Twitter is planning to take Elon Musk to court in an attempt to close a takeover deal.
The Tesla CEO recently announced he's withdrawing his $44 billion takeover bid for the social media site.
Mr Musk claims Twitter was deceitful and failed to provide data on how many of its users were made up of fake accounts.
Twitter responded, saying they provided the billionaire with the information requested, which revealed spam accounts make up less than five per cent of its monetiseable daily active users.
“The Twitter board, which I think is going to go down in history as being one of the most incompetent corporate boards ever assembled, they couldn’t run a lemonade stand,” Circle Squared Alternative CIO Jeff Sica said.
“What I believe is going to happen is they’re going to do this masquerade of saying they’re going to sue to get Elon Musk to follow through with his original offer. They are going to fail.”

A new poll suggests Democratic voters are "having some regrets" electing Joe Biden into the Oval Office, according to United States Studies Centre's Brendon O'Connor.
A new New York Times/Siena College poll has found almost two-thirds of Democratic voters don't want to see US President Joe Biden run for re-election in 2024.
Democrats cite Biden's age and performance in the job as the main reasons.
Mr O'Connor told Sky News Australia Joe Biden is "too old" at 79 years of age to hold the job.
"There's a sense that it doesn't suggest the kind of vitality, that Biden's better days were when he was vice-president or a senator 20 years ago and they're not now," he said.
"So, he was very much a compromised candidate to take on Donald Trump – but as president maybe people are having some regrets."

Hunter Biden could be charged with federal prostitution offences after it emerged he may have transported three sex workers across state lines in 2018.
According to an exclusive report from the Daily Mail, the president's son spent $30,000 on prostitutes over a five-month period.
On one occasion in December 2018, Hunter reportedly paid the Amtrak fares for three sex workers to travel from Boston to his $700-per-night suite at the Roxy Hotel in New York in order to have sex with him.
If this is proven to be true, the president son’s may have violated the Mann Act, which prohibits transporting individuals across state lines for sex.
