The Supreme Court's Bruen Gun Decision Is Even Bigger Than You ThinkBY VICTORIA TAFT AUG 04, 2022 6:36 PM ET

 

Since Supreme Court Justice Clarence Thomas made crystal clear in his ruling in New York Pistol and Rifle v. Bruen that the Second Amendment is not a second-class civil right, the question becomes: how far does this decision go? After consulting several gun and constitutional lawyers, here’s the short answer: very far.

Thomas stated unequivocally that Americans’ right to carry a gun outside the home has been treated as a second-class right in modern times. Indeed, the whims of politicians have been treated with more respect than bedrock constitutional principles surrounding Americans’ right to defend themselves with guns.

Chuck Michel of the California Rifle and Pistol Association (CRPA) notified all 58 county sheriffs that the Bruen decision changed the state’s “may issue” or “good cause” to acquire a concealed gun permit. CRPA is already litigating California’s magazine limitation and “assault weapons” bans, as well as bans on certain semi-automatic weapons, age limitations on the purchase of semi-automatic guns, and so-called “large capacity” ammo magazines. And it turns out that all of those issues are impacted by the Bruen decision.

Constitutional law attorney Mike Davis, head of the Article III Project, told in the Podcastthat from now on these kinds of limitations on guns will be required to be measured by “strict scrutiny.”

“The state has the heavy burden now of determining we’re a felon, unworthy, that we have a dangerous mental illness that puts the community in danger,” he said. “Governments can still regulate guns just like they can regulate speech but it’s going to be with a more exacting standard, strict scrutiny.” And he said, so are the laws about magazine sizes, semi-automatic limits, and bans.

William Kirk of Washington Gun Law said on the Podcast that “Justice Thomas’s opinion makes it clear — there can be no debate about this – that when we are talking about these sorts of restrictive gun measures, the only analysis to use is strict scrutiny. [A]nd if that is the standard moving forward, if all the federal courts follow this very clear direction from the Supreme Court, then I don’t see how magazine bans survive. I don’t see how AR bans survive. I don’t see how many of these restrictive gun measures around the country … I don’t see how they’re going to survive constitutional scrutiny.”

Pennsylvania gun attorney Dillon Harris of the Firearms Industry Consulting Group, a division of the Civil Rights Defense Firm, indicated that all of these gun-grabbing laws are in the crosshairs. He told the Adult in the Room Podcast that previously the test to determine whether a gun law was constitutional was done under an immediate scrutiny threshold, which is a much easier test to measure government rules and regulations than strict scrutiny.

Harris says that if there was litigation in the pipeline concerning all of the gun bans, registrations, and age limitations then those cases are still “live” and will basically have to start over using the Bruendecision parameters. That’s good news for gun rights. Still, in some instances, “it may be the case that new litigation will have to be started again” depending on the jurisdiction the court is in…But, he said, “I do think we’ll use it to gain a lot of ground in states with novel and onerous [regulations].

Red flag laws will come under new scrutiny under this decision as well, predicts Harris, who says, “there are first amendment issues, second amendment issues, and fourth, fifth, and sixth amendment issues” involved in these laws.

Oregon Firearms Federation leader Kevin Starrett told PJ Media that as aresult of the Bruen decision there will be a wave of unscrupulous moves by officials trying mightily to get around it.“I think we are going to see chaos and massive disrespect for the law by elected officials. As you know, California just released all the private info of [concealed weapons permit] holders. There will be more vindictive actions like that.” Starrett believes that changes to the current gun laws will take “several years before they get to SCOTUS” but cautions that the political prosecutions and other lawlessness by the feds will get worse. “I suspect that everything we have ever assumed about our legal processes will soon be history. We are basically in a lawless phase now where leftists ignore the law and the established rules and anyone who tries to live by them could find themselves in prison.”

Do Americans have expanded gun rights? And do those rights expand to other gun control limitations? Yes, but only if judges and attorneys general don’t ignore them.

On Thursday morning, Florida Gov. Ron DeSantis drew a line in the sand, announcing that he is suspending woke Hillsborough County state attorney Andrew Warren.

 

In a news conference that aired live on Rumble, Facebook, and Twitter, Florida Gov. Ron DeSantis announced the immediate suspension of Hillsborough County state attorney Andrew Warren for consistent refusal to enforce certain laws. Accompanied by county sheriffs and law enforcement officers, DeSantis said Warren has publicly put himself above the law, citing Warren’s announcement that he would refuse to enforce any Florida laws limiting abortion in the wake of the Dobbsdecision, laws against allowing children to undergo mutilating surgeries, and a consistent record of charges not being brought in violent crime cases.

