COHEN: We all are waitÂing for the Supreme Court’s ruling in New York State Rifle & Pistol AssoÂciÂation, Inc. v Bruen. Of course, I haven’t read every essay or analysis on the case or the oral arguÂment that took place on it last fall, but I have yet to come across a Second AmendÂment scholar or gun policy expert who says the Court’s conserÂvatÂive majorÂity will side with New York and against the interests of gun owners. What’s your sense of the scope of the decision we are most likely to see here? What’s your predicÂtion?
MILLER: Other than feelÂing very confidÂent that the existÂing New York State pistol licensÂing law will be struck down, I have very little sense of the scope of the decision we’re likely to see in the next month or two. The justices at oral arguÂment seemed genuÂinely concerned that a broad ruling on public carry would embroil them in all kinds of minuÂtiae about where guns can be prohibÂited — campuses, subway cars, Times Square on New Year’s Eve, etc. I cannot believe that they have much appetÂite for transÂformÂing every federal district court judge in the counÂtry into a gun zoning czar. That said, there’s a conserÂvatÂive superÂmaÂjorÂity on the Court that is clearly ready to flex its muscles on issues that conserÂvatÂives have long cared about — from aborÂtion restricÂtions, to free exerÂcise, to gun rights — so I can’t rule out a broad and broadly disruptÂive ruling that would upend not only New York’s reguÂlaÂtions but would call into quesÂtion the constiÂtuÂtionÂalÂity of nearly every gun reguÂlaÂtion, in every state, at every level of governÂment.
COHEN: You have writÂten a great deal on the Second AmendÂment and how poliÂcyÂmakers can and should approach the tension between gun rights and gun reguÂlaÂtions. One article that caught my eye, posted last year, advocÂated for an “equiÂlibÂrium adjustÂment” approach to Second AmendÂment law, a sort of slidÂing scale of reasÂonÂableÂness that would presumÂably protect some existÂing gun laws while strikÂing down others. Sounds optimÂistic to me, given what we know of the Court’s ideoÂloÂgical makeup. Are you lookÂing for anything in Bruen that would help you evalÂuÂate whether the Court is receptÂive to this “equiÂlibÂria” approach?
MILLER: The primary point I wanted to make in that article is that if the Court ends up leanÂing heavÂily or exclusÂively on text, history, and tradiÂtion to decide Second AmendÂment cases, the process of reasÂonÂing from analogy from those sources has to apply equally on both sides of the rights/reguÂlaÂtion equaÂtion. The Court has firmly rejecÂted arguÂments that only 18th-century weapons are protecÂted by the Second AmendÂment. But that arguÂment should apply to reguÂlaÂtions too
— more than just those reguÂlaÂtions that exisÂted in the 18th century are constiÂtuÂtional. So, if the Court holds that new kinds of weapons
— like 9-milliÂmeter pistols
— are “similar” enough to historÂical weapons to count as an “arm” under the Second AmendÂment, the Court should say new kinds of reguÂlaÂtions
— like prohibÂitÂing guns on the subway
— are “similar” enough to historÂical reguÂlaÂtions to be constiÂtuÂtional.
