Good morning Chairman Leahy, Ranking Member Grassley, and members of the committee. Thank you for the opportunity to appear before the committee today.

 

As you know, my term as FBI Director is due to expire later this summer. In early May, the president asked if I would be willing to serve an additional two years, and I told him I would be honored to do so.

 

The president has further asked that Congress pass the legislation necessary to extend my term, and the committee is considering that legislation at today’s hearing. If my term is extended, I look forward to working with the committee and the men and women of the FBI to meet the challenges that face us in the years to come.

 

The FBI has never faced a more complex threat environment than it does today. Over the past year, we have seen an extraordinary array of national security and criminal threats, from terrorism and espionage to cyber attacks and traditional crimes. These threats have ranged from attempts by Al Qaeda and its affiliates to place bombs on airplanes bound for the United States to lone actors seeking to detonate IEDs in public squares and subways, intent on mass murder.

 

A month ago, the successful operation in Pakistan leading to Usama bin Laden’s death created new urgency for this threat picture. While we continue to exploit the materials seized from bin Laden’s compound, one of the early assessments from this intelligence is that Al Qaeda remains committed to attacking the United States. In addition, we are focused on the new information about the homeland threat gained from this operation.

 

We also continue to face the threat from adversaries, like Anwar Alaqui, who are engaged in efforts to radicalize people in the United States to commit acts of terrorism. In the age of the Internet, these radicalizing figures no longer need to meet or speak personally with those they seek to influence. Instead, they conduct their media campaigns from remote regions of the world, intent on fostering terrorism by lone actors here in the United States.

 

Alongside these ever-evolving terrorism plots, the espionage threat persists as well. Last summer, there were the arrests of 10 Russian spies, known as "illegals," who secretly blended into American society in order to clandestinely gather information for Russia. And we continue to make significant arrests for economic espionage as foreign interests seek to steal controlled technologies.

The cyber intrusion at Google last year highlights the ever-present danger from a sophisticated Internet-attack, Along with countless other cyber incidents, these attacks threaten to undermine the integrity of the Internet and to victimize the businesses and people who rely on it.

 

In our criminal investigations, the FBI continues to uncover massive corporate and mortgage frauds that weaken the financial system and victimize investors, homeowners, and ultimately taxpayers. We are also rooting out insidious health care scams involving false billings and fake treatments that endanger patients and fleece government health care programs.

 

The violence in Mexico remains a threat for the United States, as we saw with the murder of three individuals connected to the U.S. Consulate in Ciudad Juarez in March 2010 and the shooting earlier this year of two DHS Immigration and Customs Enforcement agents in Mexico.

 

And throughout, we are confronted with instances of corruption that undermine the public trust and violent gangs that continue to take innocent lives.

 

In this threat environment, the FBI’s mission to protect the American people has never been broader and the demands on the FBI have never been greater.

 

To carry out this mission, the FBI has taken significant steps since 9/11 to transform itself in to a threat-based, intelligence-led agency. This new approach has driven changes in the Bureau’s structure and management; our recruitment, hiring, and training; our information technology systems; and even our cultural mindset. These changes have transformed the Bureau into a national security organization that fuses traditional law enforcement and intelligence missions. As this transformation continues, the FBI remains committed to upholding the Constitution and the rule of law and protecting civil liberties.

 

Of course, the FBI’s transformation is not complete, as we must continually evolve to meet the ever-changing threats of today and tomorrow. If my term is extended, I look forward to working with the committee and the men and women of the FBI to continue the Bureau’s transformation in the years to come.

Robert Mueller was nominated by President George W. Bush and became the sixth Director of the FBI on September 4, 2001.

 

Born in New York City, Mr. Mueller grew up outside of Philadelphia. He graduated from Princeton University in 1966 and later earned a master’s degree in International Relations at New York University.

 

After college, he joined the United States Marine Corps, where he served as an officer for three years, leading a rifle platoon of the Third Marine Division in Vietnam. He is the recipient of the Bronze Star, two Navy Commendation Medals, the Purple Heart, and the Vietnamese Cross of Gallantry.

 

Following his military service, Mr. Mueller earned a law degree from the University of Virginia Law School in 1973 and served on the Law Review.

 

After completing his education, Mr. Mueller worked as a litigator in San Francisco until 1976. He then served for 12 years in United States Attorney’s Offices, first in the Northern District of California in San Francisco, where he rose to be chief of its criminal division. In 1982, he moved to Boston as an Assistant United States Attorney, where he investigated and prosecuted major financial fraud, terrorist, and public corruption cases, as well as narcotics conspiracies and international money launderers.

