The Supreme Court on Friday eliminated the constitutional right to obtain an abortion, casting aside 49 years of precedent that began with Roe v. Wade.

The decision by Justice Samuel Alito will set off a seismic shift in reproductive rights across the United States. It will allow states to ban abortion, and experts expect about half the states to do so.

 

Legal Precedent - stare decisis

a doctrine or policy of following rules or principles laid down in previous judicial decisions unless they contravene the ordinary principles of justice

 

I think something a little more seismic is tied up in the Roe v Wade decision that is not to do with abortion.

For a very long time legal system has used 'legal precedent' as a tool, and perhaps weapon. Corrupt legal system creates a series of cases each somewhat similar and increasingly more significant and then uses 'precedent' upon which to base their decision.

One initial poor decision then begets a whole chain of increasingly bad decisions.

Today I believe that the SC made the decision based on fact rather than on a decision made by someone else some time ago.

This I think is more important than the actual Roe v Wade part, the SC making a proper decision rather one based on dogma and doctrine.
