Luttig is called a 'conservative judge' - pretty sure he's deep DeeP state. His seat as a circuit court of appeals judge was created 104 Statute 5089 - which added a bunch of circuit court justice seats during the Bush era.

Luttig was nominated April 23, 1991, by President George H.W. Bush to the U.S. Court of Appeals for the Fourth Circuit, a new seat created by 104 Statute 5089. He was confirmed by the Senate on July 26, 1991, and received commission on August 2, 1991. [3]

Then he left the circuit court to join Boeing (also from Sourcewatch):

"…announced May 10, 2006, that he is resigning immediately to be senior vice president and general counsel of the Chicago-based Boeing Company. [1]"

 

Then, just prior to the 2020 election in Dec. 2019 (and just in time to 'advise' Pence), he resigned from Boeing:

The Boeing Company (NYSE: BA) announced today that J. Michael Luttig, 65, valued Counselor and Senior Advisor to the Boeing Board of Directors, has informed the Board of his long-considered retirement at year end.
