Danshenko case, the decision by the court of withheld classified materials by the government, June 22, 2022
Initially Danshenko defense received a “substantial summary” from Durham but not the “privileged” underlying documents that were sealed.
Danshenko’s attorneys wanted to get the classified information Durham collected, saying it would be “relevant and helpful” to the defendant’s case.
Durham actually filed the confidential docs under protective order with the court, and it was allowed. Meaning Danshenko cannot see them ever. I think it has to do with “sources and methods”, and confidential witnesses etc.
The basis of the defense’s is saying, itwould be “relevant and helpful” to have the sealed docsfor their defense and the documents were classified and sealed improperly by Durham and the court in the first place.
The court found the documents were sealed correctly as “classified”, and the “detailed summary” provided to the defense by Durham gave the defensesubstantially the ability to make their defensewithout get the “sealed classified materials”
So the defense can not get them!
This feels like a semi big win, and I think this judge is a lot more sticking by the book than the Sussmann judge. Kek
I’ve also, attached Durham requesting the court allow for 30 Subpoenas, Kash was saying, 30 subpoenas is fucking big deal!
