This means all Agencies that received the authority of congress, such as the SEC did not (remember 5th circuit said SEC was an unconstitutional agencies and could not fine as it violates the constitution), that means the administrative state created by all these agencies, could be & should be in the chopping block. SEC has no right to fine a company, so FDA and CDC can certainly be included. Please God give the court the power and wisdom to destroy them all.
This btw isone of Gorsuch’s pet pieves, he doesnt like the administative state because the court can only interpret the laws congress made for them, they cannot change the definition of the law. This came up in his hearings.
He said, “if you dont like the courts rulings, change the law”! But congress can not really transfer their powers.
OSHA should be on the list too along with many others, such as the IRS. If theSEC is not empowered to fine(only one of the three branches of government can) the IRS should not have that weapon either.
