Supreme Court Issues Ruling, Gutting Miranda Rights And Threatening The Fifth Amendment

 

On Thursday, the Supreme Court issued a ruling in Vega V Tekoh, a case involving the administration of Miranda rights, with the court ruling that a suspect’s words or statements can be used in court regardless of their Miranda rights.

 

For background, these are the facts of the case in question:

 

Terence Tekoh worked as a patient transporter in a hospital in Los Angeles. After a patient accused him of sexual assault, hospital staff reported the allegation to the Los Angeles Sheriff’s Department. Deputy Carlos Vega went to the hospital to ask Tekoh questions and take Tekoh’s statement. Although the parties described vastly different accounts of the nature of the interaction between Tekoh and Vega, it is undisputed that Vega did not advise Tekoh of his Miranda rights before questioning him or taking his statement.

 

Tekoh was arrested and charged in California state court, but a jury returned a verdict of not guilty. Following the acquittal on the criminal charge, Tekoh sued Vega, alleging that Vega violated Tekoh’s Fifth Amendment right against self-incrimination by taking his statement without first advising him of his Miranda rights.

 

Justice Samuel Alito issued his ruling, a count of 6-3, deciding that using such statements outside of Miranda rights is not a violation of a defendant’s rights and does not give them the right to sue the court for such use.

 

Miranda prescribed a specific and protective set of warnings to ensure that criminally accused suspects were made aware of the Fifth Amendment’s decree that no person “shall be compelled in any criminal case to be a witness against himself.”

 

Miranda is also one of the court’s most culturally famous decisions. Americans know Miranda. More accurately: Americans know their Miranda warnings. Even if they cannot recite the lyrics to the national anthem or the Pledge of Allegiance, they likely can recite Miranda’s warnings:

 

You have the right to remain silent;

Anything you say can and will be used against you in a court of law;

You have the right to a lawyer;

If you cannot afford a lawyer, one will be appointed for you.

 

Generally, if the police obtain a suspect’s statement violating Miranda, the government cannot use that statement against the defendant in court.

 

But can the defendant later sue the police for violating the defendant’s constitutional rights?

 

The Supreme Court now says, No.

Biden's "Gas Tax Holiday" Would Actually Push Pump Prices Higher

 

While we know that Biden's proposed gas tax holiday is dead on arrival, and thus just another waste of time by the administration whose hot air emissions have singlehandedly raised global temperature by at least one degree, we would be remiss if we didn't point out just how stupid this latest suggestion truly was.

 

According to JPMorgan analyst, the Biden's admin's intervention to artificially lower gasoline prices would remove some of the incentive to curb consumption and would in fact push pump prices higher as artificially lower prices would encourage people to drive more.

 

Instead, long-term price relief can only be achieved when insufficient refining capacity and other supply-side issues are addressed or when demand declines significantly (i.e., Biden pushes the US economy into a recession). Indeed, as we discussed last night, proposed solutions under discussion include cutting fuel taxes, changing blending requirements, and capping fuel exports.

 

Before we get into the details, a quick anecdote on just how much Biden's tax holiday would "save"

 

The latest measure under consideration is a temporary halt in the federal gas tax—a key source of funding for federal roads and bridges—that could lower prices at the pump by 18.4 cents per gallon (the 18.4 cents per gallon comes from 18.3 cents in excise tax plus 0.1 cent in a storage fee). The national average price for a gallon was $4.955 per gallon on Tuesday, according to AAA. A gas tax holiday would require congressional action, putting the decision in the hands of an equally divided Senate. How much would the tax holiday benefit an average American driver? If the federal gas tax was suspended for the rest of the summer, someone who drives 12,000 miles a year in a car that averages 22.8 miles per gallon would only save about $20.

 

So yeah, don't spend it all at once.

“Only on the basis of honest and mutually beneficial cooperation is it possible to find a way out of this crisis situation that has gripped the global economy due to the thoughtless and selfish actions of certain states,” Putin said.

 

The Russian leader stressed that today, as never before, the leadership of the BRICS countries is needed in order to develop a unifying policy for the shaping of a truly multipolar system of intergovernmental relations, and that it ought to be based on the universally recognized norms of international law and the key principles of the UN Charter.

 

According to Putin, the BRICS states (Brazil, Russia, India, China and South Africa) have a truly enormous political, economic, scientific, technological and human potential. Their influence on the global arena is increasing with every year, he pointed out.

"Shockingly Predatory": Prosecutors Want 30-55 Years For Ghislaine As Her Lawyers Try To Halt Victim Testimony

 

Convicted sex trafficker Ghislaine Maxwell should spend between 30 and 55 years in prison, after serving as dead pedophile Jeffrey Epstein's fixer and partner in crime.

 

The 60-year-old disgraced socialite was convicted in December on five charges, including recruiting, grooming, and sex trafficking girls - some as young as 14, between 1994 and 2004, for Epstein and associates to abuse.

 

Prosecutors called Maxwell's conduct "shockingly predatory," according to Reuters, citing a sentencing memorandum filed in Manhattan federal court on Wednesday.

 

"Her practice of targeting vulnerable victims reflects her view that struggling young girls could be treated like disposable objects," they added.

 

Maxwell will be sentenced on Tuesday, June 28 by Circuit Judge Alison Nathan.

 

Maxwell's lawyers have asked for less than the 20-year sentence recommended by probation officers, and no more than 5-1/4 years - arguing that she's being scapegoated for Epstein's crimes, and has already spent quite a long time behind bars.

 

Prosecutors said Maxwell's reports of poor confinement conditions at Brooklyn's Metropolitan Detention Center were no reason for a lighter sentence.

 

"Going from being waited on hand and foot to incarceration is undoubtedly a shocking and unpleasant experience," they wrote. -Reuters

 

Maxwell's legal team is also trying to bar two alleged victims from giving impact statements at the sentencing.

 

Epstein accusers Sarah Ransome and Elizabeth Stein were not called to testify during Maxwell's trial last year, however sentencing hearings allow for a wider pool of alleged victims to speak in order to help judges make their sentencing decisions.

 

In a Tuesday court filing, an attorney representing both women, Robert Lewis, requested that his clients be able to speak at Maxwell's sentencing as "victims of the sex trafficking perpetrated by Jeffrey Epstein" and Maxwell.

The motion in support of Kiev’s bid preceded the European Council summit, where EU leaders are expected to make the decision

 

A large majority of MEPs have supported granting Ukraine, Moldova and Georgia EU candidate status. The vote came ahead of the European Council summit later on Thursday and Friday, which is expected to decide whether to accept the three EU hopefuls’ bids.

 

Some 529 members of the European parliament voted for the adoption of the resolution, 45 against, with 14 others abstaining during the vote on Thursday.

New Bill Would Punish Doctors Who Point Out Scientific Facts Challenging Established Narrative

 

(Aaron Kheriaty, Brownstone Institute) — I will be heading to Sacramento next Monday to testify at a Senate committee hearing on California Assembly Bill 2098. The bill, sponsored by Senator Pan—who has been in Pharma’s back pocket for years and the source of much legislative health policy mischief in my home state—would give the medical board the authority to punish any physicians who challenge the safety and efficacy of covid vaccines.

 

This bill is advanced even as evidence continues to emerge of safety problems with the mRNA shots, including a study this week showing the vaccines lower sperm counts in men.

 

But this proposed measure seeks to enshrine in law “scientific” conclusions which are highly dubious:

 

All three of these statements are demonstrably false:

 

(a) The death count figures cited are grossly overestimated by hospitals failing to distinguish dying from covid vs. dying with covid and the financial incentives from the Centers for Medicare and Medicaid Services (CMS) to overestimate covid deaths;

 

(b) the efficacy of vaccines has declined with time and new variants, so the statistic cited here is no longer true of the vaccines against omicron;

 

(c) the CDC has consistently failed to follow-up on serious safety signals, apart from myocarditis, and the post-marketing surveillance data acquired from our FOIA request showed serious safety issues in the first three months of vaccine rollout.

