Feds Swear Trump Investigation Was in 'EARLY STAGES' When FBI Stormed Mar-a-Lago. Oh, Really?

During the hearing to determine if any of the documents used to get a warrant to raid Donald Trump’s Mar-a-Lago home, prosecutors told the judge that the investigation was in its “early stages” and argued to keep all of their documents secret for fear of giving the former president’s lawyers a “roadmap” to their case.

 

Judge Bruce Reinhart said he was inclined to release some of the documents and gave the government one week to come up with a plan to determine which documents would be redacted, released, or remain sealed. “I’m not prepared to find the affidavit should be fully sealed,” he told attorneys for the media, Judicial Watch, and the government. Reinhart, who’d previously recused himself from another lawsuit involving Trump, said, “I find on the present record the government has not met its burden of showing the entire affidavit should remain sealed.”

 

Chalk up a temporary win for civil libertarians.

 

Still, the thought rolling around in my brain was the claim made in court that this investigation was in its “early stages.” This is a breathtaking statement. And it raises more questions than it answers. Let’s go through a few of them.

 

The attorney for the media companies arguing for unsealing the search warrant affidavit, Deanna Shulman, first mentioned the interesting “early stages” timing of the raid to reporters waiting outside the hearing at the Paul G. Rogers Federal Building in West Palm Beach. Politico noted the “early stages” comment came from the head of the Department of Justice’s (DOJ) counterintelligence division, Jay Bratt. Bratt argued to Judge Reinhart that the “open investigation” was still in its “early stages” and that to reveal any of the supporting documents at such an early stage would ” jeopardize ‘several witnesses’ whose accounts of Trump’s actions were specific enough that the sources for them might be easily identified.” That’s normally how it’s done, but it’s clear these are not normal circumstances.

 

I’m not an investigator, nor am I a cop, but I am the Adult in the Room and have been around the block reporting on court cases and investigations for longer than a cup of coffee. I can tell you that theraids usually come toward the end of an investigation. And yes, well spotted, that was a metaphorical hat trick.

 

Former federal prosecutor Andy McCarthy noted in a National Review post writtenbefore Thursday’s hearing, that service of a search warrant — a raid — usually comes late in an investigation with a perp in his PJs or ankle shackles stranded on the street for hours.

 

If it has probable cause to get a search warrant, the government nearly always has probable cause for an arrest warrant, too. In fact, quite often the same affidavit is filed to support arrest warrants and search warrants. Investigators would rather wait until the end of their probe to seek both, because investigations are best done in secrecy, without tipping off suspects while evidence is still being covertly gathered. [emphasis added]

 

These circumstances raise one question and may answer another. First, why conduct a smash and grab raid at the “early stages” when you haven’t investigated enough to know what you need to make your case?

 

This goes to another important issue. Was this why the warrant was so vague and “overly broad”? How could a warrant that had under its aegis every piece of paper ever generated during Trump’s presidency not be overly broad? “Overly broad” is a legal term of art suggesting we are veering into unconstitutional territory. That’s a Fourth Amendment no-no and it goes to the very reason why patriots escaped to the colonies and declared their independence from the Crown.

It may answer the question of why the FBI combed through Melania Trump’s under lovelies and hired a safecracker. They didn’t seem to know what they were looking for.

 

This is why it appears this was a raid in search of a crime.

 

As I wrote at PJ Media shortly after the raid:

 

The warrant demands that agents remove binders of photographs, documents with classification markings on them, and, the coups de grâce, “any physical documents with classification markings, along with anycontainers/boxes (including any other contents) in which such documents are located, as well as any other containers/boxes that are collectively stored or found together with the aforementioned documents and containers/boxes.”

 

The warrant covers any documents that Trump touched between his first day and last day in office. This included, “information, including communications in any form, regarding the retrieval, storage, or transmission of national defense information or classified material, any government and/or Presidential Records created between January 20, 2017, and January 20, 2021.”

 

Later, anti-Trump prosecutors showed atypical humility and admitted that, yes, they’d “over collected” documents such as Trump’s passports and privileged documents between Trump and his attorneys.This is no small thing. This is enough to get evidence and possibly the whole case thrown out by a judge. Fruits of the poisonous tree and all that. If agents had an appropriately tailored search warrant and had the judge bothered to look at the underlying documents, then privileged documents that were clearly out of the scope of the warrant wouldn’t have been confiscated. That is unless Trump and his attorneys were scoring crack, smoking meth, doing deals to get raw materials to make lithium batteries for the Chi-coms, and getting payoffs from the Ukrainians and Russkies. Wait, sorry, that’s Hunter Biden and The Big Guy…

 

Moving on.

 

Immediately following the raid, the media reported the Feds had hoped to keep the sacking of Mar-a-Lago under wraps, hoping no one would notice–least of all Trump since they knew he was out of town. This is important because it supports the speculation –- and educated speculation is all we’ve got on this point — that the raid was a Hoover special, vacuuming up as many documents, photos, and underpants they could in the hope that they’d find something.

 

And here are a couple more data points. Why was Monday, August 8, 2022, chosen for the raid?

 

The warrant was signed by Judge Reinhart on Friday, August 5, 2022. The FBI waited until the following Monday to execute the warrant. You might well be thinking that it takes a bit of planning to stand up a raid like this. True. You have to organize muscle, get the suits to sign on, get a babysitter, tell the spouse you’ll be late, and get the right people with the right clearances lined up to read all these evil, super-secret nuclear secrets that Trump had according to DOJ media leaks. We are also told that Attorney General Merrick Garland agonized for weeks or months over raiding a former president’s home. Well, we certainly hope so. But how long has this “early stages” investigation been going on, anyway? Law professor Margot Cleveland, writing for The Federalist,thinks it’s been at least since January, 2022. Newsweek puts the inflection point during the presidential transition in January of 2021, when a news story reported that the head of the National Archives (NARA), David S. Ferriero, noticed someone with Trump carrying a bankers box to Marine One and said, “What the hell’s in that box?’” Thereafter, he made it his mission to get the box and apparently get Trump too.

 

So what drove the timing of the raid?

 

This is another important data point. Was this an emergency? What were the exigent circumstances forcing the move on Trump? If Trump had nuclear secrets that they were afraid he’d give over to Joe Biden’s buddies in the PRC or Hillary’s Russkie spy friends who helped write her fake Steele dossier, then why wait till August to do the raid? Isn’t this an emergency?

 

Why get a search warrant on Friday and serve it on a Monday under such fraught circumstances concerning documents having to do with nuclear issues, which is what the the Washington Post reported, quoting anonymous sources from some government agency?

Conversely, why wait till 90 days before an important election that was expected to cost Democrats a chamber of Congress? That question answers itself.

 

Oh, but he held classified information,which he wasn’t supposed to have, the media argued. As we know by now, but which I will make as clear as possible – again – in a story that will go to publication within hours and that you’ll find here soon, sitting presidents can declassify at will. In the realm of declassification, nobody’s the boss of the president.

 

Furthermore, the statutes cited in the search warrant, 18 U.S.C. §§ 793, 2017, or 1591, by the Feds are chargeable because the documents are classified. It’s interesting but less germane to the real issue. The real issue appears to be the other statute the Feds included in Trump’s list of horribles and that’s obstruction of justice.

 

Let’s provide some context, as I did on PJ Media, on how other presidents and big shots have been dealt with by NARA.

 

To put it in context, the Clintons stole nearly $200,000 worth of furniture, part of which they were told to pay back. There was no FBI raid. Later, Hillary’s server was chock-full of classified information that was easily hackable by spy agencies. No raid. Then there were President Obama’s 30 million pages of “unclassified documents” that he failed to return to the National Archives (NARA), also with no FBI raid. NARA and Obama’s foundation agreed to a Memo of Understanding (MOU) promise in 2018 that the documents would be digitized and in exchange, Obama’s foundation had to pay $3.3 million to NARA to be allowed to keep the records “on loan.”

 

David Ferreira signed that Memo of Understanding with the Obama people. Understand, Obama got to keep access to the documents because his foundation paid NARA to keep them “on loan.” No one gave Obama the side-eye, much less brought a battering ram to his Chicago manse.

 

So what the DOJ wants to keep secret are the documents behind the search warrant. While it’s normal to keep these things under wraps until there’s an indictment — and there will be an indictment of Trump — these are not normal times.

 

There will be an indictment of Trump, yes; the Left will get their desired perp walk; and it will be on obstruction of justice charges because negotiators for Trump, working with NARA, didn’t fully cooperate with a crotchety librarian at the National Archives who wanted the Feds to find out what was in his box–which he got back, by the way.

 

And government lawyers swear we can’t possibly know what is in the affidavit underlying the search warrant served on a former president because the investigation is in its “early stages.” Most people think the Feds are just going through Melania’s under lovelies hoping to find a crime.

REPORT: FBI Was After Documents Trump Believed Would ‘Exonerate’ Him From Russia Conspiracy

The FBI was reportedly seeking documents President Donald Trump believed would exonerate him from Russian collusion claims and other election-related charges when agents raided his Mar-a-Lago residence, anonymous intelligence officials told Newsweek.

The FBI collected all of the documents that were government property and used concerns about classified documents to justify the raid, but agents were looking for Trump’s personal stash containing documents related to Russian collusion accusations against him, fearing that he would “weaponize” them, Newsweek reported. One former Trump official said he may have planned to use the documents to help in a presidential run in the coming term.

 

“Trump was particularly interested in matters related to the Russia hoax and the wrong-doings of the deep state,” the official told the outlet, adding that he may have intended to use the documents in a 2024 presidential campaign. “I think he felt, and I agree, that these are facts that the American people need to know.”

 

Newsweek went on (to bullshit):

 

“The sought-after documents deal with a variety of intelligence matters of interest to the former president, the officials suggest—including material that Trump apparently thought would exonerate him of any claims of Russian collusion in 2016 or any other election-related charges.”

 

Initial reports of the Mar-a-Lago raidfocused on a trove of classified documents Trump was reportedly storing at the Florida residence, including 42 boxes of classified documents that had been accidentally shipped there during his move from the White House, according to Newsweek. A report from the Washington Post also claimed the search was related to nuclear information in classified documents Trump possessed.

 

“They collected everything that rightfully belonged to the U.S. government but the true target was these documents that Trump had been collecting since early in his administration,” the source told Newsweek.

 

The Department of Justice did not respond to the Daily Caller News Foundation’s request for comment.

Student Killed In Alabama After Run-In With Individuals ‘Living Off The Grid’ In National

A University of Central Florida student was shot to death Sunday during an attempted robbery by a female suspect thought to be “living off the grid” in Talladega National Forest.

 

Adam Simjee was traveling down National Forest Road in Clay County, Alabama, with his girlfriend Mikayla Paulus when Yasmine Hider flagged down their car, according to the Orlando Sentinel. Law enforcement said that Hider asked them for help with her vehicle before holding them at gunpoint and walking them into the woods, the outlet continued.

 

Simjee and Hider exchanged gunfire after he reportedly informed her that he was also armed, the outlet continued. Both suffered gunshot wounds, the outlet noted. Simjee died, while Hider was taken to a hospital for treatment.

 

The entire situation was allegedly witnessed by another woman, later identified as Krystal Diane Pinkins, who is believed to be Hider’s accomplice, the Orlando Sentinel continued. Both Hider and Pinkins have been charged with murder, according to the Gadsden Times.

 

After police arrived on the scene, a search of the area uncovered a camp in the middle of the forest where the two women were staying, the Gadsden Times continued. Authorities were allegedly confronted at the camp by a 5-year-old child carrying a loaded shotgun.

 

Law enforcement was told that other individuals in the group were “armed and potentially violent,” the Gadsden Times continued. The discovery of the camp was handed over to the National Forest Enforcement Officers, who ensured it will be dismantled.

 

Pinkins was charged with a single count of murder and endangering the welfare of a child, and two counts of kidnapping and robbery, according to People. Hider was charged with one count of murder and two counts of kidnapping and robbery, the outlet noted.

Scarborough Accuses Fox News Of ‘Deliberately’ Inciting Harm Against IRS Agents

MSNBC’s host of “Morning Joe,” Joe Scarborough, accused Fox News of “deliberately” inciting violence against IRS agents Friday.

 

Scarborough and co-host Willie Geist were discussing the Treasury Department’s denial that it would be hiring 87,000 new IRS agents as part of the so-called Inflation Reduction Act. Geist said those claiming the IRS agents will be weaponized to target the middle class are “laying the groundwork” for “violence.”

 

Scarborough agreed, saying he’s allegedly heard talk from Republicans about the possibility of a civil war.

 

“I know this all sounds melodramatic until you have the head of the FBI saying we’re facing unprecedented threats. And people that I know, people that I’ve known my entire life are texting me and talking about replacing the U.S. government, talking about civil war. You go, ‘What’s wrong with you?’ They say, ‘The IRS agents are coming with AR-15s and they’re coming to our doors. They’re going to kill us.’ Or they’re saying, ‘The FBI is coming to raid our house and take our guns away from us.'”

 

“These are the lies that have been spread not by — this is what is so disturbing — not by back-benchers. These lies have been spread by Chuck Grassley, by Kevin McCarthy, by top news hosts at Fox News. This is not Infowars. This is mainstream, pro-Trump rhetoric. They are deliberately trying to get Americans to a position of where they’ll do harm to IRS agents.”

 

Scarborough then quoted Fox’s Brian Kilmeade, who said IRS agents are going to “hunt down and kill middle-class taxpayers” and accused such people of “deliberately trying to gin up a civil war.”

 

Scarborough had former Bush adviser Richard Haass join him Wednesday, during which Haass said the U.S. may be in the “most dangerous time” since the Civil War.

YouTube Suspends Steven Crowder’s Show Alleging ‘Misinformation’ In Kari Lake Interview

 

YouTube suspended conservative comedian Steven Crowder’s show over a now-removed interview with Republican Arizona gubernatorial candidate Kari Lake.

 

The platform said the interview violated their “misinformation policy” because of Lake’s claim that there was “widespread fraud” in the 2020 presidential election, according to Crowder’s tweet posted late Wednesday. Lake told Crowder that if she is elected, she intends to investigate the alleged voter fraud both in the last presidential election and in the gubernatorial primary she recently won.

 

“Content that advances false claims that widespread fraud, errors, or glitches changed the outcome of the U.S. 2020 presidential election is not allowed on YouTube,” the notification said.

Crowder accused YouTube of practicing “suppression of political speech” by removing the interview from the platform.

When suspended, a user is unable to upload videos or stories, host livestreams, show playlists, create community posts and navigate viewers to and from premiers, according to their policy.

23-Year-Old Dies After Allegedly Being Left Unattended In Hospital Hallway

The mother of a 23-year-old man who died at Yale-New Haven Hospital in 2021 filed a lawsuit against the institution claiming staff “untreated him to death.”

 

The man, William “Billy” Miller, was transported to Yale-New Haven Hospital’s emergency department after ingesting white powder at a gathering with friends that was suspected of being laced with fentanyl, according to the Connecticut Post. Prior to transportation, fire department personnel administered naloxone, reviving Miller to the point where he was alert, walking and talking, the outlet continued.

 

Miller was taken to the hospital so staff could monitor and prevent any type of toxicity recurrence, the CT Post noted. During transportation, Miller called his mother to explain what happened and told her that he was feeling okay, the suit states.

 

Upon arrival at the hospital at around 7:13 pm, Miller was placed on a stretcher and placed in the “ambulance bay” in the emergency department, the CT Post continued. From 7:15 pm to 1:56 am, Miller received no medical attention, with security footage showing him moving around the hospital area to use the bathroom, get a snack, make a call, before he fell asleep, the outlet described.

 

No medical staff checked on Miller after he fell asleep until one nurse stopped by at 1:56 am, the CT Post continued. The suit states that when the nurse finally checked on him, he had no pulse, his skin had turned a shade of blue-gray, and his pupils were fixed and dilated, suggesting he had been in full cardiac arrest for a currently unknown period of time, the lawsuit reportedly claims.

 

Miller’s mother and her daughter called the nursing station at Yale-New Haven Hospital numerous times and were allegedly told that Billy was doing okay, the CT Post noted. “The next morning, we called the hospital for an update but we couldn’t get any details,” Miller’s mother said, according to the outlet. “My last conversation with Billy he said everything was going to be OK and he would see me tomorrow but tomorrow has never come for us.”

‘Appalled and Disgusted’: Former Cop Arrested For Alleged Sex Crimes During His Career

 

Detectives in Hutchinson, Kansas, arrested a one-time member of their police department Wednesday afternoon for than 20 alleged crimes, many of which occurred during his time on the force, the department announced.

 

Todd Allen, 51, is reportedly charged with two dozen offenses between October 2012 and June 2022, including aggravated indecent liberties with a child and multiple counts each of rape, kidnapping, aggravated sexual battery and breach of privacy. Hutchinson Police Chief Jeff Hooper revealed that all of the alleged assaults occurred from 2012 to 2018, when Allen was a Hutchinson police officer.

 

Hooper said he took command at the police department in late 2018 and Allen, then a patrol officer, quit when they held a press conference about those incidents in November of that year. He claimed Allen worked at the department for over 20 years total.

 

“I am appalled and disgusted that somebody who is a suspect in these type of crimes and this type of behavior ever wore the uniform and this badge that I am honored to pin on my chest every day,” Hooper added. “But I’m very proud of this administration and all the men and women that diligently worked on these cases over the last decade and who today brought Mr. Allen to justice.”

Mitch McConnell Sounds The Alarm On Republicans’ Senate Chances

Senate Minority Leader Mitch McConnell expressed concern Thursday about Republicans’ ability to take back the Senate during the upcoming November midterms, as polls show GOP candidates trailing Democrats in key races.

 

“I think there’s probably a greater likelihood the House flips than the Senate. Senate races are just different, they’re statewide, candidate quality has a lot to do with the outcome,” McConnell told reporters, according to Frank Thorp V of NBC News.

 

Although redistricting is expected to net Republicans the five seats necessary to take back the House of Representatives, elections analysts have downgraded the GOP’s chances at retaking the upper chamber amid a series of weak polls and anemic fundraising numbers.

 

Republicans received good news Wednesday with the release of an Emerson College poll showing JD Vance leading Rep. Tim Ryan by three points in Ohio. Ryan has significantly out-raised Vance, both in- and out-of-state, following a bruising seven-candidate GOP primary. Previous polls had shown Ryan leading by as few as three points and as many as eleven.

 

In contrast, Cook Political Report with Amy Walter downgraded Republicans’ chances at keeping the seat currently held by retiring Pennsylvania Sen. Pat Toomey. The handicapper moved the race to “lean Democrat” after ranking Pennsylvania as a “toss-up.” Republican nominee Mehmet Oz has not lead a single poll, trailing Democratic Lt. Gov. John Fetterman by as many as 18 points.

 

FiveThirtyEight’s tracker gives Democrats a 63% chance at holding the Senate, with the most likely outcomes a 50-50 or 52-48 split. Democrats are defending 14 seats, while Republicans are defending 21.

 

McConnell has feuded with National Republican Senatorial Committee chairman Rick Scott of Florida over campaign strategy. Scott released an eleven-point plan outlining GOP policies if they take back Congress, which McConnell blasted asnot “part of the Republican Senate majority agenda.”

Then you have the social media component. The train has left the station. There is no dealing with the rhetoric. At this point, we need serious conversations around preparing for actual violence. Republicans and conservatives have expressed outrage at the Aug. 8 raid on Mar-a-Lago, claiming it was an “abuse of power” by the Justice Department. Cross, who was guest-hosting “The ReidOut,” referred to an incident at the Cincinnati field office of the FBI, where a man armed with a nail gun and a rifle tried to break in before being killed after a standoff, then asked Javed Ali, who once handled counterterrorism for the National Security Council, what could be done to prevent violence.

 

On the average everyday American side, just trying to be a responsible citizen,” Ali said. “If you’re hearing this rhetoric from a neighbor or a friend or somebody like that, engaging in a conversation to try to cool things down. Right now, yes, the atmosphere in the U.S. is very heated. Hopefully, we can de-escalate things.”

 

“I hear your point about having a conversation,” Cross said. “I don’t know if it’s my ministry to have a conversation with a Gaetz supporter.”

 

The host went on to characterize the supporters of Republican Rep. Matt Gaetz of Florida as “willfully ignorant.”

 

“Dangerous rhetoric from the left led to an assassination attempt on a U.S. Supreme Court Justice, a shooting at a Congressional baseball practice, Molotov cocktails at pregnancy centers, rampant crime in major cities, and an open border. Call out the left on their threatening hyperbole, then we will talk,” Republican National Committee spokeswoman Emma Vaughn told the Daily Caller News Foundation.

Sen. Rick Scott Lays Out 11-Point Plan To ‘Rescue America’

Republican Florida Sen. Rick Scott has created an 11-point plan with 128 specific ideas to “rescue America,” which he believes should be the focus of the GOP’s agenda moving into the midterms.

 

The Daily Caller obtained a copy of Scott’s plan and spoke with the current National Republican Senatorial Committee (NRSC) Chairman about his ideas for the party. As a businessman, Scott said he would need to explain his goals in order to receive funding or support and compared it to his job as a Senator, saying he could not raise money without a specific plan. He mentioned that if he expects people to vote for him then he has to give people a reason to vote for him.

 

Scott said he believes the elections will mostly be focused on how bad President Joe Biden’s first term in office has been but added that, since he is running for Senate reelection in 2024, Scott wants people to know what he will be focusing on. The Florida Republican also said that he knows a number of other Republicans who will put out plans with different ideas. According to Scott, House Minority Leader Kevin McCarthy has a similar plan and said he imagines former House Speaker Newt Gingrich would be putting out a plan at some point.

“I think the way you do it is you educate Americans on where things are made. We all try to do it. I’m sure you try to do things locally. But, you’ve got to have an option and you’ve got to know it. So, I think it’s important to decouple from China. I think their government just lies, cheats and steals. I think they’re part of killing 100,000 Americans last year with fentanyl, and I think it’s past time for us to say this idea that they were going to change and get better is just not realistic. Joe Biden Announces ‘Unity Summit’ After FBI Raid on Donald Trump’s Home

President Joe Biden is planning on hosting a “unity summit” to bring together Republicans and Democrats at the White House after the FBI raided former President Donald Trump’s home at Mar-a-Lago.

 

White House press secretary Karine Jean-Pierre announced Biden’s plan to host the summit in a statement on Friday, noting the president wanted to “counter the corrosive effects of hate-fueled violence on our democracy and public safety.”

 

“The United We Stand Summit will bring together heroes from across America who are leading historic work in their communities to build bridges and address hate and division, including survivors of hate-fueled violence,” she wrote.

 

The White House stressed they wanted both Democrat and Republican public officials to attend, as well as civil rights organizations, faith and community leaders, technology and business leaders, and law enforcement officials. It is unclear which Republicans will be invited to attend or speak.

 

Biden has a deep appreciation for summits, as he hosted a “virtual leaders summit” on climate change at the White House last April and a “Summit for Democracy” last December. The announcement of the “unity” summit comes as a growing number of Republicans are outraged over the FBI raid on Trump’s home Mar-a-Lago home.

 

The former president has expressed concern about the growing anger in the country since the raid, even offering to assist the nation in lowering the political temperature.

 

The White House cited the 2017 Charlottesville riots as a motivating factor for the summit, in addition to the multiple mass shootings that took place during Biden’s administration.

 

The priorities of the unity summit were outlined by Biden’s domestic policy adviser, Susan Rice, in a blog post on the White House website.

 

Hate must have no safe harbor in America,” she wrote, noting the summit would “counter the corrosive effects of hate-fueled violence on our democracy and public safety.”

 

Biden will deliver the keynote speech of the summit, according to Rice, and the summit will also include roundtable discussions and panels on preventing radicalization and violence.

 

“Even as our nation has endured a disturbing series of hate-fueled attacks, Americans of all beliefs and political affiliations remain overwhelmingly united in their opposition to such violence,” she wrote.

 

She urged Americans to email UnitedWeStand@who.eop.gov to nominate “an extraordinary Uniter” so that the White House could recognize him or her.

 

“As President Biden said in Buffalo after the horrific mass shooting earlier this year, in the battle for the soul of our nation ‘we must all enlist in this great cause of America,'” she stated, concluding, “The United We Stand Summit will present an important opportunity for Americans of all walks of life to take up that cause—together.”

Judge Temporarily Blocks Parts of Florida’s Stop WOKE Act

A federal judge on Thursday intervened against parts of Florida’s Stop WOKE Act, which aims to protect students, teachers, and employees from being subjected to radical left-wing woke ideologies, criticizing the policies of the act as “bordering on unintelligible.”

 

Chief U.S. District Judge Mark Walker, an Obama appointee, detailed his decision in a 44-page opinion, contending that the act violates the First Amendment.

 

“In the popular television series Stranger Things, the ‘upside down’ describes a parallel dimension containing a distorted version of our world,” Walker wrote. “Recently, Florida has seemed like a First Amendment upside down.”

 

“Normally, the First Amendment bars the state from burdening speech, while private actors may burden speech freely. But in Florida, the First Amendment apparently bars private actors from burdening speech, while the state may burden speech freely,” he continued, before continuing the Stranger Things references.

 

“Now, like the heroine in Stranger Things, this Court is once again asked to pull Florida back from the upside down,” he said, ultimately granting a temporary injunction, blocking the law’s private employer provisions.

 

“If Florida truly believes we live in a post-racial society, then let it make its case. But it cannot win the argument by muzzling its opponents. Because, without justification, the IFA attacks ideas, not conduct, Plaintiffs are substantially likely to succeed on the merits of this lawsuit,” he continued.

 

The law itself targets woke ideology, such as Critical Race Theory (CRT), in both schools and places of employment. Gov. Ron DeSantis (R) originally pitched the law in December 2021, as Breitbart News detailed at the time:

 

The legislation would protect employees, teachers and school staff, and ultimately students and families, he announced on Wednesday during a press conference in Wildwood.

 

Under the legislation, CRT training would be considered an “unlawful employment practice,” making it “clear that corporations and public sector employers violate the Florida Civil Rights Act when they subject their employees to training that espouses race or sex stereotyping or scapegoating including critical race theory.”

 

It also considers CRT discriminatory in the realm of education, stopping what his office describes as “indoctrination in the guise of professional development, and requires districts and schools to adhere to professional development frameworks consistent with Florida’s lawful and publicly adopted state standards.” The measure would also solidify the Florida Board of Education’s previous actions, making them law “to guard students against indoctrinating curriculum.”

 

He ultimately signed the legislation in April. As his office detailed, the measure “includes provisions to prevent discriminatory instruction in the workplace and in public schools and defines individual freedoms based on the fundamental truth that all individuals are equal before the law and have inalienable rights.”

“No one should be instructed to feel as if they are not equal or shamed because of their race,” DeSantis said at the time. “In Florida, we will not let the far-left woke agenda take over our schools and workplaces. There is no place for indoctrination or discrimination in Florida.”

Democratic Georgia gubernatorial candidate Stacey Abrams said Thursday on CNN’s “OutFront ” that her opponent Gov. Brian Kemp (R), was not moderate but instead a “dangerous extremist.”

 

“And so, while I understand the concerns that have been raised, we have to focus on who’s actually responsible and who is in charge,” she said. “Brian Kemp is a dangerous extremist who has tried to hide himself behind one good action, and he has distracted the rest of us or certainly distracted most of America from looking at his actual record. He is trying to play both moderate and MAGA, but he is just extreme. He wants credit for standing up to Trump, but he is refusing to testify, to tell the truth.”
