Arizona AG Mark Brnovich strikes back at DOJ over election integrity lawsuit
Arizona Attorney General Mark Brnovich’s patience appears to be wearing thin with the Biden Department of Justice following the announcement that it was suing Arizona for “restrictive voter registration requirements.”
“It’s another round of Brnovich v. Biden as his DOJ continues its attempts to undermine our election integrity laws,” Brnovich tweeted Tuesday in response to the lawsuit. “I will see you in court. Again.”

Specifically, the DOJ complaint challenges Arizona’s recently-passed House Bill 2492, which requires residents to provide “satisfactory evidence of citizenship” to be eligible to vote. The law will take effect in January.
“House Bill 2492’s onerous documentary proof of citizenship requirement for certain federal elections constitutes a textbook violation of the National Voter Registration Act,” contended Kristen Clarke, assistant attorney general for the DOJ’s Civil Rights Division, in a Tuesday press release.
“For nearly three decades, the National Voter Registration Act has helped to move states in the right direction by eliminating unnecessary requirements that have historically made it harder for eligible voters to access the registration rolls,” Clarke continued. “Arizona has passed a law that turns the clock back on progress by imposing unlawful and unnecessary requirements that would block eligible voters from the registration rolls for certain federal elections.”

In its complaint, the DOJ states that House Bill 2492 contravenes the Supreme Court’s 2013 ruling in Arizona v. Inter Tribal Council of Arizona, Inc. The ruling holds that a previous proof-of-citizenship requirement in Arizona was “pre-empted by the NVRA’s mandate that States ‘accept and use’ the Federal Form” for voter registration, which merely requires applicants to swear under penalty of perjury that they are U.S. citizens.
Following the DOJ’s announcement, Rep. Andy Biggs, R-Ariz., weighed in on the matter via Twitter, writing: “DOJ doesn’t think you should prove that you’re an American to vote in an American election. DOJ is suing Arizona over proof of citizenship requirements. Unbelievable.”
Meanwhile, Arizona gubernatorial candidate Kari Lake had a shorter response, tweeting, “F (& I cannot stress this enough) JB.”

The lawsuit comes amid growing election integrity concerns in the Grand Canyon State, where many still question the validity of the results of the 2020 presidential election.
Last month, inventor and entrepreneur Jovan Pulitzer presented additional evidence to Arizonan politicians and candidates of 2020 election fraud from a forensic analysis he conducted into the paper ballots used in the Maricopa County election.
“There is sufficient and irrefutable evidence of pervasive voter fraud and widespread election fraud in Maricopa County, Arizona,” Pulitzer said at the June 27 event, at which he announced his finding that President Donald Trump, not Joe Biden, won Maricopa County with 59 percent of the vote.
As evidence continues to surface challenging the prevailing narrative of what happened on Nov. 3, 2020, voters in Arizona and around the country will undoubtedly be watching closely to see how the court rules on election integrity laws like House Bill 2492.

Good Government Groups Ask State Officials To Stop Biden’s Federal Takeover Of Elections
Governors and other state officials don’t have to stand idly by as the Biden administration plots a federal takeover of elections. That’s the message being sent by the heads of two good government groups in a new memo to state officials.
“The Biden administration wants to use federal government resources for political, get-out-the-vote purposes, and it’s up to strong leaders in state and local government to stop them,” wrote Russ Vought of the Center for Renewing America and Tarren Bragdon of the Foundation for Government Accountability. “We strongly urge those in positions of power to stop President Biden’s power grab and act soon.”
Biden issued an executive order on March 7, 2021, directing all 600 federal agencies to submit a plan to the White House to increase voter registration and turnout. Many agencies subsequently developed a plan to turn federal facilities, particularly those that deliver federal benefits, into voter registration agencies.
For example, Housing and Urban Development is trying to turn assisted housing centers into get-out-the-vote hubs. Health and Human Services is doing the same with its public health centers. Even as labor problems are out of control, the Department of Labor is turning its American Job Centers into voter registration agencies.
The agencies are allowed to work with voting groups approved by left-wing partisans in the White House, reminiscent of the Zuckerbucks plot to destabilize the 2020 election by running get-out-the-vote operations in the Democrat areas of swing states.
It’s a “backdoor approach that’s designed to ensure Democratic victories at the polls in 2022 and beyond,” Vought and Bragdon wrote.
The two recommend that state officials take action to prevent Biden’s plot. Since the National Voting Rights Act provides states the authority to designate voter registration agencies beyond those already required by federal law, the federal government cannot designate additional agencies without a change to federal law enacted by Congress.
So when federal agencies send “guidance” memorandums to state agencies about turning federal benefit centers into voter registration agencies, Vought and Bragdon recommend state officials contact those agencies and “order them not to implement that guidance because it is illegal at worst and unethical and partisan at best.”
Further, they remind states that they can issue a gubernatorial executive order or the legislature can pass a law or resolution prohibiting state agencies from applying to become voter registration agencies.
“With increasing brazenness, President Biden is taking advantage of a loyal federal bureaucracy to wield the power and influence of the federal government to influence elections by increasing Democratic voter registration and turnout,” write Bragdon and Vought. They say the actions are particularly troubling given recent lawsuits filed by the Department of Justice against conservative efforts to fortify election integrity and make it more difficult to cheat.