 

If this bill passes, any physician who raises these or other inconvenient scientific facts or study findings could be disciplined by the medical board, as the text of the bill explains:

 

“It shall constitute unprofessional conduct for a physician and surgeon to disseminate misinformation or disinformation related to COVID-19, including false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines.”

 

The supposed scientific “facts” mentioned in the bill make it clear just what information will be considered “misinformation” under this law. This bill will spell the end of scientific integrity and medical freedom in California. I worry that if it passes, other states could follow suit. As I have said before, California is the tip of the spear.

The disgraced ex-congressman-turned-convicted sex offender has returned to the social media site that set the stage for his sex selfie-fueled downfall more than a decade ago.

 

The 57-year-old tweeted on Wednesday for the first time in nine years, asking for tips on making a social media comeback from followers — who solidly agreed that he should just stay away.

 

“Advice for returning to Twitter,” Weiner tweeted, along with the social media sites’ poll button feature.

 

The poll choices included: “Update your bio then run,” “Act like nothing happened” and “Just don’t.”

 

Though the competition was stiff, “Just don’t” was the clear winner, rising to the top of the poll as the choice of 62% of respondents.

 

People also gave the deflated congressman a hard time in the comment section under the post, with some offering sage words of wisdom such as, “keep your DM’s off. Permanently.”

 

Others were quick to remind Weiner — who resigned from Congress in June 2011 after sending a lewd photo of himself to a young woman — of his social media-challenged past.

 

Users roasted him with comments such as, “Lolita Express much?” and “Is this how pedophiles talk to each other?”

 

Weiner was sentenced to nearly two years in prison in September 2017 for sexting with a 15-year-old girl from North Carolina — the last straw for his long-suffering wife, Huma Abedin, former vice chair Hillary Clinton’s presidential campaign.

 

Weiner sent the teen “adult pornography” and repeatedly convinced her to strip naked and fondle herself while he watched via Skype and Snapchat in February and March 2016, federal authorities said.

 

The incident came after Weiner sent a crotch shot to a woman while lying next to his young son, and the image was made public in August 2016.

 

He had previously admitted to sexting at least three women in 2013 after he resigned from Congress.

‘I was raped’: Boy band members allege abuse, exploitation in disturbing doc

 

Before Ricky Martin was “Livin’ La Vida Loca,” members of his former boy band Menudo — one of the biggest Latin groups of all time — were living a nightmare.

 

In a new documentary, Angelo Garcia — who joined Menudo just after he had turned 11 — said he was raped during his 1988-90 stint with the quintet. He details the sexual assault — which he said took place in his hotel room after he was given alcohol by an undisclosed man — in “Menudo: Forever Young,” a four-part docuseries that premieres on HBO Max Thursday.

 

“All I remember was that I, like, passed out. When I woke up, I was naked and I was bleeding, so I knew that I had been penetrated,” Garcia said in the documentary. “I had, like, these burn marks on my face from the rug … I was very confused and I didn’t understand.”

 

That wasn’t the only time Garcia said he was molested during his tenure with the group. “During my time in Menudo, I was raped a series of times, and that was the way that predators would take advantage of me,” he said in the documentary.

 

Other members of Menudo — which featured 32 different boys during its initial 20-year run — also claimed they endured sexual abuse, as well as bullying, drug scandals and oppressive working conditions in “Forever Young.” Such negligence and exploitation, they said, took place while they worked for the boy band’s mastermind, Edgardo Díaz, who is described as “their manager, producer and father surrogate.” (Díaz, who did not respond to requests for an interview or comment on the allegations in the documentary, has always denied any abuse and any wrongdoing in his management of the group.)

 

“We were pawns of his business,” said Ray Acevedo, who was in Menudo from 1985 to 1988.

