Ok, so the EPA v SC, FBI and RICO

 

So the EPA v SC, what does it mean?

 

What most folks seem to believe is that this ruling prevents EPA from fomenting it's own rules regarding carbon emissions, but this is completely wrong.

 

What the Supreme Court actually said, was that subordinate agencies are limited by the powers of Congress, and they cannot go go beyond those powers.

 

WTF does that mean?

 

Well in EPA v SC, they said that EPA cannot enact rules and regulations, unless Congress specifically allowed that the EPA to do so.

 

That is to say, that if Congress does not have the power to enforce rules and regulations, then neither do the sub TLA's. That means that unless Congress specifically allowed, and legislated those powers, the TLA's cannot appropriate those powers!

 

So lets have an example:

 

FBI search powers……….

 

Does Congress have the power to search a private citizens communications?

 

If the answer is "No", then how an Congress subordinate those powers to a TLA, given it does not have those powers?

 

If Congress does not have the power to spy on an individual's communications, then how is it possible that they could delegate these powers to an TLA agency? Like the FBI?

 

The only exception is when Congress have a signed, dated, current search warrant, enacted under probable cause, by a District Court Judge……….

 

So….. Mister FBI Monitoring Agent……..

 

Do you actually have in front of you right now, a signed and sealed "probably cause" warrant from a District Court Judge?

 

Giuliani is a clever bastard, you gotta give him that…..

If Congress did not give FBI the powers to spy………….
