“But Leavitt’s statements about the dismissal don’t quite line up with what attorneys said in court.
“’The allegations are some of theworst allegations of sexual abusethat I’ve come across in the many years that I’ve been prosecuting these types of cases’ [prosecutor] Sturgill said during a hearing in May 2013.
“… the defense attorney … also discussed the seriousness of the case and the need for a thorough investigation. …
“During a hearing in March 2014, Sturgill moved to dismiss the charges,with a plan to possibly refile the case in the future.
“Neither attorney shared concerns during the hearing that the allegations were outlandish or unbelievable. Instead, they pointed to the several-years delay in reporting by the alleged victim, and difficulty in obtaining records.”

PROVO — A Provo man was arrested earlier this week on several rape chargesstemming from incidents in the 1990s.David Hamblinis being charged with12 counts of rape of a child, three counts of sodomy of a child, one count of attempted sodomy of a child, all first-degree felonies, and two counts of aggravated sexual abuse of a child, a second-degree felony.
The charges are based on events that reportedly happenedbetween 1991 and 1998. In Utah there is no statute of limitations for child sex crimes, meaning they can be prosecuted regardless of how much time has passed…
The accuser … is still afraid for her life because Hamblin threatened to kill her and several of her family members if she ever told anyone about the abuse. …The accuser said the abuse took place from the time she was 5 years old until she was 13.
In an eight-page affidavit the accuser describes in graphic detail multiple incidents when she was raped by Hamblin, as well as the ways he allegedly threatened to kill her. All of the alleged crimes took place in Provo. …

David Hamblin’s peyote defense lawyer also unsuccessfully defended a woman convicted of killing her adopted 4 year old daughter through “forced water intoxication, which caused her brain to swell and the sodium in her body to drop to fatal levels.”
"Maybe she's too honest for her own good," her lawyer, Michael Esplin, said after the verdict.