 

“Forever Young” recounts how Díaz’s brainchild, Menudo, was born in Puerto Rico in 1977. Díaz adopted a “Fountain of Youth strategy” for the group, where members would be replaced once they turned 16. Parents of the boys — many of them poor — would sign over much of their parental authority to the manager.

 

After first exploding in Venezuela and going on to cause “Spanish Beatlemania” in the US, Menudo found its most famous member, Martin, in 1984. “Ricky, from the beginning, was like the golden kid,” says Acevedo.

 

But Martin — who is not interviewed in the documentary — didn’t make life so easy for other members, according to Sergio Blass, who was in Menudo from 1986 to 1990.

 

“To be with Ricky was brutal because he had seniority over me,” Blass said. “So if someone knocked on the door, I had to open it. If the phone rang, I had to pick it up. I was like his housewife.” (Representatives for Martin did not respond to The Post’s request for comment.)

 

Indeed, there was plenty of bullying in Menudo — Acevedo even recalled being held over a balcony by another member — and hazing of new guys. Without getting proper supervision and even security, the boys were also exposed to drugs, including marijuana and cocaine.

Inside the ‘love fest’ cult that’s allegedly infiltrated Google headquarters

 

Google has been infiltrated by a “destructive” California cult led by a “pedophilic” leader, according to a lawsuit.

 

Former Google video producer and whistleblower Kevin Lloyd is suing the technology giant, alleging that he was fired after he began complaining that his bosses at Google Developer Studio, where he worked in Mountain View, Calif., were stacking the division with members of the Fellowship of Friends.

 

Past members of the group, which was registered as a religious organization with the IRS in 1971 and is based at a sprawling compound in Northern California, have accused its longtime leader Robert Earl Burton of sexual abuse and misconduct, according to “Revelations,” a six-part podcast series on Spotify released last year. Two lawsuits related to these accusations and filed by ex-members, in 1984 and 1996, were settled out of court.

 

In the early 1970s, Burton preached that members needed to immerse themselves in high art, such as opera and literature, in order to get rid of negative thinking. He relied on “44 Angels” — who included the spirits of historical figures such as William Shakespeare, Benjamin Franklin and Italian poet Dante Alighieri — to lead him in enlightenment.

 

“[Former members] told me about these sex rituals where [the leader] would attempt to have sex with 100 followers in a day. He called them love fests,” the podcast’s investigative reporter Jennings Brown told The Post last year.

 

“There are online support groups for former Fellowship of Friends members to help them process the trauma endured during their membership, as well as problems that arise after leaving,” according to Lloyd’s lawsuit filed in California Superior Court in August.

 

According to the lawsuit, Lloyd, 34, began working for the Google Developer Studio in August 2017, hired through Advanced Systems Group, a technology support services firm which he is also suing in the same filing.

 

In his court filings, Lloyd alleges that soon after being employed, he noticed that his bosses at Google exclusively promoted members of the cult, all of whom lived in and around the group’s 1,200-acre headquarters, known as Apollo, in Oregon House, Calif., north of Sacramento. At least 12 of the 25 employees in Lloyd’s division were members of the cult, the lawsuit claims.

 

One of Lloyd’s supervisors, Peter Lubbers, is allegedly a member of the Fellowship of Friends, according to the lawsuit. On numerous occasions, Lubbers, the director of the Google Development Studio, hired his son to work as a DJ at Google corporate events; another of Lubbers’ sons was hired as a freelance video producer, while his wife was also put on the Google payroll, Lloyd’s court filings allege.

 

“Mr. Lubbers gained status and praise relative to the increase of money flowing to the Fellowship through his efforts at Google that put (and kept) other Fellowship members — directly or indirectly — on Google’s payroll,” according to the lawsuit.

Feds search home of former DOJ official Trump sought to install as AG: reports

 

Federal law enforcement this week searched the home of Jeffrey Clark, the former Department of Justice (DOJ) official accused of trying to use the agency to pursue former President Trump’s election fraud allegations, multiple news outlets reported Thursday.