 

A few hours later, Save America JFC, a joint fundraising committee on behalf of Trump’s Save America and the Make America Great Again PAC, sent out a fundraising email with a personal note from Donald Trump, echoing DeSanitis’ call to get rid of government employees who refuse to obey the law.

 

“When I make a promise, I keep it, ” Trump wrote. “I told you I wouldDRAIN THE SWAMPand purge Washington of woke bureaucrats, and that’s exactly what Schedule F accomplishes.”

 

“I implemented Schedule F so that Presidents could have the ability to FIRE federal employees who were BYPASSING democracy for their own benefit,” he added. “These employees are doing a disservice to America and are the very Swamp creatures that we’re trying to get rid of.” [Emphasis original

 

In October 2020, Trump signed an executive order reclassifying some 50,000 “policy-determining, policy-making, or policy-advocating” jobs, removing protections that made it nearly impossible to fire them. Joe Biden rescinded the order when became president.

 

It should be noted that while Trump accomplished a great deal during his term as president — including appointing a slew of conservative judges who will alter the courts for decades to come — he wasn’t able to make much headway in draining the swamp. The executive order was a great start, but it came too late in his presidency. As a result, the FBI, the DOJ, and the U.S. military are still run by leftist ideologues who care more about appeasing the woke mob than protecting the country. And this week we learned that the IRS is stockpiling millions of rounds of ammo — and even machine guns. While Trump had the best of intentions, he ultimately wasn’t able to drain the swamp in any meaningful way before leaving office.

With DeSantis’ announcement today, he declared war on woke leftists in government who are “bypassing democracy,” to use Trump’s phrase, and is doing something about it.

 

The left started its long march through the institutions more than a half-century ago unimpeded and, for the most part, undetected by the vast majority of Americans. Trump succeeded where other Republican presidents had failed — in drawing attention to the swamp and calling out the entrenched government basement-dwellers who more often than not have more power than elected officials. DeSantis is picking up where Trump left off and taking it a step further by dismantling the swamp in Florida. Let’s hope other Republican governors have the courage to step up and drain the swamps in their own states. Trump and DeSantis are on the right track, but we’ve got a long way to go.

I'm truly sorry': Katie Hobbs issues new apology in Talonya Adams firing

Democratic candidate for governor Katie Hobbs has issued an apology and acknowledged discrimination took place in the firing of a Senate staffer years ago as her campaign faces continued criticism for its scattershot response.

 

“I recognize that my initial response fell short of taking accountability, and I know that it was for the most part unnecessarily defensive,” Hobbs said in an exclusive phone interview with The Arizona Republic on Wednesday, hours after releasing a public apology video on her campaign Twitter.

 

In the video, Hobbs, who now serves as secretary of state, acknowledges the "discrimination that Talonya Adams faced as an employee in the Legislature."

 

"Please allow me to say this clearly and unequivocally: I apologize to Ms. Adams," Hobbs said. "I’m truly sorry for the real harm that I caused Ms. Adams and her family. My response to the jury verdict was short-sighted, unnecessarily defensive and failed to meet the moment."

 

Adams was fired from her job as a Democratic Senate aide in 2015, when Hobbs was the Senate Democratic leader. Adams filed a discrimination lawsuit, winning jury verdicts that found she was discriminated against on the job and was retaliated against when she was fired.

 

The most recent verdict, handed down by a federal jury Nov. 10, has damaged Hobbs' campaign for governor, with Black community leaders and others criticizing Hobbs' initial response, which shifted blame to Republicans who control the Legislature and did not acknowledge discrimination took place…

Children among injured after shelling of Donetsk hospital – DPR

 

Several civilians, including children, were injured in the incident, officials said

A Ukrainian artillery attack on Dontesk has left at least one person dead and several others injured, officials in the Donetsk People’s Republic (DPR) said. One of the buildings targeted on Friday was a hospital. Ten people, including children, were injured DPR Deputy Information Minister Daniil Bezsonov said.

 

Two neighborhoods in Donetsk came under fire by Ukrainian forces on Friday, DPR self-defense forces reported. The damaged hospital is located in the Kuibyshev district of the city. At least one rocket made a direct hit through the roof, images from the scene suggest.

 

Local emergency services said the missile started a fire, which was quickly dealt with.

