I don't think West Virginia v. EPA will be 5-4.

I think it'll be 6-3, based on Michigan v. EPA (Kagan, Ginsburg, Sotomayor, Breyer dissented).

Roberts and Alito went with the majority.

 

Thomas, Roberts, Alito, Gorsuch, Barrett, Kavanaugh

Sotomayor, Breyer, Kagan
