I have a theory:
The courts are known to be corrupt. You wouldn't introduce cases that could actually be litigated there, when "the military is the only way" -this evidence is/was/will be litigated elsewhere.
You would write big noisy PR pieces to make the public aware of the issues, and let them be thrown out to piss off John Q about "how corrupt the courts are!"