 

According to The New York Times, Clark’s suburban Virginia home was searched on Wednesday, a day before the House committee investigating the Jan. 6, 2021, Capitol attack was set to hear from former DOJ officials about the internal strife in the Trump administration following the 2020 election.

 

A spokesman for the U.S. attorney’s office in D.C. did not immediately respond when asked for comment on the reports.

 

Clark was central to Trump’s pressure campaign at the DOJ and Trump even weighed installing him as attorney general, according to previously released material.

 

The mid-level attorney, who specialized in environmental law and was acting head of the department’s civil division at the time, was one of Trump’s top advocates for forwarding election fraud claims. He pushed the DOJ to send a letter to Georgia asking it to hold off on certifying its election results so the Justice Department could announce an investigation into voter fraud there.

 

That pressure campaign came to a head at a Jan. 3, 2021, meeting in which Trump told his DOJ leadership he was weighing ousting them in favor of Clark, who had for days been pushing Trump allies’ claims about voter fraud.

 

Then-acting Attorney General Jeffrey Rosen and his deputy, Richard Donoghue, were surprised to get an email from Clark prior to their White House meeting promoting “various theories that seemed to be derived from the internet,” according to Donoghue.

 

That included a theory that the Chinese government may have hacked into Dominion voting machines through a smart thermostat. He followed with a request for an intelligence community briefing on the matter along with the request to send the letter to Georgia elections officials.

"Unbalanced recovery" after the pandemic is " aggravating inequality across the world," the global growth momentum has weakened, and the economic prospects have declined, the declaration says.

 

"We urge major developed countries to adopt responsible economic policies, while managing policy spillovers, to avoid severe impacts on developing countries," BRICS leaders said, urging "multilateral financial institutions and international organizations to play a constructive role in building global consensus on economic policies and preventing systemic risks of economic disruption and financial fragmentation."

 

The five leaders underscored that the G20 "shall remain intact and respond to current global challenges."

Food security

 

The leaders pointed out that BRICS states produce about one third of all food in the world and noted the "strategic importance" of agriculture inputs, including, inter alia, fertilizers, on ensuring global food security. The document does not mention the food crisis issue directly.

Investigations continue surrounding Trump’s "fake elector scheme"

 

The FBI has seized the cell phone of Nevada Republican Party Chairman Michael McDonald, according to a local news report.

 

Local Nevada CBS station KLAS reported that sources close to the situation said warrant served to McDonald was related to the bureau’s ongoing investigation into former President Trump’s efforts to persuade states in 2020 to submit fraudulent slates of electors, in an alleged attempt to change the outcome of the presidential race that he lost.

 

Just the News on Thursday attempted by email to reach McDonald's office to confirm the report. The office had not responded before this story was posted.

 

FBI agents were unable to locate state party Secretary James DeGraffenreid, who was named in a separate search warrant related to the investigation, according to the news report.

 

In Dec. 2020 Nevada Republicans sent the National Archives a legally meritless certification of their state’s votes for Donald Trump.The Jan. 6 Committee had earlier this year subpoenaed McDonald relating to the false document.

 

President Joe Biden won Nevada’s six electoral votes by more than 2%.

VoterGA Challenges Georgia Secretary of State Raffensperger’s GOP Primary Results

 

VoterGA Challenges Raffensperger’s SOS Primary Results after 81 Counties Fail to Provide Public Election Certifications.

 

We reported in late May that no one in Georgia believed that the state’s corrupt Secretary of State Brad Raffensperger won his GOP primary.

 

Then we found that it appeared that Georgia’s voting system added thousands of votes to Raffensperger.