 

After serving as a partner at the Boston law firm of Hill and Barlow, Mr. Mueller returned to public service. In 1989 he served in the United States Department of Justice as an assistant to Attorney General Richard L. Thornburgh. The following year he took charge of its Criminal Division. In 1991, he was elected Fellow of the American College of Trial Lawyers.

 

In 1993, Mr. Mueller became a partner at Boston’s Hale and Dorr, specializing in complex white collar crime litigation. He again returned to public service in 1995 as senior litigator in the Homicide Section of the District of Columbia United States Attorney’s Office. In 1998, Mr. Mueller was named United States Attorney in San Francisco and held that position until 2001.

 

Mr. Mueller and his wife, Ann, have two daughters.

Last night in Channelview at the 16000 blk of First Street, three adult males attempted to force entry into a home. The males were armed and wearing masks. The home was occupied by an adult female, 12-yr-old male, and two 17-yr-old males. One of the 17-yr-old male occupants retrieved a shotgun and discharged it several times striking two of the suspects…The 3rd suspect fled in a dark colored, 4-door sedan. There were no other reported injuries.

The DoJ Argues that the Intelligence Community Overrides the Judiciary

At this point in time I have no regard for the probity or competence of the Intelligence Community and neither, apparently, does Judge Aileen Cannon, who earlier this week ordered the appointment of a Special Master to review those documents seized in the Mar-a-Lago raid, which it claims are classified. The Department of Justice appears to have been surprised that it has lost credibility and filed a motion seeking a stay on that portion of the order and a Notice of Appeal to the Eleventh Circuit indicating its intention to file an interlocutory appeal.

 

I don’t think the trial judge who issued a very well-considered order will grant the stay. I don’t think the Eleventh Circuit will, either. I don’t think the Eleventh Circuit will even grant an interlocutory appeal on this matter. I do think all of these pleadings reveal the weakness of the grounds for a search and seizure of materials at the home of Donald J. Trump, the overreach of the warrant, and the expansive search itself. Worse for the DoJ and FBI, I believe their actions amount to a claim that under no circumstances does the judiciary have a right to question anything the Intelligence committee does as long as it makes a claim of β€œnational security.” Such a claim is scary and should be and I think will be denied.

 

Without going into all the fine points of what it means to say a trial court order is an interlocutory order, basically it means that the order is not a final one. In this case, it is merely an order covering discovery matters in a trial. As Seth Barrett Tillman tweeted, ”The government has not been forced to return any materials, and no privilege rulings have been made for which to take an appeal.” He also gives an example of such an interlocutory, unappealable action by a trial court: He notes that J. Messitte refused to decide Trump’s motion to dismiss the Emoluments Clauses case and sat on it for three years until after the election when he dismissed it as moot after Trump lost.

 

Why is the DoJ so desperate to prevent a Special Master, even one with security clearance, to view those documents the department asserts are classified? (The parties each have offered two candidates for the position, one of Trump’s candidates, in fact, sat on the FISA court. Is he less certain to do this job properly than the National Archivist?) There are several possible explanations for the desperation I can think of – none of which do credit to the attorney general. The first and most common supposition is that the documents which they claim must be kept even from the eyes of the Special Master relate to the FBI and DoJ’s role in fashioning and perpetrating the phony Russian Collusion fairytale. That would be damning indeed, and frankly, I see it as the most likely explanation: It is improper to classify documents simply to prevent embarrassment to persons or agencies. And anyone who does this is subject to sanctions. Obama’s Executive Order 13526 reads in relevant part:

Sec. 1.7. Classification Prohibitions and Limitations. (a) In no case shall

information be classified, continue to be maintained as classified, or fail

to be declassified in order to:

 

(1) conceal violations of law, inefficiency, or administrative error;

(2) prevent embarrassment to a person, organization, or agency;

(3) restrain competition; or

(4) prevent or delay the release of information that does not require protection in the interest of the national security.

 

Despite leaking staged photos of the fruits of the search, along with claims that it involved β€œnuclear” information, in the latest pleading it’s revealed that the searchers seized copious amounts of news clippings, some clothing, passports, personal tax records and material clearly covered by attorney-client privilege. In other words, the agents seem to have viewed this is a general warrant to grab everything, something not permitted. The only β€œnuclear” thing mentioned is some document about the nuclear capacity of a foreign government – hardly the nuclear code which had been bruited about by some media lackeys.

 

I think the delay rankles and disturbs DoJ as much as the likelihood that a Special Master will find the β€œclassified” information was legally declassified by Trump and had been improperly classified in the first instance to protect those who engaged in this wrongful smear of a political candidate.

