Had Plaintiffs’ case been allowed to proceed to discovery, additional damning evidence similar to the recent revelations summarized above doubtless would have come to light, proving the truth of Plaintiffs’ claims. Instead, the District Court dismissed the action, notwithstanding that Plaintiffs’ allegations are significantly more extensive and detailed than those presented in Supreme Court and Ninth Circuit cases where state action was found to exist. It also dismissed the state law claims for lack of standing.
