The NARA violations as alleged against President Trump are unconstitutional as the elements of the alleged violations do not have a SCIENTER requirement, i.e., that Trump 1) actually knew the Act's legal requirements regarding the materials in question and 2) that Trump acted with specific INTENT to violate them.
