Judge Allows Justice Gableman to Represent Election Integrity Activist Harry Wait Despite WI DOJ’s Objections

 

On Friday in Racine, WI, Judge Robert Repischak shut down the Wisconsin Department of Justice’s attempts to deny Harry Wait’s right to choose his own defense attorney.

 

Harry Wait, an election integrity activist exposed an active loophole in the Wisconsin Elections Commission’s (WEC) MyVoteWI.com website, which allows anyone to order anyone else’s absentee ballot with only a name and a birthdate.

 

In July, Wait, with the permission of several friends, successfully ordered their ballots to be delivered to his home.

 

He also ordered Wisconsin Republican Robin Vos, Speaker of the State Assembly, and Democrat Mayor of Racine, Corey Mason’s ballots successfully without their consent.

 

Wait notified the WEC, the offices of Vos and Mason and the Racine County Sheriff’s department among others, the same night he ordered the ballots, informing them of his ability to successfully do so. Vos apparently took action to prevent his ballot from being mailed, however, Wait still received Mayor Mason’s ballot!

 

Rather than thank Harry Wait for his efforts to alert WEC of the open and active loophole in their system and ensure Wisconsin voters’ absentee ballots were secure, the WEC made a complaint to the Wisconsin Department of Justice, who subsequently indicted Wait, charging him with 2 counts of voter fraud and 2 counts of identity theft.

 

Wait initially intended to represent himself in the criminal proceedings, however eventually received council and representation from former Wisconsin Supreme Court Justice Michael Gableman. You may be familiar with Gableman who was previously hired by Robin Vos on behalf of the State Assembly to investigate voter fraud in the 2020 Elections.

 

Vos received a serious primary challenge in 2022 after failing to do anything meaningful with findings from Gableman’s investigation. Instead, after fending off that challenge, Vos fired Gableman and shut down his investigation the day after the primary election.

 

After appearing to represent Wait at a preliminary hearing this fall, it was unclear if Gableman would continue to represent him, when Democrat Attorney General Josh Kaul’s prosecutors claimed Gableman may have a conflict of interest.

 

The prosecutors claimed that because Gableman, who was hired by Vos in his capacity as Assembly Speaker, to lead an investigation for the the State Assembly, Vos may have had confidential conversations with Gableman that could create a conflict or violation of attorney client privilege if Gableman were to represent Wait.

 

Keep in mind, during that investigation Vos was not a “client” of Gableman and in the prosecution against Harry Wait, Vos is a witness, not a plaintiff.

 

Wait’s attorney Dan Hartman argued Wait has a 6th Amendment Constitutional right to choose his own attorney and due to the nature of Gableman’s engagement with the General Assembly, not Robin Vos personally, there was no possible conflict of interest or possible risk of Gableman exposing anything Robin Vos may have told him, because Vos could not have told him anything that would be required to remain confidential in that scenario.

Texas Secretary of State John Scott has announced his resignation after what he called a "successful" 2022 General Election, which followed a rocky primary in which counties threw out nearly 23,000 mail ballots as a result of voters' struggling to navigate new mail-in voting requirements.

 

"With a successful 2022 General Election in the rear view mirror … I write to inform you that I intend to return to my private law practice at the beginning of the New Year," Scott said Monday, making his resignation effective on Dec. 31, 2022.

Human rights org reveals 48 more secret Chinese 'police stations' worldwide, including in LA & NYC

 

The additional 48 locations adds to the original report from September 2022 that revealed 54 Chinese outlets, totaling at least 102 known instances where Chinese police are conducting operations inside other countries. The original report identified one location in New York City under the police jurisdiction of Fuzhou, China, while the new list adds three more entities in the United States. New locations have been identified in New York and Los Angeles operated from the Wenzhou, China, police jurisdiction, while a third operation's exact location is unknown, but is run under the Nantong, China, jurisdiction.

At least two locations have been located in Canada according to CTV News, stating that Safeguard Defenders, a Spanish nongovernmental organization, uses open-source statements from Chinese authorities, Chinese police, as well as state media to document the stations.

Republicans condemn Trump after controversial remark about the Constitution: 'He’s become a toxic force'

 

Senate Republicans fed up with former President Donald Trump are increasingly airing their grievances publicly.

What is the background?