 

Today VoterGA announced that they were contesting the results in the recent Georgia Secretary of State primary:

 

VoterGA today announced a challenge for the Republican Secretary of State’s (SOS) race in Georgia’s May 24, 2022 primary election. All 159 counties are named as Defendants in the contest, that was filed in Spalding County by VoterGA’s co-founder Garland Favorito and attorney Todd Harding. Georgia law allows the same charge against multiple counties to be heard in the jurisdiction of one county. The contest alleges the Dominion vote count for the Secretary of State (SOS) race is not accurate and that incumbent SOS, Brad Raffensperger, certified unlawful results when he declared himself the winner of the primary with 52% of the vote in a four-way race including Jody Hice, T.J. Hudson and David Belle Isle.

 

The contest seeks to unseal the ballots to determine the accuracy of the results and alleges that all counties violated Open Records Request (ORR) law by failing to honor Mr. Favorito’s ORR for an electronic copy of the actual ballots. Actual ballots are needed to verify election results because VoterGA found the Dominion ballot images required to produce 2020 Fulton County election results were electronically altered prior to certification. VoterGA also announced that 81 counties failed to provide correct, signed certifications for the primary, including 73 that never responded to another ORR Favorito submitted to get the public certificate.

 

The contest cites evidence collected from a VoterGA monitoring team during a June 6 Cobb Co. hand count audit. The team monitored most Election Day ballots in the Vinings 04 precinct and found Raffensperger received about 53% of the Republican Election Day SOS votes while the Dominion voting system awarded him 68.4% of those votes. Thus, the Dominion software attributed about 15% more votes to Raffensperger’s electronic totals than the actual paper ballots seem to show. Since county tabulators are prepped centrally under the jurisdiction of the SOS office and vulnerable to a single point of attack, there is a significant risk that all tabulators statewide awarded extra votes to Raffensperger which helped him avoid an expected runoff.

 

Georgia counties have experienced several counting problems with the Dominion voting system in the 2022 primaries. An election night graphic of results originally posted by the SOS office showed Georgia’s voting system allocated 3,317 votes to a Fulton County School Board District 7 candidate who was NOT on the ballot! That same graphic showed candidate Phil Chen with zero votes at 10:12 on Election Night even though he actually received 49.7% of the vote in the race. Chen has challenged the outcome of that race.

NYC to Offer Monkeypox Vaccines

 

New York City will offer monkeypox vaccines beginning Thursday.

 

According to NBC New York, NYC represents more than 20% of all monkeypox cases in the US.

 

“The vaccines will be administered at the Chelsea Sexual Health Clinic (303 Ninth Avenue in Manhattan). The clinic will open Thursday, and will be open on Mondays, Tuesdays, Thursdays, Fridays, and Sundays from 11 a.m. to 7 p.m. moving forward.” NBC reported.

New York City will begin offering vaccination against monkeypox to at-risk groups on Thursday, as authorities scramble to contain a global outbreak.

 

As opposed to the early days of COVID, when there was no effective treatment, there are already multiple vaccines that work against the orthopoxvirus that causes the ailment.

 

Some 28 people have tested positive for the virus in the city since early May, almost all of them men who have sex with men. In total New York City represents more than 20% of all cases diagnosed nationwide.

 

The move to offer the vaccine follows similar efforts in cities like Montreal and Toronto.

 

The Health Department today announced the opening of a temporary clinic to administer the two-dose JYNNEOS vaccine to eligible people who may have had a recent exposure to monkeypox, the city announced.

 

The US Centers for Disease Control and Prevention (CDC) issued new emergency guidance on monkeypox last week about how to identify the virus.

 

The US now has 72 reported cases of monkeypox in at least 18 states, NBC reported.

 

The CDC released new guidance on Tuesday about how to identify the virus based on symptoms.

 

“Descriptions of classic monkeypox disease describe a prodrome including fever, lymphadenopathy, headache, and muscle aches followed by development of a characteristic rash culminating in firm, deep-seated, well-circumscribed and sometimes umbilicated lesions. The rash usually starts on the face or in the oral cavity and progresses through several synchronized stages on each affected area and concentrates on the face and extremities, including lesions on the palms and soles.” the CDC said in its guidance.
