I don't think West Virginia v. EPA will be 5-4.
I think it'll be 6-3, based on Michigan v. EPA (Kagan, Ginsburg, Sotomayor, Breyer dissented).
Roberts and Alito went with the majority.

so if those 5 vote in favor of the plaintiffs, that leaves Justice Thomas. no way in hell he votes with the liberal justices.
