UCMJ Article 23 - Who May Convene Special Courts Martial

Section (a) "Special courts-martial may be convened by–"

(1) "any person who may convene a general court-martial"

 

Article 22 Section (a)

"General courts-martial may be convened by–"

(1) "the President of the United States;"

 

Article 23 Section (b)

"If any such officer is an accuser, the court shall be convened by superior competent authority, and may in any case be convened by such authority if considered advisable by him."

 

If I'm interpreting the above correctly, most/many officers in military ~Cpt or above can convene/initiate special courts-martial, as can POTUS.

Further, if they are the accuser they may initiate unilaterally.

 

Did something specific happen in recent past to 'trigger eligibility' for a special courts-martial to be initiated by POTUS?

Or Flynn? (I think he is also included under 23.a(1))

 

If this is in the correct vein, next Q would be what does it mean though?

Why Article 23 & not Article 22?

 

If this in not the correct vein, would FM/AR/etc other reg fit the mold?