 

Bezsonov published a video on his Telegram channel, showing one of the victims, saying that she heard at least two projectiles landing nearby as she and her child were visiting the hospital. Investigators said that a second rocket landed outside the building and that the debris from the explosion hit a car and injured a man.

 

The victim added that she was with her son when the attack started. She shielded the child with her body, managing to save him from serious injury, while she was hit by flying debris.

 

Kiev denies the accusations that its forces launch daily artillery attacks on civilian targets in Donetsk. It claims the shelling is done by the DPR and Russian forces to discredit Ukrainian troops.

 

The DPR said the latest attack came from Avdeevka, a satellite city located just north of Donetsk that has become a Ukrainian stronghold. There has been intensive fighting in the area this week, with Ukrainian troops reportedly ceding territory.

US-led effort to isolate Russia failed – Bloomberg

Half of the G20 nations have not supported the sanctions

 

The US-led drive to isolate Russia through sanctions has not succeeded, as half the countries in the Group of Twenty leading global economies refused to sign on, Bloomberg reported on Friday.

 

According to the publication, senior officials from leading Western nations are surprised by the lack of support within the wider G20, despite their efforts to make the case for restrictions against Russia.

 

Argentina, Brazil, China, India, Indonesia, Mexico, Saudi Arabia, South Africa, and Turkey have not joined the sanctions that were adopted by the US, UK, EU, and their allies Australia, Canada, Japan, and South Korea. Some nations, like China and South Africa, have openly criticized the restrictions. The G20 nations account for around 85% of global economic output.

 

According to Bloomberg, the reasons for the lack of support include strong trade ties, historical affinities to Moscow, and a distrust of former colonial powers.

China cuts ties with US on critical issues

Beijing has severed communication with Washington in several areas in retaliation for Nancy Pelosi’s trip to Taiwan

China has decided to cut diplomatic ties with the US in a number of military and civilian areas, the Foreign Ministry announced on Friday. The devolvement of ties is Beijing’s way of retaliating for this week’s visit to Taiwan by Speaker of the US House of Representatives Nancy Pelosi.

 

The ministry released a list of areas in which there will no longer be communication between Chinese and American officials. It includes military contacts on the level of theater commander and wider defense policy coordination talks. Also suspended are consultations on maritime security, cooperation on the repatriation of illegal migrants, legal assistance on criminal matters, fighting against transnational crime and drug trafficking, and talks on climate change, according to the statement.

 

Earlier on Friday, the Chinese Foreign Ministry announced personal sanctions on Pelosi and her immediate family members.

 

Pelosi visited Taiwan this week despite repeated objections from Beijing. The self-governed island is claimed as part of China, with the US formally acknowledging the One-China policy since the 1970s.

 

Washington maintained informal ties with Taipei even after switching diplomatic recognition to Beijing. Over the past several years, subsequent American administrations have increasingly treated Taiwan’s government as representing a sovereign nation. Beijing says Washington is deliberately undermining the status quo and encouraging separatism in Taiwan.

 

While the White House tried to distance itself from Pelosi, claiming it was her independent decision to visit Taiwan, officials in Beijing took it as part of a perceived policy to undermine its claim, and threatened consequences.

 

China’s People’s Liberation Army launched major exercises around the island, which Chinese media described as a rehearsal of a full blockade. Beijing also introduced trade restrictions on Taiwan.

Zelensky angered by lack of help from EU

Withholding €8 billion in financial aid is either “a crime or a mistake” by Brussels, the Ukrainian leader says

 

Ukrainian President Vladimir Zelensky has lashed out at the EU, accusing the bloc of deliberately withholding €8 billion ($8.18 billion) in aid promised to his country amid the conflict with Russia.

 

“Every day and in different ways, I remind some EU leaders that Ukrainian pensioners, our displaced persons, our teachers and other people, who depend on payments from the budget shouldn’t be hostages of their indecision or bureaucracy,” Zelensky said in a video address on Telegram on Thursday.

 

The EU has suspended the allocation of €8 billion, and this “artificial delay in macro-financial aid for our country is either a crime or a mistake,” he insisted.

 

The president did not name the nations responsible for withholding the money, but expressed hope that it’s only a mistake “and it will be corrected.”

 

Earlier this week, the deputy head of Zelensky’s office, Igor Zhovkva, said that Ukraine has so far received just €1 billion from Brussels, while “some EU countries, including Germany” are blocking the transfer of another €8 billion.

 

With Kiev unable to patch the holes in its budget due to the fighting and the dire economic situation, the EU promised in May to provide Ukraine with €9 billion in subsidies and low-interest loans by the end of 2022.
