Whatever he says can't be used in a criminal case against him... but if the DOJ already has that evidence, his testimony doesn't prevent them from using the evidence they obtained elsewhere.

An analogy: Cops raid an apartment w/o a warrant; Judge tosses the evidence. Cops find the same evidence of guilt from another source. Admissible.
