The Westfall Act says the DOJ must defend government employees whenever they have legal problems that arose while performing acts within the scope of the Government. For instance, Trump is currently being defended by Biden's DOJ in the lawsuit filed against Trump by E. Jean Carrol.

 

If you remember she said Trump raped her, Trump started talking shit about her, she sued for defamation and since Trump was POTUS, the DOJ said him talking shit about her was a Presidential action, and under the Westfall act, they were obligated to defend him. Biden has kept the defense going.

All that to say, if Trump wins 2024, and he still has Georgia and Mar-A-Lago problems, he could easily say that shit was done with in the scope of him being president, therefore the DOJ would have to defend Trump against themselves as far as Mar-A-Lago is concerned.

 

Be some wild shit. But Haberman is partially right. I don't agree with backing himself into a corner, so he is running. I think he always wanted to run in 2024, legal problems or not. But she's right in that being President will help out a lot in his legal woes.