 

This, the second of my suppositions is related to the Hail Mary effort to stay the portion of the order which temporarily enjoins the government (pending completion of the Special Master’s review of further court order) from reviewing and using the seized materials for investigative purposes. The warrant was issued before the grand jury in D.C. even received or reviewed the 15 boxes of documents Trump turned over to the government. This suggests the department was eager to use whatever they could hose up at Mar-a-Lago before a further examination of the legality of their actions could be done and not coincidentally in time to affect the midterms.

 

In the meantime, the department yet again has been engaged in a leak to poison public opinion and any potential jury trial.

The feds continued to leak like crazy after the order, in a form of lashing out, getting the word out to The Washington Post that some of the documents related to a foreign government’s nuclear program (the leak didn’t say that such documents were classified). For years during Russia Collusion attacks, whenever there was a news cycle that might help Trump in the public eye, the feds leak something to grab back the news cycle; that tactic seems to be renewing itself.

Like Mark Wauck, I see these pleadings as asserting that the Intelligence community the very folks who promulgated and promoted the Russian Collusion story and went on to cast substantial doubt on the Hunter Biden computer contents, asserting they were likely β€œRussian disinformation” should be the sole arbiter of such matters. The problem with losing your credibility is that no sensible person will trust you again. As lawyers often tell juries, β€œ"false in one thing, false in everything." True of government officials and agencies as it is for the rest of us.

 

In sum, my hunch is that this latest effort by the Deep State is not going to go anywhere for a long time, if at all.

EXC: Zuckerberg Group Spending $80M to Hijack Local Election Practices and Help Liberals.

 

Despite claiming not to get involved again, the Facebook founder’s group is doubling down on its election interference.

 

The Center for Tech and Civic Life – a nonprofit group that controversially used funds from Mark Zuckerberg to boost turnout for Democrats in the 2020 election – launched a new $80 million initiative targeting local election departments.

 

Under the leadership of Tiana Epps-Johnson, the Center for Tech and Civic Life (CTCL) overruled local election officials and increase turnout in almost exclusively Democratic districts through mail-in voting in 2020. Proving the partisan conflict of interest, the CTCL supported many election offices’ shifts to vote-by-mail and allegedly accessed mail-in ballots ahead of the election using funds from the Facebook founder’s Chan Zuckerberg Initiative.

 

Though the group purports to be nonpartisan, following several exposΓ©s into the group’s left-wing bias, the CTCL appears to be launching a new $80 million initiative to extend its influence over America’s election departments.

 

Announced in April of 2022, the U.S. Alliance for Election Excellence is described as a β€œnonpartisan collaborative that is bringing together election officials, designers, technologists, and other experts to help local election departments improve operations, develop a set of shared standards and values, and obtain access to best-in-class resources to run successful elections.”

 

The alliance’s website provides scant details on how it plans to accomplish its aforementioned goals.

 

Local election departments appear to be able to apply to become a β€œCenter for Election Excellence” and, if approved, will receive funding from the alliance.

 

β€œDuring the first year of the program, we’re identifying local election departments who want to join the Alliance and serve as a support system for each other and for other election departments across the country. These offices will be recognized as U.S. Centers for Election Excellence,” explains the procedure.

 

β€œCenters will participate in co-creating values and standards of election excellence which will be rolled out to jurisdictions nationwide, uplifting and advancing the profession of election administration in the years to come,” adds the group, which will also β€œsend $80 million in the next five years to election departments across the United States in need of basic funding for equipment replacement and other resources,” according to the Washington Post.

 

The CTCL is working with six additional partners on the venture including the Center for Civic Design and the Center for Secure and Modern Elections (CSME).

 

The CSME purports to be bipartisan; however, it was created as a project of the New Venture Fund, the leading β€œdark money” sponsor for left-wing causes. The New Venture Fund has been criticized by even the New York Times for its β€œsystem of political financing, which often obscures the identities of donors,” as β€œdark money,” calling the network β€œa leading vehicle for it on the Left.”

 

Similarly, the Center for Civic Design partners with left-wing groups and financiers to support election initiatives favorable to Democrats, including vote-by-mail and automatic voter registration.

 

The alliance appears to be a rebranding effort by the CTCL, whose actions during the 2020 election have led to bans on private funding of elections and investigations into its shady conduct. Earlier this year, Zuckerberg even claimed that he would not be engaging in the effective privatization of local election offices again – a claim belied by the latest CTCL announcements.