 

Over the weekend, Trump was accused of calling for the termination of the U.S. Constitution after demanding the results of the 2020 presidential election be thrown out.

 

"Do you throw the Presidential Election Results of 2020 OUT and declare the RIGHTFUL WINNER, or do you have a NEW ELECTION? A Massive Fraud of this type and magnitude allows for the termination of all rules, regulations, and articles, even those found in the Constitution," Trump said on Saturday. "Our great ‘Founders’ did not want, and would not condone, False & Fraudulent Elections!"

What are Republicans saying?

 

Trump was already under a microscope in Republican circles after Trump-endorsed personalities either lost or narrowly won contests in the 2022 midterm elections, compared to moderate Republicans who won easily.

 

If three consecutive losing elections were not enough, Republicans further distanced themselves from Trump after his controversial dinner with rapper Kanye West. Now, dismissing the Constitution has Republicans directly speaking out against Trump and his 2024 ambitions.

 

"I’m at a loss for words. We need to move on," Sen. John Cornyn (R-Texas) told Politico, explaining that Trump's 2024 prospects are "increasingly less likely, given statements like that."

 

"The facts of the election in 2022 are just indisputable. The ultra, pro-Trump, handpicked by Trump, based on loyalty to Trump? Those candidates wildly underperformed," explained Sen. Pat Toomey (R-Pa.). "It’s pretty clear that he’s become a toxic force and that’s going to diminish his influence a lot."

 

Sen. Ben Sasse (R-Neb.), who, like Toomey, is retiring from politics, said, "People in my party have to decide: Do they want to keep giving oxygen to somebody who is trying to sell tickets to his own proprietary circus, or do they want to be a constitutional party that has a clear agenda."

 

"Well, I think you take an oath to the Constitution, you don’t take it provisionally," Sen. Roy Blunt (R-Mo.) said, NBC News reported. "And I can’t imagine that a former president would make that statement."

 

Virginia Gov. Glenn Youngkin, meanwhile, said on Tuesday, "I completely disagree with his comment."

 

Senate Minority Leader Mitch McConnell, moreover, suggested that Trump's comments are prima facie disqualifying for the presidency.

 

"Let me just say, anyone seeking the presidency who thinks that the Constitution could somehow be suspended or not followed, it seems to me would have a very hard time being sworn in as president of the United States," McConnell said.

How did Trump respond?

 

The former president defended himself from accusations that he called for the termination of the Constitution.

 

"The Fake News is actually trying to convince the American People that I said I wanted to 'terminate' the Constitution. This is simply more DISINFORMATION & LIES," Trump claimed Monday.

Fiji's attorney-general, Aiyaz Sayed-Khaiyum, caught in extraordinary dispute just a week out from national election

 

Fiji's election supervisor has accused one of the country's major political parties of "misinformation" after it claimed the attorney-general had visited an election printing centre and ordered CCTV cameras be turned off.

The extraordinary dispute comes as political tensions intensify in the lead-up to next week's national election in the Pacific Islands country.

 

In a letter to the supervisor of elections (SOE) sent yesterday, the National Federation Party (NFP) said it had been informed that incumbent attorney-general and Fiji First candidate Aiyaz Sayed-Khaiyum went to Start Printery early on December 1.

 

It said that election officials asked Mr Sayed-Khaiyum to leave because election ballots were being printed, but he refused.

 

The letter also claimed the attorney-general refused a police request to vacate the premises, not leaving until after Supervisor of Elections Mohammad Saneem had arrived.

'Flabbergasted by your allegations'

 

In the letter to the SOE, NFP officer Dalip Kumar said it was a serious issue.

 

"It is your responsibility to ensure that, at all times during the printing and distribution process, the ballot papers are stored in 'highly secure premises'," Mr Kumar wrote.

 

"The premises cannot be considered 'highly secure' if the secretary-general of the ruling party can enter those premises and insist on staying when asked to leave."

 

However, in a fiery response yesterday afternoon, Mr Saneem said the claims in the NFP letter were fabricated, accusing the NFP of spreading lies.

 

"I am flabbergasted by your allegations around the information you purport to have received that I have come to any scene … I wish to confirm that no such activity ever took place," Mr Saneem said.

 

He said the final delivery of ballot papers from the printery took place on November 28, three days before the alleged incident, in the presence of election observers, party agents and the media.
