Luttig is called a 'conservative judge' - pretty sure he's deep DeeP state. His seat as a circuit court of appeals judge was created 104 Statute 5089 - which added a bunch of circuit court justice seats during the Bush era.

Then, just prior to the 2020 election in Dec. 2019 (and just in time to 'advise' Pence), he resigned from Boeing:
