=Affidavit Focuses on Documents; ‘Classification Markings,’ ‘National Defense Information’

The Department of Justice (DOJ) affidavit seeking the search warrant for the Federal Bureau of Investigation (FBI) raid on former President Donald Trump’s private residence at Mar-a-Lago, Florida, was unsealed by a federal judge Friday afternoon.

The affidavit, signed by a special agent with the FBI, contends that after reviewing 15 boxes of material that Trump handed over voluntarily to the government, the DOJ determined that classified information had not been stored properly and that there might be more of it at Mar-a-Lago. “The FBI’s investigation has established that documents bearing classification markings, which appear to contain National Defense Information (NDI), were among the materials contained in the FIFTEEN BOXES and were stored at the PREMISES in an unauthorized location,” the affidavit said.

“Further, there is probable cause to believe that additional documents that contain classified NDI or that are Presidential records subject to record retention requirements currently remain at the PREMISES. There is also probable cause to believe that evidence of obstmction will be found at the PREMISES.”

One of the government’s concerns was that material in the boxes was poorly organized:

[A] preliminary review of the FIFTEEN BOXES indicated that they contained “newspapers, magazines, printed news articles, photos, miscellaneous print-outs, notes, presidential correspondence, personal and post- presidential records, and ‘a lot ofclassified records.’ Of most significant concern was that highly classified records were unfoldered, intermixed with other records, and otherwise unproperly [sic] identified.”

The agent did not personally know that there was defense-related information in the documents with alleged classification marking, but said that “[b]ased on my training and experience, I know that documents classified at these levels typically contain NDI.”

Curiously, the agent cited a Breitbart News article in which former White House national security official Kash Patel said that Trump had declassified the documents.

Separately, the court also released the government’s legal memorandum explaining the reasons for the redactions in the affidavit.

The categories, described further below, are (1) information from a broad range of civilian witnesses who may be subject to “witness intimidation or retaliation,” D.E. 80 at 9; (2) information regarding investigative avenues and techniques that could provide a roadmap for potential ways to obstruct the investigation, id. at 9-10; (3) information whose disclosure is prohibited under Rule 6(e) of the Federal Rules of Criminal Procedure (“Rule 6(e)”), such as grand jury subpoenas, testimony, and related material, id. at 10; (4) information whose disclosure could risk the safety of law enforcement personnel, id. at 9; and (5) information _whose disclosure could harm “legitimate privacy interests” of third parties.

The “five categories of information that must remain under seal in order to protect the safety of multiple civilian witnesses” did not include national security.

Affidavit: ‘National Security’ NOT Cited by DOJ Among Reasons for Redactions

The Department of Justice (DOJ) did not cite national security as one of the reasons for redacting information in the affidavit for the Mar-a-Lago raid, which was released on Friday.

In addition to releasing the redacted affidavit, Judge Bruce Reinhart also released the government’s legal memorandum explaining the reasons for the redactions in the affidavit.

The government’s “five categories of information that must remain under seal in order to protect the safety of multiple civilian witnesses” did not include national security:

The categories, described further below, are (1) information from a broad range of civilian witnesses who may be subject to “witness intimidation or retaliation,” D.E. 80 at 9; (2) information regarding investigative avenues and techniques that could provide a roadmap for potential ways to obstruct the investigation, id. at 9-10; (3) information whose disclosure is prohibited under Rule 6(e) of the Federal Rules of Criminal Procedure (“Rule 6(e)”), such as grand jury subpoenas, testimony, and related material, id. at 10; (4) information whose disclosure could risk the safety of law enforcement personnel, id. at 9; and (5) information _whose disclosure could harm “legitimate privacy interests” of third parties.

The Washington Post had reported earlier this month that “nuclear documents” might be among the materials the DOJ sought and seized at Mar-a-Lago, raising the stakes.

The intense public interest in the affidavit caused the PACER website to crash.

Ron Johnson: ‘Way Past Time’ to Investigate FBI — They’ve Been ‘Hiding the Ball’ on Us for Years

Thursday on Fox Business Network’s “The Evening Edit,” Sen. Ron Johnson (R-WI) reacted to FBI whistleblowers claiming top officials at the agency were telling agents to delay investigating Hunter Biden’s laptop until after the election involving now-President Joe Biden.

Johnson said it was “way past time” to investigate the FBI, which he argued had “been hiding the ball on the American public for years.”

“They were basically told, ‘Don’t do anything with [the laptop],'” Johnson explained. “By not doing anything with it, they interfered in our election. And of course, other members of our intelligence community have also interfered in our elections.”

“It is way past time that we started investigating the FBI,” he added. “You know, we subpoenaed the FBI under President Trump. President Trump wanted this information made public. It never was made public. They have been hiding the ball on the American public for years.”

Johnson described the laptop as a “treasure trove of information” showing criminal activity. He added that his “concern” was a deal had been cut with the U.S. Attorney that would seal “the full corruption of Biden inc.”

“We didn’t have all the details, but the Hunter Biden laptop did,” Johnson said. “It’s a treasure trove of information. More and more of that information is coming out. It seems quite incriminating. It certainly looks like criminal activity to me. And, again, the FBI has been sitting on this thing since December of 2019.”

Republican Senators Demand FBI Officials Answer for Undermining Probe into Biden Family Business

Sens. Chuck Grassley (R-IA) and Ron Johnson (R-WI) on Thursday demanded FBI officials answer questions about undermining their investigation into the Biden family’s sketchy business after the agency falsely claimed at the time that the Senators were involved in a “Russian disinformation” scheme.

The Republican senators requested intelligence analyst Nikki Floris and counterintelligence deputy Bradley Benavides answer questions next month about an “unnecessary” briefing which undermined the Senators’ inquiry into the Biden family in 2020, according to a report by the Washington Examiner.

According to polling, 58 percent believe President Joe Biden has played a role in his family’s business. Sixty percent say Hunter Biden, a key member of the family enterprise, was “selling influence and access” to Joe Biden.

“Simply put, the unnecessary FBI briefing provided the Democrats and liberal media the vehicle to spread their false narrative that our work advanced Russian disinformation,” the Republican letter reportedly read. The briefing was “unnecessary and was only done because of pressure from our Democratic colleagues, including Democratic Leadership, to falsely attack our Biden investigation as advancing Russian disinformation.”

As many as 15 media personalities claimed Hunter’s laptop emails were likely Russian disinformation. Moreover, many media outlets used Politico’s now-debunked infamous article that detailed 51 intel officials’ belief the laptop was Russian propaganda. Yet the intel letter Politico reported actually suggested the opposite.

Moreover, Facebook’s founder and CEO Mark Zuckerberg revealed on Thursday the FBI warned Facebook of an imminent “dump” of “Russian propaganda” shortly before the Hunter Biden “laptop from hell” story broke, causing the story to be shared to a less “meaningful” degree on the platform.

The demand for the FBI’s appearance came one day after whistleblowers revealed to Sen. Ron Johnson (R-WI) that the leadership of the FBI forbade agents from investigating Hunter Biden’s laptop until after the 2020 election was decided. Johnson wrote to the Justice Department:

After the FBI obtained the Hunter Biden laptop from the Wilmington, DE computer shop, these whistleblowers stated that local FBI leadership told employees, “you will not look at that Hunter Biden laptop” and that the FBI is “not going to change the outcome of the election again.” Further, these whistleblowers allege that the FBI did not begin to examine the contents of Hunter Biden’s laptop until after the 2020 presidential election—potentially a year after the FBI obtained the laptop in December 2019.

According to polling, 74 percent of Americans believe the FBI mislead the public when it claimed Hunter Biden’s laptop was “disinformation.”Seventy-nine percent said former President Donald Trump would have won reelection if Hunter’s laptop was known to voters.

When respondents were asked if they “agreed or disagreed the electorate did not have access to information that could have been critical to their decision at the polls,”78 percent agreed. Twelve percent disagreed.

Schiff: Still Concerned DOJ Moving ‘Very, Very Slowly’ on January 6 Probe

Representative Adam Schiff (D-CA) said Wednesday on MSNBC’s “All In” that he was “still concerned” the Department of Justice is moving too slow in its legal pursuit of former President Donald Trump.

Hayes said, “A few months ago, as you are speaking in public amidst a series of public hearings that the January 6 Committee had as you talked about the Department of Justice and you talked the evidence that the committee had both uncovered and disclosed publicly. I think it is fair to say that you seem almost exasperated by the apparent lack of movement of the Department of Justice on what clearly seems to be a significant factual predicate for an investigation. Things look very different 60 days later. I wanted to check in with what do you think of the developments since earlier this summer in that regard?”

Schiff said, “On the one hand, it is encouraging the Justice Department is willing to follow the evidence where it leads, even when it leads to Mar-a-Lago. I think that is very positive. It certainly appears they were very patient with the former president. They tried asking for the materials that should have never been there. They tried demanding them. They tried a subpoena, and only when it was clear that there was reasonable cause to believe that they were being obstructed, misled, or, that there was evidence of a crime did they feel, was necessarily going to a search.”

He added, “I still am concerned that as to even more serious allegations of misconduct around January 6 the attempt to overturn the election that the department has still been moving very, very slowly. And as to certain lines of effort to overturn the election, I don’t see much effort yet at all by the department.”

WARNING: MAGA, The FBI Is Going to Try to Entrap You, Don’t Take the Bait

Two short weeks later, everything was ruined. A throng of MAGA supporters, with sometimes tacit approval from Capitol Police, got caught up in the moment and stormed the Capitol building on that now infamous day, January 6th, 2021.

Don’t get me wrong, the left-wing media has greatly exaggerated and lied about what happened that day. 99.9% of the Trump supporters who came to Washington on January 6 acted completely peaceful and lawful. But the tiny mob that ran into the building was ruthlessly exploited by the left-wing media to demonize and criminalize Trump supporters as “traitors” and “domestic violent extremists.”

Thus, “January 6th” has replaced 9/11, Pearl Harbor, Gettysburg, and the burning of the White House in liberal American folklore. Random people who snapped a selfie in the Capitol were imprisoned in horrendous conditions. Some are still rotting in their cells.

The Biden administration, which was sworn in just two weeks later, has used the events of that day as a pretext to massively crack down on any dissenting politics in America, using the federal government’s post-9/11 domestic surveillance laws to investigate, harass, and seize personal materials from the president’s inner circle. Meanwhile, the January 6th “select committee” holds one-sided public show trials more concerned with TV ratings and clicks than an honest and robust debate about what actually happened that day.

All of this, of course, is aimed at one thing: preventing Donald Trump from running and winning the presidency again.

Which brings us to the present moment.

The FBI raid on Donald Trump’s home in Mar-a-Lago, allegedly to collect confidential records, has rightfully alarmed and outraged many Americans. I’m mad, and if you’re reading this, you’re probably pretty mad too. The Rubicon has been crossed. We will fight peacefully, lawfully, and in the court of law and public opinion.

Since the raid, some irresponsible actors have been brimming with talk of a new “civil war” and other absurd fantasies.

Let me be clear: Democrats and their toadies in the media are 100% trying to bait Trump supporters into doing something stupid.

Not only are they trying to bait you, but they also have active feds trying to whip up violence, both on social media and in real life.

The deep state wants nothing more than for what already happened in Cincinnati to happen again and again. Don’t fall for these traps. Not only is it wrong morally, it’s strategically stupid.

In the period before January 6th, 2021, we had no idea. No one knew what was about to happen.

Now, the Ghost of Christmas 2020 is back. This time, all of our outrage must be channeled productively and politically, not squandered in a sudden combustion of chaos. All MAGA supporters need to know that anyone talking about violence is either an idiot or a fed, or both.

Trump has been raided, and there’s a real possibility he will be indicted and arrested. The image of seeing a former president in cuffs would be horrifying and enraging for all of us. But violence will actively aid the left’s mission to paint Trump supporters as terrorists and even further escalate the surveillance and persecution of the political right in America.

All conservatives must totally shun anyone who talks of such things. It’s not just useless. it is worse than useless–it’s horrendously damaging to everything we want to do to save America. Last time, we didn’t know what idiots and feds were plotting. This time, we know their tricks. Don’t fall for them.
