Ukraine on Tuesday and received a positive COVID-19 test result early Wednesday while in Amsterdam en route back to Salt Lake City.

He’s now quarantining in a hotel room near the airport in Amsterdam, but says he’s not sure how long he will be required to stay there.

“Thankfully they have a bathrobe,” he said Wednesday. “BecauseI literally went with the clothes on my back. And so now my clothes are drip-drying from my hotel room sink.”

During his years teaching in Ukraine, Leavitt said he instructed law students about the principles of American jury trials. The county attorney said it was the Ukrainian law students’ confusion over how plea deals could work in the United States that made him realize the shortcomings of the criminal justice system. He is now outspoken about wanting reform.

“So much of what I do in the United States, as the Utah County Attorney, is directly tied to years in the Ukraine,” he said. “I’m sad about it, because I not only love the Ukranian people, I have worked hard to help the legal system.”