Biden’s Swamp Brings Back ‘Sue And Settle’ To Hide Behind Courts As It Stomps Out Fossil Fuels
The case, led by 10 environmental groups, includes all the trademarks of a ‘sue and settle’ suit.
A new lawsuit brought against the Department of the Interior last week by a series of left-wing interest groups is raising questions about the return of “sue and settle” cases as a signature feature of the Beltway swamp.
Led by the Dakota Resource Council, 10 environmental groups including the Center for Biological Diversity and the Sierra Club are suing the Interior Department, the Bureau of Land Management (BLM), and their executives to put an end to federal lease sales for oil and gas drilling on public lands. Despite an 18-month suspension in lease sales and an overhaul of the leasing program that discourages drilling, the plaintiffs allege that the federal government failed to consider the global consequences of emissions from more oil and gas extraction.
“Federal Defendants acknowledge the fundamentally incremental nature of the climate crisis and the small and shrinking window that remains to avoid the most catastrophic effects of climate change,” the legal complaint states. “Federal Defendants also admit that their Federal Oil and Gas Leasing Program contributes significantly to the global climate crisis, and that the Lease Sales at issue here will collectively cause billions of dollars in social and environmental harm to people and the planet.”
The case includes all the trademarks of a “sue and settle” suit: Friendly interest groups present a legal challenge to a federal policy with proposed changes that are endorsed by the administration, which in turn voluntarily settles and enacts the preferred policy outcome behind the cover of the courts. The allied interest groups, meanwhile, pocket a handsome payout of taxpayer dollars in the process.
Administration officials have left no room for doubt in their desire to shut down the nation’s oil and gas program, following through on a pledge from the president made repeatedly on the campaign trail to “end fossil fuels.”
“No more drilling on federal lands,” Biden said on a CNN debate stage. “No more drilling, including offshore. No ability for the oil industry to continue to drill. Period.”
Indeed, Biden ordered the suspension of lease sales for oil and gas exploration on federal lands almost immediately upon his inauguration. The suspension remained in place until a federal judge in Louisiana ordered their resumption. The Biden administration, however, has dragged its feet on new sales while pledging to resist compliance, with White House climate adviser Gina McCarthy saying on MSNBC that “President Biden remains absolutely committed to not moving forward with additional drilling on public lands.”
Gary Lawkowski, an attorney at the Dhillon Law Group who specializes in administrative law and used to serve at the Department of the Interior, told The Federalist that while it was “too soon to say definitively” the current lawsuit brought by the Dakota Resource Council fit the exact criteria of a “sue and settle” case. The filing possesses “all the hallmarks of being one that would be hard to challenge a settlement in.”
The Trump administration tried to put an end to the practice in 2018 when the Interior Department established an online database to make the details of administrative settlements publicly accessible. According to the order, the department entered into more than 460 settlement agreements and consent decrees between Jan. 1, 2012, and Jan. 19, 2017, dishing out more than $4.4 billion in taxpayer dollars, more than a third of which was paid in the final year of the Obama White House.
Last month, however, Biden Interior Secretary Deb Haaland revoked her predecessor’s order and scrubbed the administrative website that placed settlements and consent decrees in the public eye.While the department “is committed to fair, transparent, and efficient resolution of all claims brought against it,” Haaland wrote, she said the requirements under the previous order presented “limitations” that “are burdensome, duplicative, and hinder the effective resolution of complex litigation matters.”
Biden’s Environmental Protection Agency also revoked a 2017 memo from former Administrator Scott Pruitt demonizing the “sue and settle” practice as a tactic that “undermines the fundamental principles of government.”
“The days of this regulation through litigation are terminated,” Pruitt wrote, only for them to return after the 2020 election.
Pete McGinnis of the Functional Government Initiative told The Federalist that the current suit before the Department of the Interior and the BLM was a prime example of “sue and settle” back in action.
“Last month, Interior rolled back the public webpage that provided transparency on these precise types of lawsuits,” McGinnis said. “With record gas prices and administration officials in full panic attempting to show the public they are doing something about it, the timing of this suit appears to seek the exact goals of Secretary Haaland and President Biden but without having to put their name on it.”
“And they won’t even have to tell the public about their settlement if it gets to that point,” McGinnis added.
